APRIL 15, 2003FORTY-FIRST MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, April 15, 2003 at 9:00 A.M. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Clausen second by Batcheller to amend and approve the Board minutes of April 8, 2003 as submitted to reflect Mr. Clausen as a no vote on action taken to receive a letter of request from Robert and Karen Keegan requesting vacation of road right of way, per recommendation of the county engineer. Carried 5-0.

Motion by Boykin second by Clausen to approve and receive for signatures a resolution proclaiming the week of April 13-19, 2003 as National Public Safety Telecommunications Week and presentation to honor Woodbury County 911 Center public safety dispatchers. Carried 5-0.

RESOLUTION NO. 9640

PROCLAMATION

WHEREAS, Woodbury County Communications will honor the men and women who serve as public safety dispatchers during National Public Safety Telecommunications Week, April 13-19, 2003 and

WHEREAS, introduced to Congress in 1991, National Public Safety Telecommunications Week is the second full week of April each year. This week is dedicated to public safety telecommunicators who aid in providing 9-1-1 emergency assistance to citizens everywhere, and

WHEREAS, every day, millions of people depend on the skill, expertise and commitment of the men and women who work in public safety telecommunications. These individuals help save countless lives by responding to emergency calls, dispatching emergency professionals and equipment and providing moral support to citizens in distress, and

WHEREAS, the term 9-1-1 is often associated with rapid emergency response, poise under pressure, aid and compassion in times of distress and critical decision-making within seconds. Many people dont stop to think about these seemingly nameless, faceless individuals until they experience actual emergencies themselves. These professionals make the difference between life and death in many instances.

THEREFORE, The Woodbury County Board of Supervisors do hereby proclaim

The Board approved the separation of Kyle D. Gates, Temporary Engineering Aide, Secondary Roads Dept., effective 3-24-03. End of Temporary Work. Copy filed.

The Board approved the unpaid leave of absence of Bradley D. Rose, Correctional Officer, County Sheriff Dept., effective 4-5-03. Unpaid Leave of Absence preceded by 30 calendar days/year Military Leave. Copy filed.

Ms. Paula Johnson from Robert Half Management Resources Consultant gave an assessment report with recommendations to the Board concerning Health and Insurance Portability and Accountability Act (HIPAA).

Motion by Boykin second by Batcheller to authorize the Chairman to sign an extension to the existing contract with Robert Half Management Resources Consultant to provide additional services to assist the county in implementation of the Health Insurance Portability and Accountability Act. Carried 4-1, Clausen opposed.

Motion by Boykin second by Clausen to appoint J.D. Pellersells as interim compliance officer for Woodbury County as required by the Health Insurance Portability and Accountability Act. Carried 5-0.

Motion by Welte second by Boykin to authorize the Chairman to sign proposal for Design Services with Calhoun-Burns & Associates, Inc., West Des Moines, IA for preliminary design of a proposed bridge replacement over Little Sioux River on Route L-36 at Correctionville, per recommendation of the county engineer. Carried 5-0. Copy filed.

Motion by Batcheller second by Boykin to accept the quote from Schmillen Construction, Inc., Marcus, Iowa, to crush concrete at Luton stockpile, per recommendation of the county engineer. Carried 5-0. Copy filed.

There was a preliminary discussion to replace Sergeant Bluff Maintenance facility.

Motion by Welte second by Clausen to refer preliminary plans for Reinholdt Subdivision to the Zoning Commission for review and recommendations. Carried 5-0. Copy filed.

Motion by Welte second by Boykin to adjourn the regular meeting to convene a meeting of inter-county drainage districts under the Woodbury County Board of Supervisors as trustees. Carried 5-0.

Chairman called the meeting to order for the Little Sioux Inter-County Drainage District of Monona, Woodbury and Harrison Counties.

Motion by Boykin second by Welte to approve and authorize the Chairman to sign a resolution adopting and levying special assessment in Little Sioux Inter-County Drainage District of Monona, Woodbury and Harrison Counties. Carried 5-0.

