JUNE 4, 2002FORTY SEVENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, June 4, 2002 at 9:00 A.M. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Rusch, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Walish second by Boykin to approve the Board minutes of May 28, 2002 as submitted. Carried 5-0.

John Calhoun discussed SHIP/DECAT Agreement with the Board.

Motion by Welte second by Walish to approve and authorize the Chairman to sign the SHIP/DECAT agreement. Carried 5-0.

Motion by Welte second by Boykin to approve and receive for signatures Resolution No. 9573 designating Highway 75 as Prairie View Corridor. Carried 5-0.

Resolution Naming

THE PRAIRIE VIEW CORRIDOR

WHEREAS, the State of Iowa and State of Minnesota have had a proud heritage of being an integral part of the Great American Prairie, recognizing its fertile soil and natural beauty as a major asset of this area, and

WHEREAS, the State of Iowa and this community recognize the importance of maintaining and growing the economic health of this area by working collectively with their neighbors in developing and marketing their area, and

WHEREAS, the County of Woodbury desires to demonstrate their desire to participate in a collective endeavor of designating their portion of State Highway 75.

NOW THEREFORE BE IT RESOLVED by the Woodbury County Board of Supervisors, duly assembled, that approval is given for designation and appropriate signage of State Highway 75 as:

The Board discussed with Shelly Malcom, Planning and Zoning Administrator, the consideration of preliminary plats for McNaughtons Subdivision submitted by Mr. Richard McNaughton.

Motion by Boykin second by Batcheller to approve preliminary plats for McNaughton Subdivision, per recommendation of the Zoning Commission. Carried 5-0. Copy filed.

There was a discussion regarding the consideration of preliminary plats for Robinsons Subdivision submitted by Mr. Ralph Robinson.

Motion by Batcheller second by Boykin to approve preliminary plats for Robinsons Subdivision, per recommendation of the Zoning Commission. Carried 5-0.

The Public Hearing and sale of Real Estate Parcel #027210 was held at 10:15 A.M. The Chairman called on anyone wishing to be heard on said sale.

Motion by Boykin second by Walish to close the Public Hearing on the sale of Real Estate Parcel #027210 as there was no one present wishing to be heard on said sale. Carried 5-0.

Chairman called for bids on Real Estate Parcel #027210. Tammy Barrett of Nustyle Development Corporation bid $4,057.00 plus recording fees. There were no further bids.

Motion by Batcheller second by Boykin to accept Nustyle Development Corporations $4,057.00 bid plus recording fees on Real Estate Parcel #027210. Carried 5-0.


RESOLUTION OF THE BOARD OF SUPERVISORS
OF WOODBURY COUNTY, IOWA:
RESOLUTION #9574

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

By Nustyle Development Corporation in the sum of Four-Thousand and Fifty-Seven Dollars and No/100 Cents ($ 4,057.00).

For the following described real estate, To Wit:

Parcel #027210

East Six (6) Feet of South one-half (1/2) of Lot Five (5) and East Sixty-One (61) Feet of Lot Six (6) of Block Sixty-Eight (68). Sioux City East Addition.
(709-711 12th Street, Sioux City, Iowa 51105)

Now and included in and forming a part of the City of Sioux City , Iowa, the same is hereby accepted: said

Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said Real Estate.

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.
BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).
BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign Courthouse Restoration Phase IV Change Order #11. Carried 5-0. Copy filed.

Bid letting was held at 10:20 a.m. for two (2) motorgraders.

The Board discussed jail food contract.

Motion by Boykin second by Welte to go into Executive Session per Iowa Code Section 20.17(3). Carried 5-0 on roll call vote.

Motion by Welte second by Boykin to go out of Executive Session. Carried 5-0 on roll call vote.

The Board approved the separation of Todd A. Trobaugh, Deputy Sheriff, County Sheriffs Dept., effective 6-30-02. Position Unfunded / Layoff. Copy filed.

The Board approved the separation of Christopher P. Jansen, Deputy Sheriff, County Sheriffs Dept., effective 6-30-02. Position Unfunded / Layoff. Copy filed.

Motion by Boykin second by Walish to authorize the Chairman to sign the posting for hiring for a county attorneys secretary position and to allow the County Attorney to proceed to create a position to replace the current investigator position. Carried 5-0.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Harlan Steffe, 2840 - 140th Street, Moville, discussed with the Board the replacement of a secondary road bridge.

The Board adjourned the regular meeting until June 11, 2002.
