JANUARY 4, 2000 TWENTY-FOURTH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, January 4, 2000 at 9:00 A.M. Board members present were Boykin, Clausen, Batcheller, Walish and Welte. Staff members present were Nancy Hodge, Board Administrative Coordinator, Patrick F. Gill, Clerk to the Board, and John Rusch, Board Legal Counsel.

The Claims were approved as presented.

Meeting was called to order.

Motion by Welte second by Walish to approve the appointment of George Boykin as Chairman of the Board. Carried 5-0.

There was an open discussion period held by the Board.

Motion by Clausen second by Walish to approve the regular Board Minutes of December 21, 1999. Carried 5-0.

Motion by Clausen second by Welte to approve the Executive Session Minutes of December 14, 1999. Carried 4-0. Batcheller abstained.

Motion by Walish second by Clausen to approve the 1st Executive Session Minutes of December 21, 1999. Carried 5-0.

Motion by Batcheller second by Clausen to approve the 2nd Executive Session Minutes of December 21, 1999. Carried 5-0.

Motion by Clausen second by Batcheller to appoint Richard Storm as County Engineer. Carried 5-0.

Motion by Welte second by Clausen to appoint Kerby Weber as County Weed Commissioner. Carried 5-0.

There was no action taken to appoint Dr. Thomas Carroll as County Medical Examiner because the term has not expired.

Motion by Batcheller second by Welte to appoint Larry Clausen as County Representative to the Third Judicial District, Department of Correctional Services. Carried 5-0.

Motion by Welte second by Batcheller to table action appointing newspapers for official publication because according to section 349.4 of the Iowa Code, a contest exists.

Motion by Clausen second by Welte to approve and authorize members to sign Resolution No. 9245 in recognition of Jack and Nancy Burright for their services as Secretary/Manager of the Woodbury County Fair. Carried 5-0. Copy filed.

A RESOLUTION THANKING AND COMMENDING

JACK AND NANCY BURRIGHT

FOR THEIR SERVICE TO WOODBURY COUNTY

WHEREAS, Jack and Nancy Burright have capably served as Secretary/ Managers of the Woodbury County Fair for Eighteen Years; and

WHEREAS, the service given by Jack and Nancy Burright to the Woodbury County Fair is characterized by their dedication to the best interests o f the citizens of Woodbury County and the Fair Association; and

WHEREAS, the Board of Supervisors have appreciated the positive, thought- fulness, and constructive input that Jack and Nancy Burright have contributed through their successful management of the County Fair for those Eighteen years; and

NOW, THEREFORE

BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY
COUNTY, IOWA that the undersigned members of this Board thank and commend Jack and Nancy Burright for their Eighteen years of service to the Woodbury County Fair; and

BE IT FURTHER RESOLVED that it is the wish of all those signing below, that the future hold only the best for this very deserving couple, Jack and Nancy Burright.

RESOLUTION APPROVING PETITION FOR SUSPENSION
OF TAXES THROUGH THE REDEMPTION PROCESS


WHEREAS, Nicole Angelle, as joint titleholder of real estate located at 1315 Iowa Street, Sioux City, Woodbury County, Iowa, and legally described as follows:

Except West 38.4 feet East 100 feet Lot 10 and Except West 18.2 feet East 61.6 feet North 25.7 feet Lot 10 Block 95, Sioux City East Addition, City of Sioux City, Woodbury County, Iowa

WHEREAS, Nicole Angelle, as joint titleholder of the aforementioned property has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1999 Iowa Code Section 447.9(3) and,

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby directs the County Auditor to redeem parcel # 031770 owned by the petitioner from the holder of a certificate of purchase of the amount necessary to redeem under section 447.1, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this parcel.

RESOLUTION NO. 9247

RESOLUTION FIXING DATE FOR A MEETING ON THE AUTHORIZATION OF A LOAN AGREEMENT IN THE PRINCIPAL AMOUNT OF $421,715 BETWEEN WOODBURY COUNTY AND THE CITY OF SIOUX CITY WITH RESPECT TO PERSONAL PROPERTY AND EQUIPMENT BEING ACQUIRED FOR THE BENEFIT OF THE WOODBURY COUNTY INFORMATION AND COMMUNICATION COMMISSION, AND PROVIDING FOR PUBLICATION OF NOTICE THEREOF

WHEREAS, it is deemed necessary and advisable that the County of Woodbury, State of Iowa, should provide for the authorization of a Loan Agreement in the principal amount of $421,715, as authorized by Section 331.402, Code of Iowa, as amended, for the purpose of providing funds to pay costs of acquiring personal property as hereinafter described; and

