SEPTEMBER 28, 2010 — THIRTY-NINETH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, September 28, 2010 at 9:00 a.m.  Board members present were Boykin, Clausen, Monson, Smith, and Walish.  Staff members present were Karen James, Board Administrative Coordinator, Joshua Widman, Assistant County Attorney and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented.  Copy filed.

The meeting was called to order.

Motion by Monson second by Walish to approve the minutes of the September 21, 2010 Board meeting.  Carried 5-0.  Copy filed.

Motion by Smith second by Clausen to approve and Authorize the Chairman to sign a Resolution approving suspension of taxes for Siouxland Residential Services, Inc., 1815 Pierce St, Sioux City, Parcel #894721313006.  Carried 5-0.

RESOLUTION APPROVING ABATEMENT OF TAXES

WHEREAS, Siouxland Residential Services Inc. is the titleholder of real estate Parcel #894721313006,  located in the City of Sioux City, Iowa and legally described as follows: 
 
Parcel #894721313006

West Forty-eight feet (W 48 ft) Lot One (1) Block Seventeen (17) Higmans 2nd Addition, City of Sioux, Woodbury County, Iowa

WHEREAS, the abovestated property has taxes owing for the 2009/2010, tax year and the parcel is owned by Siouxland Residential Services Inc., and

WHEREAS, the organization, namely Siouxland Residential Services Inc.  is failing to immediately pay the taxes due; and 

WHEREAS,  the Board of Supervisors sees that good cause exists for the abatement of these taxes; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates  the taxes owing on the above parcel according to Code of Iowa, 445.16 for the taxes owed for the 2009/2010 tax year and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

WHEREAS, Diocese of Sioux City is the titleholder of  real estate Parcels #884707278008 located in Woodbury County, Iowa and legally described as follows:

LL-SC Comm. 88-47 Irreg. Tct SWly ff NaTalia Way Being 316. 12 Ft On W & 338.35 Ft On SW S 1/3 NE 7-88-47, City of Sioux City, Woodbury County, Iowa

WHEREAS, the abovestated property has taxes owing for the 2009/2010, tax year, and the parcel is owned by Diocese of Sioux City; and

WHEREAS, the organization, namely Diocese of Sioux City is failing to immediately pay the taxes due; and 

WHEREAS,  the Board of Supervisors sees that good cause exists for the abatement of these taxes; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates  the taxes owing on the above parcel according to Code of Iowa, 445.16 for the taxes owed for the 2009/2010 tax year and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

Motion by Monson second by Walish to approve and authorize the Chairman to sign the Woodbury County Local Hazard Mitigation Plan-Multi Jurisdiction Agreement, per recommendation of Director Woodbury County Emergency and Disaster
 Services, Gary Brown.  Carried 5-0.  Copy filed.

Motion by Clausen second by Monson to approve and authorize the Chairman to sign a Certification and Assurance form referencing the DMC DR – FFY11 Grant Project Abstract as the Authorized County Official per recommendation of David Gleiser.  Carried 5-0.  Copy filed.
 
The Board discussed 2010 City Assessor homestead and military tax credits with County Budget/Tax Analyst Dennis Butler.
Motion by Walish second by Smith to approve the 2010 City Assessor homestead and military tax credits.  Carried 5-0.
Motion by Monson second by Clausen to approve and authorize the Chairman to sign a payment voucher for IDOT for materials testing for project number Bros-CO97(84)---5f-97, per recommendation of the County Engineer, Mark Nahra. Carried 5-0.  Copy filed.
 
Motion by Smith second by Walish to approve and Authorize the Chairman to sign a Certificate of Completion for 2010 Pavement Marking Contract, per recommendation of the County Engineer, Mark Nahra.  Carried 5-0.  Copy filed.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda, or Supervisors concerns.

James Van Bruggen of the Tax Research Conference discussed, with the board, the revenue shortfall brought about by the lack of federal prisoners being placed in the county jail.
 
The Board adjourned the regular meeting until October 5, 2010.
