MARCH 14, 2017, ELEVENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, March 14, 2017 at 4:30 p.m. Board members present were Ung, De Witt, Radig, Taylor, and Pottebaum. Staff members present were Dennis Butler, Budget/Tax Analyst, Karen James, Board Administrative Coordinator, Ed Gilliland, Human Resources Director, Abigail Sills, Assistant County Attorney and Patrick Gill, Auditor/Clerk to the Board.

The meeting was called to order with the Pledge of Allegiance to the Flag and a Moment of Silence.

Citizen concerns.

Motion by Ung second by Taylor to approve the Agenda for March 14, 2017. Carried 5-0. Copy filed.

Motion by Radig second by Pottebaum to approve the following items by consent:

To approve minutes of the March 7, 2017 meeting. Copy filed.

To approve the claims totaling $557,488.72. Copy filed.

To approve the promotion of Toni Haefs, Senior Clerk, County Sheriff Dept., effective 03-15-17, $17.94/hour, 14%=$2.30/hr. Promotion from Clerk II to Senior Clerk.; the reclassification of Tonia Abell, Senior Clerk, Human Resources Dept., effective 03-28-17, $18.62/hour, 4%=$.68/hr. Per Wage Plan comparability with AFSCME Courthouse Contract, from Grade 4/Step 2 to Grade 4/Step 3.; and the reclassification of David Hansen, Sheriff Deputy, County Sheriff Dept., effective 04-01-17, $27.73/hour, 6%=$1.69/hour. Per CWA Deputy Sheriff Contract agreement, from Class I to Senior Class due to 4 years employment and Bachelor’s Degree. Copy filed.

To approve and authorize the Chairperson to sign the Authorization to initiate the hiring process for Temporary Summer Laborers (5), Secondary Roads Dept., Wage Plan: $9.00-$11.00/hour. and for Temporary Engineering Aides (3), Secondary Roads Dept., Wage Plan: $11.00-$14.00/hour. Copy filed.

To receive the award of $1,650.00 from MidAmerican Energy Local Partners Grant Program. Copy filed.

A public hearing was held at 4:35 p.m. for the sale of parcel #536161, 3099 Transit Ave. The Chairperson called on anyone wishing to be heard.

Motion by Taylor second by Radig to close the public hearing. Carried 5-0.

Motion by Taylor second by Ung to approve and authorize the Chairperson to sign a Resolution for the sale of this parcel to Shay Hacker, 2910 Garretson Ave., Sioux City, IA, for real estate parcel #536161, 3099 Transit Ave, for $606.00 plus recording fees. Carried 5-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

By Shay Patrick Hacker in the sum of Six Hundred Six Dollars & 00/100 ($606.00)-----------------------------------------------------dollars.

For the following described real estate, To Wit:

Parcel #536161

West 66 feet North 12.45 feet of Lot 1 and Triangle Tract in Northerly and Westerly part of Lot 2 in Block 60 West Morningside Addition, City of Sioux City, Woodbury County, Iowa
(3099 Transit Avenue)

Now and included in and forming a part of the City of Sioux City, Iowa, the same is hereby accepted: said
Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said Real Estate.

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.

BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

Motion by Taylor second by Ung to approve the funding in the amount of $15,000.00 from local option sales tax proceeds for the Local Housing Trust Fund for FY 2017/2018. Carried 5-0. Copy filed.

A public hearing was held at 4:45 p.m. for tower lease with Motorola Solutions, Inc. within the WIT Tower site.

Motion by Taylor second by Radig to close the public hearing. Carried 5-0.

Motion by Taylor second by Radig to approve a tower lease with Motorola Solutions, Inc. for an initial term of thirteen (13) years between Woodbury County, Starcomm, the City of Sioux City, and Motorola Solutions, Inc. for Starcomm WIT Tower at 4647 Stone Ave. Carried 5-0. Copy filed.

Motion by Ung second by Radig to receive the Woodbury County’s Certified Annual Financial Report for FY 2016. Carried 5-0. Copy filed.

The Chairperson reported on the day-to-day activities.

The Board members reported on their committee meetings.

The Board adjourned the regular meeting until March 21, 2017.
