NOVEMBER 1, 2016, THIRTY NINETH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, November 1, 2016 at 4:10 p.m.  Board members present were Monson, Ung, Taylor, Smith, and Clausen.  Staff members present were Dennis Butler, Budget/Tax Analyst, Karen James, Board Administrative Coordinator, Ed Gilliland, Human Resources Director, Abigail Sills, Assistant County Attorney and Patrick Gill, Auditor /Clerk to the Board.

Motion by Clausen second by Monson to go into closed session per Iowa Code Section 21.5(1)(a).  Carried 4-0 on roll-call vote; Smith was not present.

Motion by Monson second by Ung to go out of closed session per Iowa Code Section 21.5(1)(a).  Carried 4-0 on roll-call vote; Smith was not present.  

Motion by Taylor second by Ung to uphold the appeal upon completing requirements discussed in the hearing.  Carried 4-0 on a roll call vote; Smith was not present.

The meeting was called to order with the Pledge of Allegiance to the Flag and a Moment of Silence. 

Ernie Colt, North Central States Regional Council of Carpenters, presented material supporting a quality assurance policy for Woodbury County.

Motion by Monson second by Taylor to approve the Agenda for November 1, 2016.  Carried 5-0.  Copy filed.

Motion by Clausen second by Taylor to approve the minutes of the October 25, 2016 Board meeting.  Carried 5-0.  Copy filed.

Motion by Taylor second by Ung to approve the claims totaling $836,312.24.  Carried 5-0.  Copy filed.

A public hearing was held at 4:35 p.m. for the sale of parcel #016035, 318 W. 1st St.  The Chairperson called on anyone wishing to be heard.

Motion by Smith second by Monson to close the public hearing.  Carried 5-0.

Motion by Clausen second by Ung to approve and authorize the Chairperson to sign a Resolution for the sale of this parcel to Ivan & Hilda Espinoza, 310 12th Ave SW, Le Mars, IA for real estate parcel #016035, 318 W 1st St., for $191.00 plus recording fees.  Carried 5-0.

RESOLUTION OF THE BOARD

RESOLUTION #12,458

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

By Ivan M. Espinoza & Hilda M. Espinoza in the sum of One Hundred Ninety-One Dollars & 00/100 ($191.00)-----------------------------------------------------dollars.

For the following described real estate, To Wit:

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

Motion by Taylor second by Ung to close the public hearing.  Carried 5-0.

Motion by Monson second by Taylor to approve the 2nd reading of Woodbury County Industrial and Owner-Operated Cattle Facility Property Improvement Tax Exemption Ordinance.  Carried 5-0.  Copy filed.

Motion by Taylor second by Ung to approve the setting a public hearing for the 3rd and final reading of the Woodbury County Industrial and Owner-Operated Cattle Facility Property Improvement Tax Exemption Ordinance on Tuesday, November 22, 2016 at 4:45 p.m.   Carried 5-0.  Copy filed.

Motion by Clausen second by Ung to approve to allow Medical Reimbursement Account in our Flexible Spending Plan to automatically follow the indexed increases allowed by the IRS.  Carried 5-0.  Copy filed.

Motion by Monson second by Taylor to approve the project amendment with the Hungry Canyons Alliance.   Carried 5-0.  Copy filed.

Motion by Monson second by Clausen to approve the project amendment for the IJR project with McClure Engineering Consultants.  Carried 5-0.  Copy filed.

Motion by Monson second by Taylor to approve the certificate of completion for project GH-2016 Road Haul.  Carried 5-0.  Copy filed.

Motion by Monson second by Taylor to approve the certificate of completion for project GH-2016 Road Haul-2.  Carried 5-0.  Copy filed.

Motion by Clausen second by Taylor to approve the certificate of completion for project G-2016 Stockpile.  Carried 5-0.  Copy filed.  

The Board recessed for a meeting of the Orton Slough Drainage District.

The Supervisors meeting was called back to order.

The Chairperson reported on day to day activities.

The Board members reported on their committee meetings.

There were no citizen concerns.

Board members presented their concerns and comments.       

The Board adjourned the regular meeting until November 8, 2016.
