SEPTEMBER 29, 2015 — FORTIETH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, September 29, 2015 at 4:15 p.m.  Board members present were Clausen, Monson, Ung, Taylor and Smith.  Staff members present were Karen James, Board Administrator, Dennis Butler, Finance/Operations Controller, Ed Gilliland, Human Resources Director, Gloria Mollet, Assistant Human Resources Director and Patrick Gill, Auditor/Clerk to the Board.

The meeting was called to order to canvass the Western Iowa Community College Election held in Woodbury County on September 8, 2015.

Official Canvass results were as follows:

For the office of Western Iowa Tech Community College Board Member, Director District III – 1 Vacancy, there were eight hundred, three (803) ballots cast as follows:

Bob Rasmus   received Seven hundred, ninety-three  793 votes

Scattered Write-In Votes  received One                         10 votes

We therefore declare Bob Rasmus duly elected to the office of Western Iowa Tech Community College Board Member, Director District III, for the term of four (4) years.

For the office of Western Iowa Tech Community College Board Member, Director District IV – 1 Vacancy, there were one hundred, seventy-three (173) ballots cast as follows:

Bill Lyle   received One-hundred, sixty-seven    167 votes

Scattered Write-In Votes received Six            6 votes

We therefore declare Bill Lyle duly elected to the office of Western Iowa Tech Community College Board Member, Director District IV, for the term of four (4) years.

For the office of Western Iowa Tech Community College Board Member, Director District VI – 1 Vacancy, there were thirty-four  (34) ballots cast as follows:

Daniel Ford – Write-in received Two        2 votes

Jeremy Ogle – Write-in received Two         2 votes

Scattered Write-In Votes received Thirty                             30 votes

We therefore declare Jeremy Ogle (drawn by lot) duly elected to the office of Western Iowa Tech Community College Board Member, Director District VI, for the term of four (4) years.

For the office of Western Iowa Tech Community College Board Member, Director District VII – 1 Vacancy, there were one thousand, five hundred and three (1,503) ballots cast as follows:

Curt Grigg  received One thousand, four hundred, eighty    1,480 votes

Scattered Write-In Votes received Twenty-three            23 votes

We therefore declare Curt Grigg elected to the office of Western Iowa Tech Community College Board Member, Director District VII, for the term of four (4) years.        Motion by Smith second by Taylor to approve and receive the Official Canvass results.  Carried 5-0.  Copy filed.

The meeting was called to order – Pledge of Allegiance to the Flag – Moment of Silence.

Citizen Concern.   Motion by Taylor second by Smith to approve the Agenda for September 29, 2015.  Carried 4-1; Smith opposed.  Copy filed.

Motion by Taylor second by Ung to approve the minutes of the September 22, 2015 Board meeting.  Carried 5-0.  Copy filed.  

Motion by Ung second by Taylor to approve the claims totaling $314,991.39.   Carried 5-0.  Copy filed.

Presentation of annual report to Board by Iowa Drainage District Association.  Copy filed.

A public hearing was held at 4:45 p.m. to consider the closure and vacation of a portion of Woodbury-Ida County line road in Section 12 of Morgan Township. 

Motion by Clausen second by Taylor to close the public hearing.  Carried 5-0.

Motion by Clausen second by Taylor to receive for signatures a Resolution to close and vacate Woodbury-Ida County Line Road on the east side of section 12, T87N, R42W.  Carried 5-0.

RESOLUTION #12,277

WOODBURY COUNTY, IOWA

A RESOLUTION CLOSING AND VACATING A ROAD RIGHT OF WAY

WHEREAS, the Woodbury County Board of Supervisors in accordance with Section 306.11, (Code of Iowa) 2015, as amended, on September 28, 2015 held a public hearing on the proposed vacation of Woodbury County Secondary Road Right-Of-Way described as follows:

Woodbury- Ida County Line Road beginning at the NE corner of Section 12 T87N R42W of the 5th P.M. thence south 1.0 miles to the SE corner of said section.   Said right of way to be vacated is 66 feet in width and was dedicated to the county by easement

WHEREAS, no objections were received in either writing or by persons present.

