MARCH 9, 1999 THIRTY-FOURTH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, March 9, 1999 at 9:00 A.M. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Nancy Hodge, Board Administrative Coordinator, Ann Long, Assistant County Attorney and Patrick F. Gill, County Auditor/Board Secretary.

The Claims were approved as presented.

Meeting called to order.

Motion by Boykin second by Welte to approve the Board minutes of March 2, 1999 as submitted. Carried 4-0, Batcheller abstained.

Motion by Boykin second by Welte to approve the minutes of the first executive session of March 2, 1999 as submitted. Carried 4-0, Batcheller abstained.

Motion by Boykin second by Welte to approve the minutes of the second executive session of March 2, 1999 as submitted. Carried 4-0, Batcheller abstained.

There was open discussion period held by the Board.

Motion by Batcheller second by Welte to approve and authorize Chairman to sign beer permit for Salix Grocery, Salix, IA. Carried 5-0. Copy filed.

Motion by Welte second by Walish to approve and authorize Chairman to sign Sunday beer permit for Salix Grocery, Salix, IA. Carried 5-0. Copy filed.

Motion by Batcheller second by Walish to appoint Gene Smith to Commission to Assess Damages Category D Persons having knowledge of property values in the county by reason of their occupation. Carried 5-0.

Motion by Boykin second by Walish to appoint Janice E. Miles to the MI Planning Committee. Carried 5-0.

The Public Hearing and sale of Real Estate Parcel #596190 was held at 10:15 A.M. The Chairman called on anyone wishing to be heard on said sale.

Motion by Welte second by Batcheller to close the Public Hearing on the sale of Real Estate Parcel #596190 to the City of Correctionville only as there was no one present wishing to be heard on said sale. Carried 5-0.

Motion by Walish second by Welte to accept bid for Real Estate Parcel #596190 from the City of Correctionville only for $1 plus recording fees. Carried 5-0.

RESOLUTION OF THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA #9166

BE IT RESOVED by the Board of Supervisors of Woodbury County, Iowa, that the offer of CITY OF CORRECTIONVILLE

in the sum of ONE AND NO/100 ($1.00) Dollars for the following described real estate to wit:

LOTS ONE (1) AND TWO (2) BLOCK ONE (1) KELLOGGS ADDITION, CITY OF CORRECTIONVILLE, WOODBURY COUNTY, IOWA

now and included in and forming a part of the City of CORRECTIONVILLE, Iowa, the same is hereby accepted; said amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said real estate.

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.

BE IT RESOLVED that per code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

WHEREAS, the Board of Supervisors has determined that the transfer of and the intended use of the real property is for a public purpose in accordance with other State laws, and as such, conveys the property legally described above to the purchaser according to Code of Iowa 331.361(3).

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quitclaim Deed for the said premises to the said purchaser.

NOTICE OF PROPERTY SALE

WHEREAS Woodbury County, Iowa is the owner under a quit claim deed of a certain parcel of real estate described as:

West Sixty-three feet (W 63) Lot Eight (8) Block One Hundred Seven (107) Sioux City East Addition, City of Sioux City, Woodbury County, Iowa (aka 817 11th St)

NOT THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on the 23rd day of March, 1999, at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That said Board proposes to sell the said parcel of real estate on the 23rd day of March, 1999, immediately following the closing of the public hearing, to St. Thomas Antiochian Church only.

3. That said Board proposes to sell the said real estate to St. Thomas Antiochian Church only, for consideration of $50.00 plus recording fees.

4. That this resolution, preceded by the caption Notice of Property Sale and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

RESOLUTION APPROVING PETITION FOR SUSPENSION OF TAXES

WHEREAS, Susan Mae Dather, as joint titleholder of real estate located at 1917 Myrle Street, Sioux City, Woodbury County, Iowa, and legally described as follows:

Parcel #052800

South Forty-five (S 45) Feet East Seventy (E 70) Feet Lot Five (5) Block Six (6), Sioux City Addition, City of Sioux City, Woodbury County, Iowa

WHEREAS, Susan Mae Dather as joint titleholder of the aforementioned property has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

The Board approved the reclassification of Randy L. Kortum, Maintenance/Painter, Building Services, @$9.49/hr., effective 3/3/99. Per AFSCME Courthouse Contract agreement, from Grade 3, Step 3 to Grade 3, Step 4. Copy filed.

Debbie Gassen, from Segal Company gave an update of the Countys health insurance.

Motion by Boykin second by Walish to approve the remodeling of room 209 of Trosper-Hoyt County Services Building. Carried 5-0.

The Board directed Mark Elgert to seek prices for the other request for remodeling at Trosper-Hoyt.

Richard Storm, County Engineer, discussed development of the five-year construction program.

Craig Jorgensen, Clerk of Court, discussed the request to utilize available space in basement of courthouse.

There was discussion of the Stop Loss Liability Insurance by Richard Mohl of Grandy Pratt Company.

Motion Batcheller second by Boykin to approve the bid of Grandy Pratt for stop loss liability insurance to be paid from the liability fund. Carried 4-1, Clausen opposed.

Brent Nelson, City Planner, discussed the joint city-county planning for fringe areas around City of Sioux City.

The Board approved the 2nd Quarterly report of Veteran Affairs. Copy filed.

The Chairman asked for and received unanimous consent to add an item to the agenda due to the urgency and timeliness of the issue.

Motion by Boykin second by Welte to adopt the recommendations of the Compensation Board for fiscal year 1999-2000.

The Board adjourned the regular meeting until March 16, 1999.
