APRIL 20, 2010 — SIXTEENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

 

The Board of Supervisors met on Tuesday, April 20, 2010 at 9:00 a.m.  Board members present were Boykin, Smith, Monson, Walish and Clausen.  Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

 

The Claims were approved as presented.  Copy filed.

 

The meeting was called to order.

 

Motion by Walish second by Monson to approve the minutes of the April 13, 2010 Board Meeting.  Carried 4-0: Clausen abstained.

 

The Board approved the transfer of Loan H. Hensley, County Attorney Dept., to Asst. Attorney-Juvenile, effective 04/21/2010.   Job vacancy posted:  03/03/2010 to 03/26/2010.  Copy filed.

 

Motion by Clausen second by Walish to approve and authorize the Chairman to sign an “Authorization to Initiate Hiring Process” form for a Civil Attorney, County Attorney Dept.  Entry Level:  Wage plan comparability salary range:  $47,931-$55,431/year, based on experience.  Carried 5-0.  Copy filed.

 

Motion by Clausen second by Smith to postpone action to approve and authorize the Chairman to sign a Resolution approving petition for suspension of taxes through the redemption process for Wayland Zimmerman, 5201 Rustin Street, Sioux City, Iowa.  Carried 5-0.

 

A public hearing was held at 10:15 for property parcel #326505 (aka 3113 13th Street).  The Chairman called on anyone wishing to be heard.

 

Motion by Clausen second by Walish to close the hearing.  Carried 5-0.

 

     Mike Gries bid $500.00 plus recording fees.

     Lorren Bjornsen bid $600.00 plus recording fees.

 

Motion by Clausen second by Monson to accept the bid from Loren Bjiorson for the property parcel #326505 (aka 3113 13th Street).  Carried 5-0.

 

RESOLUTION OF THE BOARD OF SUPERVISORS

RESOLUTION # 10,659

 

     BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

 

By Lorren & Carol Bjornsen_____________in the sum of Six Hundred & 00/100 ($600.00)--------------------dollars.

 

For the following described real estate, To Wit:

 

Parcel #326505

            Long View Addition, Lots 10, 11, & 12 in Block 6 in Sioux City, Iowa and Woodbury 

           County   

           (3113 13th Street)

 

Now and included in and forming a part of the City of Sioux City, Iowa, the same is hereby accepted: said Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said Real Estate.

 

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.

 

BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes.  Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

 

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

Motion by Smith second by Monson to approve and authorize the Chairman to sign a Resolution approving petition for suspension of taxes for Kathy Kay Bateman, 506 Prescott Street, Sioux City, Iowa.  Carried 5-0.

RESOLUTION #10,660

RESOLUTION APPROVING PETITION FOR SUSPENSION OF TAXES

 

WHEREAS Kathy Bateman, as titleholder of a property located 506 Prescott Street, Sioux City, Woodbury County, Iowa, and legally described as follows:  

 

 Parcel #894730134004

 

Lot Eleven (11) Block Fourteen (14) Highland 3 Addition, City of Sioux City, Woodbury County, Iowa

 

WHEREAS, Kathy Bateman of the aforementioned property has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and 

 

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

 

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

RESOLUTION # 10,661

RESOLUTION APPROVING PETITION FOR SUSPENSION OF TAXES

 

WHEREAS, Dorothy Samaniego and Victor Samaniego, are the titleholders of a mobile home located at 3700 – 28th Street, Lot 479, City of Sioux City,  Woodbury County, Iowa, and legally described as follows:

WHEREAS, Dorothy Samaniego and Victor Samaniego  as titleholder of the aforementioned mobile home have petitioned the Board of Supervisors for a suspension of taxes pursuant to the 2009 Iowa Code section 427.9, and 

 

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

 

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

Motion by Smith second by Walish to receive the “Sheriff’s Civil Division Quarterly Report” for the 3rd quarter ending 03/31/2010.  Carried 5-0.  Copy filed.

 

The Board reviewed final platting for Day Addition, a minor subdivision, GIS parcel #8946 17 300 002, with Planning and Zoning Administrator, John Pylelo.

 

Motion by Clausen second by Monson to approve the final plat for Day Addition Subdivision, GIS parcel #894617300002, and forward it to the Zoning Commission for review and recommendations.  Carried 5-0.

 

Motion by Walish second by Monson to receive the quote submitted by L.A. Carlson Contracting Inc., Merrill, Iowa and award them the contract for Project #L-W09(1)—73-97 (Stream Stabilization Structure), per recommendation of County Engineer Mark Nahra.  Carried 5-0.  Copy filed.

 

Motion by Monson second by Smith to approve and authorize the Chairman to sign a Permit and agreement for use of County Road Right-of-Way, submitted by Woodbury Central School, for surfacing of driveway on Fair Street and Jackson Street per recommendation of County Engineer.  Carried 5-0.  Copy filed.

 

The Board discussed the SNOWCAP alert system with Annette Griffin.

 

Motion by Monson second by Walish to approve action on SNOWCAP from riverboat funds.  Carried 4-0; Clausen abstained.  Copy filed.

 

The Board discussed action on the Courthouse Cafeteria with Board of Supervisor, Jackie Smith.

 

Motion by Monson second by Walish to provide up to $30,000.00 of Riverboat Funds to purchase equipment for the Courthouse Cafeteria.  Carried 5-0.  Copy filed.

 

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda, or Supervisors concerns.

 

The Board adjourned the regular meeting until April 27, 2010.
