APRIL 16, 2013 — SIXTEENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, April 16, 2013 at 10:00 a.m. Board members present were Clausen, Monson, Smith, Boykin and Tripp. Staff members present were Karen James, Board Administrative Coordinator, Dennis Butler, Finance/Operations Controller, Joshua Widman, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

The meeting was called to order.

Motion by Monson second by Tripp to approve the minutes of the 4/09/2013 Board meeting. Carried 5-0. Copy filed.

Motion by Smith second by Tripp to approve the reclassification of Diane Murphy, Asst. County Attorney, County Attorney Dept., effective 04/30/2013, $64,356/year, 4%=$2,703/year. Per AFSCME Asst. County Attorney Contract agreement: from Step 5 to Step 6. Carried 5-0. Copy filed.

Motion by Monson second by Tripp to approve requests from Charles Kofka to remain on County Health and Dental Insurance Plans. Carried 5-0.

Motion by Monson second by Tripp to receive the County Auditor’s Quarterly Reports. Carried 5-0. Copy filed.

Motion by Tripp second by Monson to receive the appointment of, Dusty Browamle, 1755 Grundy Ave, Moville, Iowa as Moville Township Trustee, to fill a vacancy in the office until the next regular election. Carried 5-0. Copy filed.

The item to take action on setting a date for a Special Election concerning the Issuance of General Obligation Bonds for Construction of a Multi-Purpose Facility named “Ag Expo Center” near Moville, Iowa was removed from the agenda by the chairperson.

Motion by Monson second by Boykin to approve and authorize the Chairperson to sign a Permit to Work in the County Right of Way for John Hall to install an Irrigation Line , per recommendation of County Engineer Mark Nahra. Carried 5-0. Copy filed.

Motion by Monson second by Smith to approve and authorize the Chairperson to sign a Permit to Work in the County Right of Way for Randy Hunt to install an Underground Electrical Line, per recommendation of County Engineer Mark Nahra. Carried 5-0. Copy filed.

Motion by Monson second by Boykin to approve and authorize the chairperson to sign a Resolution to Vacate a Portion of Stoddard Avenue. Carried 5-0.

A RESOLUTION CLOSING AND VACATING
A ROAD RIGHT OF WAY

WHEREAS, the Woodbury County Board of Supervisors in accordance with Section 306.11 of the Code of Iowa held a public hearing on March 26, 2013 on the proposed vacation of Woodbury County Secondary Road Right-Of-Way described as follows:

All of Stoddard Ave lying between Ivy St. (commonly known as Garretson Ave) and Vine St., between block 28 and 29 and all of a 16’ wide alley in block 29 of Morningside Addition to Sioux City, Iowa, in Section 4 T88N, R47W, Woodbury Township of the 5th P.M. Woodbury County, Iowa, more specifically described as follows:.

That portion of Stoddard Ave lying between Lots 7 through 19 of Block 29 and Lots 20 through 32 of Block 28 and all of a 16’ wide alley in block 29 of Morningside Addition, Second Filing, to Sioux City, Iowa, in Section 4 T88N, R47W, Woodbury Township of the 5th P.M. Woodbury County, Iowa, and

That portion of Stoddard Ave lying between Lots 1 through 6 of Block 29 and Lots 33 through 38 of Block 28 and all of a 16’ wide alley in between lots 1 through 6 and 33 through 38 of block 29 of Morningside Addition, Third Filing to Sioux City, Iowa, in Section 4 T88N, R47W, Woodbury Township of the 5th P.M. Woodbury County, Iowa.

WHEREAS, objections that were received at the hearing, in either writing or by persons present, and said objections have been studied and dismissed as ineligible for damages under 306.14 of the Code of Iowa,

NOW THEREFORE BE IT RESOLVED by the Woodbury County Board of Supervisors that all interest in the subject section of road right-of-way be vacated, subject to utility easements of record for ingress and egress.

Motion by Monson second by Smith to approve and authorize the Chairperson to sign a Quit Claim Deed for Greggory and Erika Kilburn. Carried 5-0. Copy filed.

Motion by Tripp second by Monson to approve and authorize the Chairperson to sign a Quit Claim Deed for Julia Culver. Carried 5-0. Copy filed.

There was a discussion of the desire of municipalities to sign a contract with the county to provide Law Enforcement Services.

The Chairperson asked if there were any individuals or groups wishing to make a presentation of items not on the agenda, or Supervisors concerns.

The Board adjourned the regular meeting until April 23, 2013.
