JUNE 09, 2011 — SPECIAL MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Thursday, June 09, 2011 at 1000 a.m. Board members present were Clausen, Monson, Smith, and Tripp; Boykin was absent.  Staff members present were Karen James, Board Administrative Coordinator, Joshua Widman, Assistant County Attorney and Patrick F. Gill, Clerk to the Board.
Meeting was called to order.
Motion by Smith second by Clausen to approve and receive for signatures a Resolution approving an ordinance to regulate parking on Port Neal Circle.  Carried 4-0.

RESOLUTION #10,783
PARKING ON PORT NEAL CIRCLE
                             
WHEREAS: The Board of Supervisors of Woodbury County as empowered under the authority of the Iowa Constitution Article III, section 39A and sections 321.239 and 321.358, subsection 13 of the Code of Iowa may adopt, amend, or repeal traffic regulations that prohibit the standing or parking of vehicles within the right-of-way of any highway under its jurisdiction, and

WHEREAS: Increased parking along Port Neal Circle by sightseers is interfering with construction equipment and activities as well as normal business operations of Port Neal businesses and industries during the flood event, and

WHEREAS: Parked vehicles in the right-of-way along Port Neal Circle during the current flood event constitute immediate and dangerous hazards in the right-of-way under Chapter 318 of the Code of Iowa, and

NOW, THEREFORE BE IT RESOLVED, by the Woodbury County Board of Supervisors that the following location shall be signed “No Parking” and that appropriate signs shall be erected at the locations described as follows:

Beginning at the railroad tracks west of the north intersection of Port Neal Circle and Port Neal Road, then proceeding west and south on Port Neal Circle to the south intersection of Port Neal Road and Port Neal Circle. Parking on both shoulders is prohibited. Vehicles so parked will be subject to towing. 

This resolution will become effective upon approval by the Board of Supervisors and posting of signs at the affected location and shall remain in effect until further action of the Board of Supervisors at the end of the flood event.

The County Engineer notified the Board that a trash pump sent out for repair was deemed unrepairable and asked to dispose of the pump by allowing the repair shop to keep the pump in lieu of payment for the completed work.  The consensus was to allow the engineer to vary from the county’s policy for the disposal of equipment.

Meeting was adjourned.