NOW THEREFORE BE IT RESOLVED by the Woodbury County Board of Supervisors that all interest in the subject section of road right-of-way be vacated, subject to utility easements of record for ingress and egress. 

SO RESOLVED this 29th day of September 2015.

Motion by Monson second by Clausen to authorize the Chairperson to  sign a petition on behalf of Woodbury County to voluntary annexation of two Secondary Road department properties into the city of Moville.  Carried 5-0.  Copy filed.  

Motion by Monson second by Clausen to approve the contract for project #ER-CO97(124)—58-97, emergency repairs to federal aid routes, with Clark Construction for $364,636.40.  Carried 5-0.  Copy filed.

Motion by Smith second by Ung to approve the contract for project #RC-CO97(119)—9A-97, PCC paving of CF Industries drive, with Steve Harris Construction for $737,045.35.  Carried 5-0.  Copy filed.

Motion by Taylor second by Ung to postpone action to adopt the revised CIP for FY2016.  Carried 5-0.  Copy filed.

Motion by Ung second by Taylor to adopt the CIP planning process to be used with our long term planning for FY2017 and beyond.  Carried 5-0.  Copy filed

Motion by Taylor second by Ung to approve the reclassification of Larry Iddings, P/T Courthouse Safety & Security Officer, County Sheriff Dept., effective 10-15-15, $17.68/hour, 5%=$.92/hour.  Per Wage Comparability with AFSCME Courthouse Contract, from Grade 3/Step 3 to Grade 3/Step 4.; the reclassification of Gregory Shinkunas, P/T Courthouse Safety & Security Officer, County Sheriff Dept., effective 10-15-15, $17.68/hour, 5%=$.92/hr.  Per Comparability with AFSCME Courthouse Contract, from Grade 3/Step 3 to Grade 3/Step 4.; and the separation of Steven Kotters, Maintenance Painter, Building Services Dept., effective 10-30-15.  Retirement.  Carried 5-0.  Copy filed.

Motion by Ung second by Taylor to authorize the Chairman to Sign the Authorization to initiate the hiring process for a Maintenance Technician, Building Services Dept., AFSCME Courthouse:  $16.17-$18.17/hour and for a P/T Female Youth Worker, Juvenile Detention Dept., AFSCME Juvenile Detention:  $17.53/hour.  Carried 5-0.  Copy filed.

Motion by Taylor second by Ung to receive for signatures a Resolution thanking and commending Fred Reese for his service to Woodbury County.  Carried 5-0.

RESOLUTION #12,278

A RESOLUTION THANKING AND COMMENDING

FRED REESE

FOR YOUR SERVICE TO WOODBURY COUNTY

WHEREAS, Fred Reese of Bronson, Iowa, with selfless service and excellent carpentry skill built the holder that displays flags from the five military service branches in the Woodbury County Courthouse for Veterans Treatment Court; and

WHEREAS, Mr. Reese himself served this nation as an Army veteran of the Vietnam War; and

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA that the undersigned members of this Board thank and commend Fred Reese for his years of service to Woodbury County; and

BE IT FURTHER RESOLVED that it is the wish of all those signing below that the future hold only the best for this very deserving person, Fred Reese.

BE IT SO RESOLVED this 29th day of September, 2015.

RESOLUTION APPROVING ABATEMENT OF TAXES

WHEREAS, Sioux City Riverboat Corp Inc.  is the titleholder of a building on leased land Parcel #894733209901 located in Woodbury County, Iowa and legally described as follows: 

Parcel #894733209901

SIOUX CITY EAST AUD 1943 PLAT PT GOV T LOTS 1-2 33-89-47            

WHEREAS, the abovestated property has taxes payable Including special assessments and the parcel is owned by Sioux City Riverboat Corp Inc., and

WHEREAS, these taxes are uncollectable or impractical to pursue collection through personal judgment or tax sale

WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes owing on the above parcel according to Code of Iowa, 445.16 for the taxes owed and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.
