AUGUST 20, 2002EIGHTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, August 20, 2002 at 9:00 A.M. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Welte second by Walish to approve the Board minutes of August 13, 2002 as submitted. Carried 5-0.

Motion by Boykin second by Batcheller to approve the minutes of Executive Session of July 16, 2002 as submitted. Carried 5-0.

Motion by Batcheller second by Welte to approve the minutes of Executive Session of July 30, 2002 as submitted. Carried 5-0.

The Board approved the reclassification of Lori A. Winge, Lead Jail Nurse, County Sheriff Dept., @$18.06/hour, effective 7-01-02. Correction of 7-01-02 Salary Increase with $101.88 Retro Pay Due.

The Board approved the appointment of Dianne R. Wallwey-Ellis, Temporary Assistant County Attorney, County Attorney Dept., @ $45,312/year, effective 8-16-02. Job Vacancy Posted: 6-21-02. FY02-03 Salary Range: $39,100 - $45,312/year, based on experience. Will become F/T employee on 8-21-02. Copy filed.

The Board approved the separation of Cole J. Dixon, Temporary Summer Laborer, Secondary Roads Dept., effective 8-19-02. End of Temporary Employment. Copy filed.

The Board approved the reclassification of Nancy M. Carstensen, P/T M.V. Clerk II, County Treasurer Dept., @$10.89/hour, effective 8-26-02. Per AFSCME Cthouse. Contract agreement, from Grade 4, Step 1 to Grade 4, Step 2. Copy filed.

The Board approved the separation of Ann M. Long, Assistant County Attorney, County Attorney Dept., effective 9-13-02. Resignation. Copy filed.

Motion by Boykin second by Welte to approve and authorize the Chairman to sign the authorization to initiate hiring process for an Assistant County Attorney, County Attorney Dept. Entry Level: AFSCME Atty./Step 1 to Step 4: $39,100 - $45,312/year. Carried 5-0. Copy filed.

Motion by Boykin second by Walish to approve and authorize the Chairman to sign Local Public Health Services Contract for FY 2003. Carried 5-0. Copy filed.

Motion by Walish second by Boykin to approve and authorize the Chairman to sign Resolution No. 9589 to submit the Referendum on Riverboat gambling to the County Electorate for the 2002 General Election. Carried 5-0.

RESOLUTION 9589

WHEREAS, the voters of Woodbury County, Iowa approved the operation of gambling games on excursion gambling boats on May 17, 1994; and

WHEREAS, Iowa Code Section 99F.7(10)(d) requires that a proposition regarding the continuation of the operation of gambling games on excursion gambling boats be submitted to the county electorate at the general election held in 2002.

THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby directs the Commissioner of Elections to place on the November 5, 2002 general election ballot a proposition regarding the operation of gambling games on excursion gambling boats in the form prescribed by Rule 72121.820(7) (99F) as follows:

Summary: The continued operation of gambling games on excursion boats in Woodbury County is approved.

The continued operation of gambling games on excursion boats in Woodbury County is approved. If approved by a majority of the voters, operation of gambling games may continue on excursion boats in Woodbury County until the question is voted on again at the general election in eight years. If disapproved by a majority of voters, gambling games on excursion boats in Woodbury County will end nine years from the date of the original issue of the license to the current licensee.

Motion by Boykin second by Walish to approve Senior Internship Program FY03 Contractual Agreement and to authorize the Chairman to sign. Carried 5-0. Copy filed.

The Public Hearing for Sale of Real Property and Conveyance of Real Estate Interest Counties for proposed termination of easement by general release was held at 10:30 a.m.

Motion by Boykin second by Welte to close the Public Hearing on the sale of Real Property and Conveyance of Real Estate Interest Counties as there was no one present wishing to be heard on said sale and conveyance. Carried 5-0.

Motion by Walish second by Batcheller to authorize the Chairman to sign Termination of Easement by General Release. Carried 5-0. Copy filed.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board adjourned the regular meeting until August 27, 2002.
