JULY 11, 2000 FIRST MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, July 11, 2000 at 9:00 A.M. Board members present were Boykin, Clausen, Batcheller, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Rusch, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Batcheller second by Walish to approve the regular Board Minutes of June 27, 2000 as submitted. Carried 5-0.

The Board approved the separation of Derrick J. Klug, Correctional Officer, County Sheriff, effective
6-30-00. Separation. Copy filed.

The Board approved the resignation of Jacalyn J. Hobbiebrunken, Correctional Officer, County Sheriff, effective 7-6-00. Resignation. Copy filed.

The Board approved the separation of Gary E. Bumsted, Equipment Operator, Secondary Roads, effective
7-28-00. Retirement. Copy filed.

The Board approved the separation of Todd D. Clausen, School Liaison Officer, Juvenile Court Services, effective 7-3-00. End of Contractual Agreement.

The Board approved the appointment of Paul A. Prather, Maintenance Technician, Building Services, @12.18/hr., effective 7-12-00. Job Vacancy Posted: 5-11-00. AFSCME Range/Grd. 5: $10.37-$13.26/hour. Copy filed.

Motion by Welte second by Walish to approve and authorize the Chairman to sign the authorization to initiate hiring process for a Gang Prevention Specialist, Juvenile Detention, Wage Plan/Grant Position: $40,000.00/year; for (2) Correctional Officers, County Sheriff, D.S.A. Entry: $11.90/hour; for an Equipment Operator, Secondary Roads, C.W.A. Entry: $13.36/hour; and for a Temporary Custodian, Building Services, Comparable AFSCME Entry: $7.88/hour. Carried 5-0. The Board discussed the County Policy & Procedures Review Committee report and direction with
J. D. Pellersels, Human Resource Director.

Motion by Welte second by Clausen to approve and authorize the Chairman to sign the FY 2000-01 Employee Assistant Program Agreement. Carried 5-0. Copy filed.

Motion by Batcheller second by Welte to accept the bid of Mathisons to furnish a Sokkia Total Station and Data Collector for $13,704.00 per county engineers recommendation. Carried 5-0. Copy filed.

Motion by Clausen second by Walish to approve and receive for signatures four resolutions setting public hearings for vacation of roads. Carried 5-0.

A RESOLUTION SETTING DATE FOR PUBLIC
HEARING FOR VACATING ROAD

WHEREAS, Woodbury County has received a request from adjacent property owner to vacate a section of road known as Garner Avenue located in Section 25, T89N, R45W.

WHEREAS, the Woodbury County Board of Supervisors in accordance with Section 306.11, (Code of Iowa 1977), as amended, seeks to set a date for public hearing to vacate a road legally described as follows:

Vacate all that portion of county road right-of-way established as Road No. 384 more commonly known as Garner Avenue and described as;

All that portion of Road No. 384 lying on the east line and the south line of the NW of the NE of Section 25, T89N, R45W of the 5th P.M., Woodbury County, Iowa. The total length to be vacated is 2640 feet, more or less.

NOW THEREFORE,

BE IT RESOLVED by the Woodbury County Board of Supervisors that on Tuesday, August 22, 2000 at 10:20 a.m. CDST, the County will hold a public hearing to vacate the above described road.

Vacate all that portion of county road right-of-way established as Road No. 216 more commonly known as 150th Street and described as;

All that portion of Road No. 216 lying between the N Section 36, T89N, R45W proceeding easterly to the NE corner of the NW of the NE of Section 36, T89N, R45W of the 5th P.M., Woodbury County, Iowa. The total length to be vacated is 1320 feet, more or less.

NOW THEREFORE,

BE IT RESOLVED by the Woodbury County Board of Supervisors that on Tuesday, August 22, 2000 at 10:25 a.m. CDST, the County will hold a public hearing to vacate the above described road.

WHEREAS, the Woodbury County Board of Supervisors in accordance with Section 306.11, (Code of Iowa 1977), as amended, seeks to set a date for public hearing to vacate a road legally described as follows:

Vacate all that portion of county road right-of-way established as Road No. 155 more commonly known as Delaware Avenue and described as;

All that portion of Road No. 155 lying 811.25 feet south of the NW Corner of the SW of the SW of Section 28, T88N, R46W commencing southeasterly to a point 490.7 feet west of the SE Corner of the SW of the SW of Section 28, T88N, R46W of the 5th P.M., Woodbury County, Iowa. Total length to be vacated is 966.65 feet, more or less.

NOW THEREFORE,

BE IT RESOLVED by the Woodbury County Board of Supervisors that on Tuesday, August 22, 2000 at 10:30 a.m. CDST, the County will hold a public hearing to vacate the above described road.

Vacate all that portion of county road right-of-way established as Road No. 49 more commonly known as 230th Street and described as;

All that portion of Road No. 49 lying on the south line of the North of the South of Section 2, T87N, R47W of the 5th P.M., Woodbury County, Iowa. The total length to be vacated is 5280 feet, more or less.

NOW THEREFORE,

BE IT RESOLVED by the Woodbury County Board of Supervisors that on Tuesday, August 22, 2000 at 10:35 a.m. CDST, the County will hold a public hearing to vacate the above described road.

Motion by Clausen second by Batcheller to approve the appointment of Mrs. Bob (Mary) Gerking of Lawton, IA to the Woodbury County Library Board. Carried 5-0. Copy filed.

The Public Hearing and sale of Real Estate Parcel #252330 (3326 W. 5th St.) was held at 10:15 A.M. The Chairman called on anyone wishing to be heard on said sale.

Motion by Batcheller second by Welte to close the Public Hearing on the sale of Real Estate Parcel #252330 as there was no one present wishing to be heard on said sale. Carried 5-0.

Chairman called for bids on Real Estate Parcel #252330. Jim Kerr bid $661.00 plus recording fees. There were no further bids.

Motion by Batcheller second by Walish to accept Mr. Kerrs bid of $661.00 plus recording fees for Real Estate Parcel #252330. Carried 5-0.

WHEREAS THE OWNERS AND PROPRIETORS DID ON THE 26TH DAY OF JUNE, 2000, FILE WITH THE WOODBURY COUNTY ZONING COMMISSION, A CERTAIN PLAT DESIGNATED AS SOUTHVIEW ADDITION, WOODBURY COUNTY, IOWA AND

WOODBURY COUNTY, IOWA

RESOLUTION #9316

YEAR 2000 TIME CAPSULE

WHEREAS, the community of Danbury in the County of Woodbury, Iowa wishes to preserve a representative history of Woodbury County, Iowa for future generations; and

WHEREAS, the community of Danbury intends to accomplish this act through interment of historical articles in a burial vault to be located in the Liston Township Cemetery legally described as Forty-two (42) degrees Fourteen (14) minutes 51.4 seconds North, Ninety-five (95) degrees Forty-three (43) minutes 07.2 seconds; and

WHEREAS, said lot will be identified by location of an appropriate marker with instruction for opening in the year 2100; and

WHEREAS, the community of Danbury has undertaken this act to provide for future generations the opportunity to share directly with Woodbury County descendents;

NOW THEREFORE BE IT RESOLVED, by the Woodbury County Board of Supervisors that the burial vault designated by the community of Danbury for location and identification in the Liston Township Cemetery be declared the official Year 2000 time capsule for the County of Woodbury, Iowa.

SO RESOLVED this 11th day of July, 2000.
