JUNE 11, 2013 — TWENTYFOURTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, June 11, 2013 at 10:00 a.m.  Board members present were Clausen, Monson, Smith, Boykin, and Tripp.  Staff members present were Karen James, Board Administrative Coordinator, Dennis Butler, Finance/Operations Controller, Joshua Widman, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented.  Copy filed.

The meeting was called to order.

Motion by Monson second by Smith to approve the minutes of the 6/04/2013 Board meeting.  Carried 4-0; Boykin abstained.  Copy filed.

Motion by Tripp second by Boykin to approve the separation of Rick Pyburn, Mental Health Supervisor, Social Services Dept., effective 06/30/13. Position eliminated.; the reclassification of Michael Wingert, Appointed % Deputy-Lieutenant, Sheriff Dept., effective 7/01/13, $74,268/year, 10%=%6,875/year. Per Sheriff Drew, increase to 78% Appointed Deputy-Lieutenant.; the reclassification of Charles Hertz, Lieutenant, Sheriff Dept., effective 7/1/13, $80,933/year, 20%=$13,540/year.   Increase per Sheriff Drew.; the reclassification of Debra Kobold, Appointed % Deputy, County Treasurer Dept., effective 7/1/13, $62,825/year, 8.8%=$5,058/year.  Per County Treasurer, increase to 80% Appointed Deputy.; and the reclassification  of Valerie Ping, Appointed % Deputy, County Treasurer Dept., effective 7/01/13, $62,528/year, 8.8%=$5,058/year.  Per County Treasurer, increase to 80% Appointed Deputy.  Carried 5-0.  Copy filed.

Motion by Monson second by Smith to approve and authorize the Chairperson to sign an “Authorization to Initiate Hiring Process” for Equipment Operator, Secondary Roads Dept., CWA Secondary Roads:  $19.90/hour.  Carried 5-0.  Copy filed.

Motion by Tripp second by Monson to approve the appointment of Katie Colling, 3065 Valley Drive, Sioux City and Tim Bottaro, 1915 Heights Ave, Sioux City to the Compensation Commission.  Carried 5-0.  Copy Filed.

Motion by Monson second by Tripp to approve and authorize the Chairperson to sign a 28E Agreement between Woodbury County, Iowa and the City of Cushing, Iowa for the provision of Law Enforcement Services.  Carried 5-0.  Copy filed.

Motion by Monson second by Tripp to approve and authorize the Chairperson to sign a 28E Agreement between Woodbury County, Iowa and the City of Smithland, Iowa for the provision of Law Enforcement Services.  Carried 5-0.  Copy filed.

Motion by Boykin second by Smith to approve and authorize the Chairperson to sign Amendment to Interlocal Agreement Entered into in May 7, 2012.  Carried 5-0.  Copy filed.

Motion by Smith second by Monson to approve and authorize the Chairperson to sign Iowa DOT Agreement for Use of Local Agency Roads as Detours, per recommendation of Mark Nahra, County Engineer.  Carried 5-0.  Copy filed.

Motion by Boykin second by Tripp to award the Bridge Replacement Project Number LB-09(2)—73-97 to L. A. Carlson Contracting, Merrill, IA for 66,744.00.  Carried 5-0.  Copy filed.

Motion by Boykin second by Smith to approve and authorize the Chairperson to sign a Resolution Approving an Agreement by and Among the City of Moville, Woodbury County, and the Woodbury Central Community School District Concerning the Extension of the Division of Revenue in the Proposed Moville Ridge Housing Urban Renewal Area from 10 Fiscal Years to 15 Fiscal Years.  Carried 5-0.

RESOLUTION APPROVING AGREEMENT BY AND AMONG

THE CITY OF MOVILLE, THE COUNTY OF WOODBURY, AND WOODBURY

CENTRAL COMMUNITY SCHOOL DISTRICT

RESOLUTION #11,049

WHEREAS, the County of Woodbury, hereinafter referred to as the County, is a political subdivision duly incorporated, organized and existing under and by virtue of the Constitution and laws of the State of Iowa; and

WHEREAS, the City of Moville has requested the County (along with the Woodbury Central Community School District) enter into an agreement relating to the extension of the division of revenue under Iowa Code Section 403.19 in the Moville Ridge Housing Urban Renewal Area for the City of Moville, Iowa, for projects involving the provision of public improvements related to housing and residential development from ten (10) fiscal years to a total of fifteen (15) fiscal years of division of revenue (beginning with the second fiscal year after the year of first certification of debt); and

WHEREAS, the County is willing to agree to such extension:

NOW THEREFORE, BE IT RESOLVED, BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, STATE OF IOWA, AS FOLLOWS:

Section 1.  The County approves the entry into the AGREEMENT BY AND AMONG THE CITY OF MOVILLE, THE COUNTY OF WOODBURY, AND WOODBURY CENTRAL COMMUNITY SCHOOL DISTRICT.

Section 2.  The officials designated below shall take any and all action necessary to execute the Agreement.

Motion by Monson second by Tripp to approve and authorize the Chairperson to sign a Resolution setting the public hearing and sale date for Parcel #132360, 117 Rebecca St, Sioux City.  Carried 5-0.

 RESOLUTION # 11,050

NOTICE OF PROPERTY SALE

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

South Thirty and one-half feet of Lot One in Block Twenty-One of the Sioux City Davis Addition, City of Sioux City, Woodbury County, Iowa (117 Rebecca Street)

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1.  That a public hearing on the aforesaid proposal shall be held on the  25th Day of June, 2013 at 10:15 o’clock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.      

2.  That said Board proposes to sell the said parcel of real estate at a public auction to be held on the 25th Day of June, 2013,  immediately         following the closing of the public hearing.      

3.   That said Board proposes to sell the said real estate to the highest bidder at or above a total minimum bid of $100.00 plus recording fees.

Then Chairperson called on anyone wishing to be heard.

Motion by Smith second by Tripp to close the hearing.  Carried 5-0.

Motion by Tripp second by Monson to approve and authorize the Chairperson to sign a Resolution for the sale of this parcel to Michael Waite (4101 E Gordon Dr. Lot 106, Sioux City), for real estate parcel #328740 (1102 Logan  St., Sioux City) for $300.00 plus recording fees.  Carried 5-0.

RESOLUTION OF THE BOARD OF SUPERVISORS

RESOLUTION #11,051

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

By    ___Michael Waite_________in the sum of          Three Hundred Dollars & 00/100 ($300.00)-----------------------------------------------------dollars.

For the following described real estate, To Wit:   Parcel #328740 Lot Eight, Block Twenty, Long View Addition to Sioux City, Woodbury County, State of   Iowa (1102 Logan Street)

Now and included in and forming a part of the City of Sioux City, Iowa, the same is hereby accepted: said Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said Real Estate.

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.

BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes.  Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.
