October 7, 2014 — FORTYFIRST MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, October 7, 2014 at 10:00 a.m.  Board members present were Boykin, Tripp, Monson and Smith; Clausen was absent.   Staff members present were Karen James, Board Administrative Coordinator, Dennis Butler, Finance/Operations Controller, Joshua Widman, Assistant County Attorney, and Patrick Gill, Auditor/Clerk to the Board.

The meeting was called to order.  

Motion by Smith second by Monson to approve the minutes from the 09/29/2014 Board meeting.  Carried 3-0; Tripp abstained.  Copy filed.

Motion by Tripp second by Smith to approve the minutes from the 09/30/14 Board meeting.  Carried 4-0.  Copy filed.

Motion by Smith second by Tripp to approve the County’s claims totaling $742,946.70.  Carried 4-0.  Copy filed.

Motion by Monson second by Tripp to approve the separation of Sara Wickey, Case Manager, Social Services Dept., effective 10/17/14.  Resignation.  Carried 4-0.  Copy filed.

Motion by Monson second by Tripp to rescind the posting of one case manager position previously approved pending the review of requested information.  Carried 3-1; Smith opposed.  Copy filed.

Motion by Tripp second by Monson to receive County Auditor’s Quarterly Report.  Carried 4-0.  Copy filed.

Motion by Tripp second by Monson to approve and authorize the Chairperson to sign Plans for Project No. ER-CO97(123)—58-97 Shoulder and Drainage repairs on Route D12 from K49 to K64.  Carried 4-0.  Copy filed.

Motion by Monson second by Tripp to approve and authorize the Chairperson to sign Plans for Project No. ER-CO97(124)—58-97 Shoulder and Drainage repairs on Route D38 from Emmett Ave. to Garner Ave. and on K64 near 260th Street.  Carried 4-0.  Copy filed.

Motion by Tripp second by Monson to approve and authorize the Chairperson to sign Plans for Project No. ER-CO97(125)—58-97 Shoulder and Drainage repairs on Route D38 from Hancock Ave. to Lennox Ave. and on D50 from Mason Ave. to Michigan Ave.  Carried 4-0.  Copy filed.

Motion by Tripp second by Monson to approve and receive for signatures a Resolution establishing speed limits on Allison Ave and 235th St.  Carried 4-0. 

SPEED LIMIT RESOLUTION

235TH STREET AND ALLISON AVENUE

RESOLUTION #12,084

WHEREAS: The Board of Supervisors of Woodbury County is empowered under the authority of sections 321.255 and 321.285, subsection 4 of the Code of Iowa to determine upon the basis of an engineering and traffic investigation conducted by the County Engineer that the speed limit of any secondary road is greater than is reasonable and proper under the conditions existing, and may determine and declare a reasonable and proper speed limit, and

WHEREAS: Such investigation has been requested and completed and the county engineer has reached an opinion concerning the reasonable and proper speed for the road listed herein,

NOW, THEREFORE BE IT RESOLVED, by the Woodbury County Board of Supervisors that the following speed limit be established and appropriate signs erected at the locations described as follows:

1). Beginning at the intersection of 225th Street and Allison Avenue then proceeding south on Allison Avenue to the end of the county maintenance, a speed limit of 35 miles per hour is established.

2). Beginning at the intersection of Andrew Avenue and 235th Street then proceeding west on 235th Street to the intersection of Allison Avenue, a speed limit of 35 miles per hour is established.

Speed limit shall be effective when appropriate signs giving notice of the speed limits are erected.

Passed and approved this 7th day of October, 2014.

Motion by Smith second by Tripp to approve and authorize the Chairperson to sign a Resolution setting the public hearing and sale date for parcel #210795, 3102 Leech Ave., Sioux City.  Carried 4-0.

RESOLUTION #12,085

NOTICE OF PROPERTY SALE  

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

Lot Twenty-Four and the East One-half of Lot Twenty-Five, Block Two, Hedges Table Addition to Sioux City, in the County of Woodbury and State of Iowa

(3102 Leech Ave.)

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1.  That a public hearing on the aforesaid proposal shall be held on the 21st Day of October, 2014 at 10:15 o’clock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.      

2.  That said Board proposes to sell the said parcel of real estate at a public auction to be held on the 21st Day of October, 2014, immediately following the closing of the public hearing.      

3.  That said Board proposes to sell the said real estate to the highest bidder at or above a total minimum bid of $245.00 plus recording fees.

Then the Chairperson called on anyone wishing to be heard.

Motion by Tripp second by Monson to close the public hearing.  Carried 4-0.

Motion by Monson second by Tripp to approve and authorize the Chairperson to sign a Resolution for the sale of this parcel to Gary & Mary Olson (48283 331st St, Jefferson, SD 57038) for real estate parcel #570825 (2220 Riverside Blvd.) for $904.00 plus recording fees.  Carried 4-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

By   Mary Olson; Donna & Dennis Kaiser in the sum of Nine Hundred and Four Dollars & 00/100 ($904.00)-----------------------------------------------------dollars.

For the following described real estate, To Wit:

The North 42.12’ of the South 48.12’ of Lot Five, (except fifteen feet off from the East side thereof for private alley) of Auditor’s Sub-division of Lot One of the Auditor’s Sub-division of the Southwest quarter of the Southeast quarter of Section 14, and Lot ten of Auditor’s Sub-division of Section 23, Township 89, North, Range 48, West of the 5th P.M. in the County of Woodbury and State of Iowa

BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes.  Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

Bid letting was held at 10:25 a.m. for HMA Routing and Sealing on Various Roads.  The bids were as follows:

Sioux Commercial Sweeping, West Des Moines, IA $17,105.00

Midwest Coatings Company, Modale, IA  $34,400.00

The Road Guy, Yankton, SD   $21,620.00

Motion by Monson second by Tripp to receive the bids and to submit them to the Secondary Roads Department for review and recommendation.  Carried 4-0.  Copy filed.

Bid letting was held at 10:30 a.m. for PCC Patching on Various Roads.  The bids were as follows:

Ten Point Construction, Denison, IA  $60,662.00

Cedar Falls Construction, Cedar Falls, IA  $66,825.00

Motion by Smith second by Monson to receive the bids and award the bid to Ten Point Construction, Denison, IA for $60,662.00.  Carried 4-0.  Copy filed.

The Chairperson asked if there were any individuals or groups wishing to make a presentation of items not on the agenda, or Supervisors concerns.

Lisa McNeil, Woodbury County Court Administrator, addressed the Board with concerns about leaks in the Law Enforcement Center.

Jay Kirkpatrick, 1809 Bronson Blacktop, Bronson submitted a claim for damages.  

The Board adjourned the regular meeting until October 14, 2014.
