SEPTEMBER 8, 1998 NINETH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, September 8, 1998 at 9:00 A.M. Board members present were Batcheller, Boykin, Burnight, Clausen and Welte. Staff members present were Karen James, Executive Secretary/Public Bidder, Patrick F. Gill, County Auditor/Board Secretary, and Ann Long, Board Legal Counsel.

The Claims were approved as presented.

Meeting called to order.

Motion Batcheller second by Boykin to approve the Regular Board Minutes of September 1, 1998 amended #30 to reflect 4-1. Carried 5-0.

Motion by Clausen second by Burnight to approve the Executive Session of September 1, 1998 as submitted. Carried 5-0.

The Board approved the appointment of Amy C. Egdorf, Temporary Clerk, County Auditor/Recorder, effective 09/08/98. Corrected Starting Date, from 9/01/98 to 9/08/98. Copy filed.

The Board approved the reclassification of Michael A. Wingert, Deputy Sheriff, County Sheriff, @16.98/hr., effective 9/21/98. Per DSA Contract agreement, from Class 2 to Class 1. Copy filed.

Motion by Boykin second by Burnight to authorize the Chairman to sign the authorization to Initiate Hiring Process for Assistant Building Superintendent, Building Services, @$31,450/yr. Carried 5-0. Copy filed.

Motion by Burnight second by Clausen to approve and authorize the Chairman to set the Public Hearing and Sale of Real Estate Parcel #213840 on September 22, 1998 at 10:15 A.M. Carried 5-0.

NOTICE OF PROPERTY SALE

WHEREAS Woodbury County, Iowa is the owner under a tax deed of a certain parcel of real estate described as:

Lots One (1), Two (2), and Three (3) of Block Seven (7) and vacated Washington Street Adjacent; All Lying North of Martha Street Auditors Plat and Lots Two (2), Three (3), Four (4), Five (5), Six (6), Seven (7) and Eight (8) in Block Six (6) and all lying North and East of Martha Street Auditors Plat and Lots Nine (9) and Ten (10), Vacated Washington Street, Vacated South St. Marys Street Adjacent and Except Small Triangle in Southwest corner of Lot Eleven (11) in Block Six of Hedges 3rd Table Addition to City of Sioux City, Woodbury County, Iowa
NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on the 22nd day of September, 1998, at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That said Board proposes to sell the said parcel of real estate at a public auction to be held on the 22nd day of September, 1998, immediately following the closing of the public hearing.

3. That said Board proposes to sell the said real estate to the highest bidder at or above a total minimum bid of $2,020.00 plus recording fees.

4. That this resolution, preceded by the caption Notice of Property Sale and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

WOODBURY COUNTY BOARD OF SUPERVISORS

A lottery was held to determine which agencies would represent which companies for RFPs for Stop Loss Liability Insurance.

Consensus was to have the Moore Group represented by Daryle Moore and Connie Peterson to do more work to determine rates for Year 2000 compliance.

Motion by Clausen second by Batcheller to authorize the Chairman to sign quarterly reporting and billing for Well Testing/Closure. Carried 5-0. Copy filed.

Motion by Boykin second by Burnight to adjourn the regular Board Meeting to go into an Orton-Slough Drainage District Meeting. Carried 5-0.

Orton Slough Drainage District Meeting was called to order by Board Chairman.

Motion by Batcheller second by Boykin to receive for signatures a resolution setting a public hearing for Orton Slough reclassification of land hearing on October 13th at 10:30 A.M. Carried 5-0.

RESOLUTION NO. 9105
RESOLUTION APPROVING COMMISSIONERS REPORT
RECLASSIFICATION AND FIXING TIME AND PLACE OF HEARING

WHEREAS, the Woodbury County Board of Supervisors, as the governing body of the Orton Slough Drainage District, did appoint Commissioners to reclassify the lands affected by the projected improvements in the said drainage district; and

WHEREAS, said Commissioners did qualify and have now completed the report entitled Reclassification of certain tracts of land in the Southwest Quarter (SW ) of Section Twenty One (21), Township Eighty Seven (87) North, Range Forty Seven (47) West of the Fifth (5th) Principal Meridian, Woodbury County, Iowa which receive benefits from improvements of the Orton Slough Drainage District which has been filed with the Woodbury County Auditor; and

WHEREAS, the said Board of Supervisors finds that said report of Commissioners should be tentatively approved and that time and place of hearing upon the report should be served as provided by statute.

NOW, THEREFORE, IT IS HEREBY RESOLVED that the report of the Commissioners to reclassify the lands in the Orton Slough Drainage District be and the same is hereby tentatively approved.

IT IS FURTHER RESOLVED that said report shall come on for hearing as required by Section 468.45 of the 1997 Code of Iowa, on the 13th day of October, 1998, and the Woodbury County Auditor is hereby directed to cause notice to be served as required by law.