WHEREAS, the Loan Agreement shall be payable from the General Fund; and

WHEREAS, before said Loan Agreement may be authorized, it is necessary to comply with the provisions of the Code of Iowa, as amended, and to publish a notice of the proposal and of the time and place of the meeting at which the Board proposes to take action for the authorization of the Loan Agreement and to receive oral and/or written objections from any resident or property owner of the County to such action;

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, STATE OF IOWA:

Section 1. That this Board meet in the Board of Supervisors Room, Woodbury County Courthouse, Sioux City, Iowa, at 10:30 o'clock A.M., on the 18th day of January, 2000, for the purpose of taking action on the matter of the authorization of a Loan Agreement in the principal amount of $421,715 between Woodbury County, Iowa (the 'County') and the City of Sioux City, Iowa (the 'City'), under which the City would agree to undertake, on behalf of the County and the City, the financing and acquisition of certain computer equipment, software and other related personal property and improvements for the Woodbury County Information and Communications Commission, with the County's share of such costs to be repaid by the County to the City as provided in said Loan Agreement.

Section 2. That the Auditor is hereby directed to cause at least one publication to be made of a notice of said meeting, in a legal newspaper, printed wholly in the English language, published at least once weekly, and having general circulation in said County, said publication to be not less than four clear days nor more than twenty days before the date of said public meeting on the authorization of said Loan Agreement.

Section 3. The notice of the proposed action shall be in substantially the following form:

PUBLIC NOTICE is hereby given that the Board of Supervisors of Woodbury County, Iowa, will hold a public hearing on the 18th day of January, 2000, at 10:30 o'clock A.M., in the Board of Supervisors Room, Woodbury County Courthouse, Sioux City, Iowa, at which meeting the Board proposes to take additional action for the authorization of a Loan Agreement in the principal amount of $421,715 between Woodbury County, Iowa (the 'County') and the City of Sioux City, Iowa ('City'), under which the City would agree to undertake, on behalf of the County and the City, the financing and acquisition of certain computer equipment, software and other related personal property and improvements for the Woodbury County Information and Communications Commission, with the County's share of such costs to be repaid by the County to the City as provided in said Loan Agreement. Principal and interest due from the general fund of the County on the proposed Loan Agreement and all other loan agreements in force on the date of authorization will not exceed ten (10) percent of the last certified general fund budget amount.

At the above meeting the Board shall receive oral or written objections from any resident or property owner of the County, to the above action. After all objections have been received and considered, the Board will at this meeting or at any adjournment thereof, take additional action for the authorization of the Loan Agreement or will abandon the proposal.

This Notice is given by order of the Board of Supervisors of Woodbury County, State of Iowa, as provided by Sections 331.402 and 331.443 of the Code of Iowa, as amended.

Security Officer, County Sheriffs Department @Current Wage; an In-House Sr. DNR Clerk/Motor Vehicle, County Treasurers Department @$10.02/hr (or per AFSCME Contract Agreement) and a Motor Vehicle Clerk II, County Treasurers Department @9.07/hr per AFSCME Courthouse Agreement Grade4.5, Step 1 (This position to be filled after the internal appointment of the Sr. DNR Clerk). Motion by Welte second by Walish to approve and authorize the Chairman to sign Resolution No. 9248 designating the County Engineer to execute certification of completion of work and final acceptance for all Farm-to-Market construction projects in the County. Carried 5-0.

RESOLUTION NO. 9248

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that Richard J. Storm, the County Engineer of Woodbury County, Iowa, be and is designated, authorized, and empowered on behalf of the Board of Supervisors of said County to execute the certification of completion of work and final acceptance thereof in accordance with plans and specifications therefore in connection with all Farm-to-Market construction projects in this county.

Leesa McNeil, Court Administrator, discussed the judges parking. The Chairman indicated that nothing had changed. The Judges still have nine spots allocated to them and if an unauthorized vehicle is parked in one of those spots, court administration may contact the person responsible and have it moved.

Supervisor Welte presented a plan to deal with funding for the fiscal year 2000-2001.

Motion by Batcheller to freeze all non-union wages effective 7-1-00, freeze all other expenses and programs to FY 99/00 levels, do not exceed the $3.50 per $1,000 levy cap, lobby the legislators to change the law on the $3.50 cap and ask all departments to identify another 5% cut on expenses other than wages and to fund this with a combination of cash reserves and moving sheriffs uniform patrol to rural services died for lack of a second.

Motion by Welte second by Clausen to freeze all expenditures and programs to FY 99/00 levels and ask all departments to identify another 5% cut on expenses other wages. Carried 5-0.

Shirley Frederikson, Golden Hills RC&D, gave an update of Loess Hills.

The Board discussed the County Legislative concerns and needs with State Senator John Redwine and State Representatives Wes Whithead, Steve Warnstadt, Ralph Klemme and Clarence Hoffman.

The Board broke for lunch.
