JULY 11, 2023, TWENTY-EIGHTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS 

The Board of Supervisors met on Tuesday, July 11, 2023, at 4:30 p.m.  Board members present were Nelson, Taylor, and Ung; Radig and Bittinger II were absent.  Staff members present were Karen James, Board Administrative Assistant, Melissa Thomas, Human Resources Director, Dennis Butler, Finance and Budget Director, and Michelle Skaff, Deputy Auditor/Clerk to the Board.

The regular meeting was called to order with the Pledge of Allegiance to the Flag and a Moment of Silence.
    
Motion by Ung second by Taylor to approve the agenda for July 11, 2023.  Carried 3-0.  Copy filed.
        
Motion by Ung second by Nelson to approve the following items by consent:

To approve minutes of the June 27, 2023 meeting.  Copy filed.
    
To approve the claims totaling $1,629,021.02.  Copy filed.

To approve and authorize the Chairperson to sign a Resolution setting the public hearing and sale of parcel #894721409027, 825 17th St.

NOTICE OF PROPERTY SALE

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

The East one-half (E ½) of Lot Eight (8) and all of Lot Nine (9), Block One (1), Lawn Ridge Addition to Sioux City in the County of Woodbury and State of Iowa
(825 17th Street)

NOW THEREFORE, 
 
BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1.   That a public hearing on the aforesaid proposal shall be held on
the 25th Day of July, 2023 at 4:35 o’clock p.m. in the basement of the   
Woodbury County Courthouse. 
      
2.   That said Board proposes to sell the said parcel of real estate at a
public auction to be held on the 25th Day of July, 2023, immediately
following the closing of the public hearing.
      
3.  That said Board proposes to sell the said real estate to the highest
bidder at or above a total minimum bid of $544.00 plus recording fees. 
      
4.  That this resolution, preceded by the caption "Notice of Property Sale"
and except for this subparagraph 4 be published as notice of the
aforesaid proposal, hearing and sale.

To approve an application for a 14-Day, Class C Retail Liquor License, with Outdoor Service Sales privileges for Woodbury County Fair, effective 07/27/2023 through 08/09/2023.  Copy filed.

To approve the separation of Kayla Orr, Civilian Jailer, County Sheriff Dept., effective 06-29-23. Separation.  Copy filed.

To approve the deauthorization of GIS Facilities and Inventory Manager, Secondary Roads Dept.  Copy filed.

To approve and authorize the Chairperson to sign the Authorization to initiate the hiring process for Civilian Jailer, County Sheriff Dept. CWA:  $23.97/hour.  Copy filed.

To schedule dates/times for 3 public hearings to consider amending the zoning ordinance to include solar energy systems, private and solar energy systems, utility scale, for 8/1/23 @ 4:45 p.m., 8/8/23 @ 4:45 p.m., and 8/15/23 @ 4:45 p.m.  Copy filed.

Carried 3-0.

Doyle Turner, Moville, Steve Corey, 1757 290th St, Salix, Daniel Hair, Hornick, Kim Alexander, Smithland, Gayle Palmquist, Lawton, spoke in support of the ordinance. 

Motion by Taylor second by Nelson to receive document from Mr. Corey. Carried 3-0. Copy filed.
    
Motion by Taylor second by Nelson to postpone action on approval of the Resolution and Energy Policy and Growth for Woodbury County until a future meeting. Carried 3-0.  

Motion by Ung second by Nelson to receive the final report and Zoning Commission recommendation for Zoning Ordinance Amendments to temporary heavy construction services uses Aggregate crush & screen (temporary); Asphalt mixing (temporary); & Concrete mixing (temporary) from prohibited to conditional in the General Commercial and Highway Commercial Zoning Districts from their 6/26/23 meeting.  Carried 3-0.  Copy filed.

A public hearing was held at 4:45 p.m. for Zoning Ordinance Amendments to temporary heavy construction services uses (Aggregate crush & screen (temporary); Asphalt mixing (temporary); & Concrete mixing (temporary) from prohibited to conditional in the General Commercial and Highway Commercial Zoning Districts.  The Chairperson called on anyone wishing to be heard.

Motion by Taylor second by Ung to close the public hearing.  Carried 3-0.

Motion by Ung second by Nelson to approve the 1st reading on Zoning Ordinance Amendments as final reading.  Carried 3-0.

Motion by Ung second by Nelson to waive the 2nd and 3rd readings of the Zoning Ordinance Amendments.  Carried 3-0.

Motion by Ung second by Nelson to adopt Ordinance #73, an Ordinance Amending the text of the Woodbury County Zoning Ordinance to amend portions of Section 3.03.4 entitled: Land Use Summary Table of Allowed Uses in each Zoning District.  Carried 3-0.

The board reported on committee meetings.

Doyle Turner, Moville, addressed the board regarding support of the farming community.  

Board concerns were heard.

The Board adjourned the regular meeting until July 18, 2023.
