July 19, 2011 — TWENTY-SEVENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, July 19, 2011 at 10:00 a.m.  Board members present were Monson, Clausen, Tripp, Smith and Boykin.  Staff members present were Karen James, Board Administrative Coordinator, Joshua Widman, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented.  Copy filed.

The meeting was called to order.
 
Motion by Tripp second by Boykin to approve the minutes of the 07/12/2011 Board meeting.  Carried 5-0.  Copy filed.

The Board approved the End of Probation for Jason G. Carlson, Engineering Tech I, Secondary Roads Dept., $19.53/hour, 3%=$.58/hour, effective 07/26/2011.  Per CWA Contract Agreement, End of Probation Salary Increase.  Copy filed.

Motion by Boykin second by Smith to approve and authorize the Chairman to sign an “Authorization to Initiate Hiring Process” for a P/T Female Youth Worker, Juvenile Detention Dept., AFSCME Juvenile Detention:  $16.00/hour.  Carried   5-0.  Copy filed.

Motion by Smith second by Boykin to approve abatement for the following taxes that are uncollectable or impractical to pursue collection through tax sale of personal judgment, per recommendation of County Treasurer Michael Clayton:

1. Michael Allen Clarke, VIN #55610AB, mobile home has been dismantled and junked by mobile home park.  Taxes total $1280.00 plus interest and costs.            
 
2. Adolfo Rodriguez, VIN #C560D341, mobile home has been dismantled and junked by mobile home park.  Taxes total $492.00 plus interest and costs.
      
Carried 5-0.

Motion by Tripp second by Clausen to receive as submitted the Semi-Annual Report of Funds in the Hands of the County Treasurer at close of business June 30, 2011 per County Treasurer, Mike Clayton.  Carried 5-0.  Copy filed.

Motion by Clausen second by Boykin to receive as submitted the sheriff’s statement of unadjudicated condemnation funds being held by the Woodbury County Sheriff’s Office, for the year ending 06/30/2011 and the sheriff’s statement of unadjudicated condemnation funds being held by the Woodbury County Sheriff’s Office in accordance with Section 331.656 of the Code of Iowa, for the year ending 06/30/2011.  Carried 5-0.  Copy filed

Motion by Smith second by Boykin to receive County Auditor’s Quarterly Report.  Carried 5-0.  Copy filed.

Motion by Clausen second by Smith to approve the memorandum of Understanding with City of Sioux City for the Justice Assistance Grant Application.  Carried 5-0.  Copy filed.

Motion by Tripp second by Clausen to approve submission of Justice Assistance Grant Application. Carried 5-0.  Copy filed.

Motion by Boykin second by Smith to authorize Patty Erickson-Puttmann to electronically submit Justice Assistance Grant.  Carried 5-0.  Copy filed.

Motion by Boykin second by Tripp to approve the Provider Agreement/Contract between Woodbury County and Siouxland Mental Health for Mental Health Services under the county management Plan.  Carried 5-0.  Copy filed.

Motion by Boykin second by Clausen to amend the Listing Agreement with NAI LeGrand and Company to include listing for sale Parcel No. 546707 (3420 Old Lakeport Road).  Carried 5-0.  Copy filed.

Motion by Boykin second by Tripp to approve and authorize the Chairman to sign a Resolution setting the public hearing and sale date for Parcel #546707, 3420 Old Lakeport Road, Sioux City.  Carried 5-0.

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

fifteen(15) of Auditor’s Plat of the Southwest Quarter(1/4)of Section Eight(8),

NOW THEREFORE,
 
BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1.  That a public hearing on the aforesaid proposal shall be held on
      the  2nd  Day of August,  2011 at 10:15 o’clock a.m. in the meeting
      room of the Board of Supervisors on the first floor of the Woodbury
      County Courthouse.
     
2.  That said Board proposes to sell the said parcel of real estate at a
      public auction to be held on the BLANK, immediately        
      following the closing of the public hearing.
     
 3. That said Board proposes to sell the said real estate to the highest
      bidder at or above a total minimum bid of $250,000.00 plus recording fees.

RESOLUTION ACCEPTING AND APPROVING
TODD ADDITION, A MINOR SUBDIVISION
TO WOODBURY COUNTY, IOWA

WHEREAS, THE OWNERS AND PROPRIETORS DID ON THE 27 DAY OF MAY, 2011, FILE WITH THE WOODBURY COUNTY ZONING COMMISSION A CERTAIN PLAT DESIGNATED AS TODD ADDITION, A MINOR SUBDIVISION TO WOODBURY COUNTY, IOWA; AND

WHEREAS, IT APPEARS THAT SAID PLAT CONFORMS WITH ALL OF THE PROVISIONS OF THE CODE OF THE STATE OF IOWA AND ORDINANCES OF WOODBURY COUNTY, IOWA, WITH REFERENCE TO THE FILING OF SAME; AND

WHEREAS, THE ZONING COMMISSION OF WOODBURY COUNTY, IOWA HAS RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT; AND

WHEREAS, THE COUNTY ENGINEER OF WOODBURY COUNTY, IOWA HAS RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT.

NOW THEREFORE, BE, AND IT IS HEREBY RESOLVED BY THE WOODBURY COUNTY BOARD OF SUPERVISORS, WOODBURY COUNTY, STATE OF IOWA, THAT THE PLAT OF TODD ADDITION, A MINOR SUBDIVISION TO WOODBURY COUNTY, IOWA BE, AND THE SAME IS HEREBY ACCEPTED AND APPROVED, AND THE CHAIRMAN AND SECRETARY OF THE WOODBURY COUNTY BOARD OF SUPERVISORS, WOODBURY COUNTY, STATE OF IOWA, ARE HEREBY DIRECTED TO FURNISH TO THE OWNER AND PROPRIETOR A CERTIFIED COPY OF THIS RESOLUTION AS REQUIRED BY LAW.

Motion by Boykin second by Tripp to approve and authorize the Chairman to sign an Underground Utility Permit for Hawthorne Underground, per Recommendation of County Engineer Mark Nahra.   Carried 5-0.  Copy filed.

Motion by Clausen second by Boykin to approve and authorize the Chairman to sign an Underground Utility Permit for Frontier Communications of Iowa, Inc., per Recommendation of County Engineer Mark Nahra.   Carried 5-0.  Copy filed.

Motion by Boykin second by Clausen to approve and authorize the Chairman to sign a Permit to Work in the County Right of Way for the Winnebago Tribe of Nebraska, per Recommendation of County Engineer Mark Nahra.  Carried 5-0.  Copy filed.

Motion by Boykin second by Clausen to approve the award for Project No. Pavement marking 2011.  Carried 5-0.  Copy filed.

John Torbert, Iowa Drainage District Association, presented the Board with an annual report and update on drainage matters in Woodbury County.

A public hearing was held at 10:30 a.m. regarding the Budget Amendment #1 FY 2011-2012.  The Chairman called on anyone wishing to be heard.
 
Motion by Smith second by Clausen to close the hearing.  Carried 5-0.

Motion by Smith second by Clausen to approve the Budget Amendment #1 FY 2011-2012.  Carried 5-0.  Copy filed.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda, or Supervisors concerns.
 
County P.J. Jennings advised the Board that he would be bringing a policy regarding weapons in county buildings before them for their consideration.

The Board adjourned the regular meeting until July 26, 2011.
