MARCH 18, 2003THIRTY-SEVENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, March 18, 2003 at 9:00 A.M. Board members present were Batcheller, Boykin, and Walish, Clausen and Welte were absent. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Boykin second by Walish to approve the Board minutes of March 11, 2003 as submitted. Carried 2-0, Batcheller abstained.

The Board approved the separation of Bonnie L. Ames, Master Sergeant Jail Facility, County Sheriffs Dept., effective 3-12-03. Deceased. Copy filed.

The Board approved the appointment of Kyle D. Gates, Temporary Engineering Aide, Secondary Roads Dept., @$8.00/hour, effective 3-14-03. Not to exceed 120 days. Copy filed.

The Board approved the separation of Steven D. Polak II, Correctional Officer, County Sheriff Dept., effective 3-24-03. Resignation. Copy filed.

Motion by Boykin second by Batcheller to approve and authorize the Chairman to sign the authorization to initiate hiring process for a Male Correctional Officer, County Sheriff Dept. DSA Entry: $13.70/hour, and for a Master Sergeant Jail, County Sheriff Dept., In-House Wage Plan: To be determined. Carried 3-0. Copy filed.

The Board discussed DARE Grant Application with Patty Erickson-Puttmann, Social Service Coordinator.

Motion by Boykin second by Batcheller to approve the submission of the DARE Grant Application to the Iowa Department of Public Health for substance abuse prevention efforts. Carried 3-0. Copy filed.

Motion by Boykin second by Batcheller to postpone discussion of cell phones until next meeting.

The Public Hearing and sale of Real Estate Parcel #140370 (also known as 2743 Virginia St.) was held at 10:15 a.m. The Chairman called on anyone wishing to be heard on said sale.

Motion by Boykin second by Batcheller to close the Public Hearing on the sale of Real Estate Parcel #140370 as there was no one present wishing to be heard on said sale. Carried 3-0.

Chairman called for bids on Real Estate Parcel #140370. Stuart Brown bid $250.00 plus recording fees. There were no further bids.

Motion by Boykin second by Batcheller to accept Stuart Browns bid of $250.00 plus recording fees for Real Estate Parcel #140370.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

By Stuart D. and Stacey J. Brown in the sum of Two-Hundred and Fifty Dollars and No/100
($250.00)

for the following described real estate, To Wit:

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.
BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

RESOLUTION APPROVING PETITION FOR SUSPENSION
OF TAXES

WHEREAS, Ruth Castillo, as titleholders of real estate located at 1720 Jones Street, Sioux City, Woodbury County, Iowa, and legally described as follows:

Parcel # 297705


West Seventy-seven feet (W 77 ft) Lot One (1) Block One (1) Lawn Ridge Addition, City of Sioux City, Woodbury County, Iowa


WHEREAS, Ruth Castillo as titleholders of the aforementioned property has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

The Board discussed the consideration of applying for a Vision Iowa Grant for Bluffs Area Recreation Complex at Sergeant Bluff.

Motion by Boykin second by Batcheller to approve a letter of support to Vision Iowa Grant for Bluffs Area Recreation Complex. Carried 3-0. Copy filed.

Bid letting was held for Project CP-2003 for Maintenance Culvert Pipe.

The bids were as follows:

Johnson Fargo Culvert, Inc., St. Paul, MN $51,942.80
Metal Culverts Inc., Jefferson City, MO $57,309.54
Midwestern Culvert, Ltd., Ankeny, IA $51,899.30

There were no further bids.

Motion by Batcheller second by Boykin to receive the bids for Project CP-2003 Maintenance Culvert Pipe, and accept the bid of Northern Iowa Construction Products, Cedar Rapids, IA in the amount of $50,159.80, subject to review and recommendation of the county engineer. Carried 3-0. Copy filed.

Motion by Boykin second by Batcheller to authorize the Chairman to sign a Utility Accommodation Permit submitted by Woodbury County R.E.C., per recommendation of the county engineer. Carried 3-0. Copy filed.

Motion by Boykin second by Batcheller to approve and authorize the Chairman to sign an agreement with the City of Smithland to use Secondary Roads Department Equipment. Carried 3-0. Copy filed.

The Board discussed the March 11, 2003 public meeting which was held at Climbing Hill.

There was a discussion concerning appointment of designated county agent for county agricultural complaint investigations for the Department of Natural Resources.

Motion by Boykin second by Batcheller to appoint Gary Brown as designated agent for Woodbury County agriculturally related complaints or site surveys for the Department of Natural Resources. Carried 3-0. Copy filed.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Motion by Boykin second by Batcheller to go into Executive Session per Iowa Code Section 21.5(1)(f). Carried 3-0 on roll call vote.

Motion by Boykin second by Batcheller to go out of Executive Session. Carried 3-0 on roll call vote.

Motion by Boykin second by Batcheller to approve the recommendation of the attorney in the previous executive session. Carried 3-0.

The Board adjourned the regular meeting until March 25, 2003.
