MARCH 29, 2011 — TWELVTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, March 29, 2011 at 10:00 a.m.  Board members present were Boykin, Clausen, Monson, Smith, and Tripp. Staff members present were:  Karen James, Board Administrative Coordinator, Joshua Widman, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented.  Copy filed.

Motion by Clausen second by Boykin to go into closed session per Iowa Code Section 21.5(1)(C).  Mr. Tripp excused himself.  Carried 4-0 on a roll-call vote. 

Motion by Smith second by Boykin to go out of closed session per Iowa Code Section 21.5(1)(C).  Carried 4-0 on a roll-call vote. 

Motion by Clausen second by Boykin to go into closed session per Iowa Code Section 20.17(3).  Carried 5-0 on a roll-call vote.

Mr. Tripp excused himself from the session.

Motion by Boykin second by Clausen to go out of closed session per Iowa Code Section 20.17(3).  Carried 4-0 on a roll-call vote. 

The meeting was called to order.
 
Motion by Clausen second by Boykin to approve the minutes of the March 22, 2011 Board meeting.  Carried 5-0.  Copy  filed.

The Board approved the separation of Marvin Flewelling, Temporary Equipment Operator, Secondary Roads Dept., effective 03-25-2011.    End of Temporary Work.   Copy filed.

The Board approved the Promotion of Lee Blanchard, Jail Sergeant, Sheriff Dept., $23.46/hour, 21%=$4.08/hr,  effective 04-04-2011.    Promotion from Sr. Civilian Jailer to Civilian Jail Sergeant.   Copy filed.
 
The Board approved the Separation of Mary Brown, Secretary, Human Resources Dept., effective 04-29-2011.    Retirement.   Copy filed.

Motion by Boykin second by Smith to approve and authorize the Chairman to sign an “Authorization to Initiate Hiring Process” for Secretary, Human Resources Dept., Wage Plan:  $15.70-$16.89 Based on Experience  Carried 5-0.  Copy filed.

Motion by Boykin second by Tripp to approve Mary Brown’s request to remain on County Insurance Plans.  Carried 5-0.

Motion by Boykin second by Clausen to approve and Authorize the Chairman to sign a Resolution approving suspension of taxes for Charles Kass, 3311 E. 5th St, Sioux City, Parcel #894726329021.  Carried 5-0.

RESOLUTION APPROVING ABATEMENT OF TAXES
                  
WHEREAS, Charles E. Kass, is the titleholder of a property located at 3311 E. 5th St., City of Sioux City,  Woodbury County, Iowa, and legally described as follows:  
    
Parcel #  8947 26 329 021

Lots Thirty-seven thru Forty (37-40) Block Three (3) Eden Park Addition, City of Sioux City, Woodbury County, Iowa

WHEREAS, Charles E. Kass  as titleholder of the aforementioned property have petitioned the Board of Supervisors for a suspension of taxes pursuant to the 2009 Iowa Code section 427.9, and 

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

Lot Twenty-One of the Viking Village Ninth Addition, City of Sioux City,    
Woodbury County, Iowa

NOW THEREFORE,
BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1.  That a public hearing on the aforesaid proposal shall be held on
      the  12th  Day of April, 2011 at 10:15  o’clock a.m. in the meeting
      room of the Board of Supervisors on the first floor of the Woodbury
     County Courthouse.
     
2.  That said Board proposes to sell the said parcel of real estate at a
      public auction to be held on the 12th  Day of April, 2011, immediate        
      following the closing of the public hearing.
     
3.   That said Board proposes to sell the said real estate to the highest
       bidder at or above a total minimum bid of $26.00 plus recording fees.

      public auction to be held on the 12th  Day of April, 2011, immediate        
      following the closing of the public hearing.
     
3.   That said Board proposes to sell the said real estate to the highest

Motion by Boykin second by Clausen to sign a contract between Juvenile Detention and Bureau of Indian Affairs per recommendation of Mark Olsen, Juvenile Detention.  Carried 5-0.  Copy filed.

 There was a discussion on a substitution of a carpet product for the courthouse.  Per recommendation of Mark Elgert, Building Services; there was a consensus to allow the substitution.

Motion by Boykin second by Clausen to approve and authorize the Chairman to sign a Permit to Work in the County Right of Way submitted by Brian Ashley per Recommendation of County Engineer Mark Nahra.  Carried 5-0.  Copy filed.

Motion by Boykin second by Smith to approve a resolution to establish emergency temporary embargos on 220th Street, Route L-21 and D-50/L-27 per recommendation of the County Engineer.  Carried 5-0.

RESOLUTION # 10,760
EMERGENCY TEMPORARY EMBARGO

WHEREAS, the Woodbury County Board of Supervisors believe certain secondary roads in Woodbury County, Iowa which are paved or unpaved,  will be seriously damaged or destroyed unless the use of vehicles thereon is prohibited or permissible weight thereon reduced, and

WHEREAS, Chapter 321, Section 471 of the Code of Iowa, gives said Board the power to prohibit the operations of said vehicles on such roads, and to impose restrictions as to the weight of vehicles on said roads.

NOW THEREFORE BE IT RESOLVED by the Woodbury County Board of Supervisors, that, where signs are erected on a highway, operations of vehicles weighing in excess of said weight limit are prohibited on said highway.

IT IS FURTHER RESOLVED that the said secondary roads subject to this resolution are more particularly described in exhibit “A”, attached thereto and by this reference made part hereof.  The effective period of this resolution begins March 30, 2011, until in the judgment of the County Engineer road conditions have improved and the embargo can be removed.   The embargo may not be in place beyond June 30, 2011.