Resolution No. 9641

RESOLUTION ADOPTING AND LEVYING SPECIAL ASSESSMENT
IN THE LITTLE SIOUX INTER-COUNTY DRAINAGE DISTRICT

WHEREAS, the Board of Trustees of the Little Sioux Inter-County Drainage District, in session on the 12th day of March, 2003, requested that the Board of Supervisors levy a special assessment of Forty-six (46%) Percent of the Original Assessment on all tracts of land, lots, public roads, and railroads in the Little Sioux Inter-County Drainage District to procure funds from which to pay the costs and expenses of repair and maintenance incurred.

NOW, THEREFORE, BE IT RESOLVED by the Joint Board of Supervisors of Monona, Woodbury and Harrison Counties, Iowa, acting as a Drainage Board for the Little Sioux Inter-County Drainage District, that there be and is hereby levied upon all tracts of land, lots, public roads, and railroads in the Little Sioux Inter-County Drainage District of Monona, Woodbury and Harrison Counties, Iowa, a special assessment in the amount of Forty-six (46%) Percent of the Original Assessment, and the Auditors of Monona, Woodbury and Harrison Counties, Iowa, be directed and ordered to spread such levy upon said lands, to be collected under 468.55 in semi-annual installments in the same manner as general property taxes are collected pursuant to 445.36 in the year 2003-2004.

PASSED and APPROVED this 15th day of April, 2003, Board of Supervisors, Woodbury County, Iowa.

Chairman called the meeting to order for the McCandless Inter-County Drainage District.

Motion by Welte second by Boykin to approve and authorize the Chairman to sign a resolution adopting and levying special assessment in McCandless Inter-County Drainage District of Monona and Woodbury Counties. Carried 5-0.

RESOLUTION ADOPTING AND LEVYING SPECIAL ASSESSMENT
IN THE MCCANDLESS INTER-COUNTY DRAINAGE DISTRICT

WHEREAS, the Board of Trustees of the McCandless Inter-County Drainage District, in session on the 19th day of February, 2003, requested that the Board of Supervisors levy a special assessment of eighty percent (80%) of the Original Assessment on all tracts of land, lots, public roads, and railroads in the McCandless Inter-County Drainage District to procure funds from which to pay the costs and expenses of repair and maintenance incurred.

NOW, THEREFORE, BE IT RESOLVED by the Joint Board of Supervisors of Monona and Woodbury Counties, Iowa, acting as a Drainage Board for the McCandless Inter-County Drainage District, that there be and is hereby levied upon all tracts of land, lots, public roads, and railroads in the McCandless Inter-County Drainage District of Monona and Woodbury Counties, Iowa, a special assessment in the amount of eighty percent (80%) of the Original Assessment, and the Auditors of Monona and Woodbury Counties, Iowa, be directed and ordered to spread such levy upon said lands, to be collected under 468.55 in semi-annual installments in the same manner as general property taxes are collected pursuant to 445.36 in the year 2003-2004.

IN THE SANDHILL-LAKEPORT DRAINAGE DISTRICT

WHEREAS, the Board of Trustees of the Sandhill-Lakeport Inter-County Drainage District, in session on the 10th day of March, 2003, requested that the Board of Supervisors levy a special assessment of Twenty-One (21%) Percent of the Original Assessment on all tracts of land, lots, public roads, and railroads in the Sandhill-Lakeport Inter-County Drainage District to procure funds from which to pay the costs and expenses of repair and maintenance incurred.

NOW, THEREFORE, BE IT RESOLVED by the Joint Board of Supervisors of Monona and Woodbury Counties, Iowa, acting as a Drainage Board for the Sandhill-Lakeport Inter-County Drainage District, that there be and is hereby levied upon all tracts of land, lots, public roads, and railroads in the Sandhill-Lakeport Inter-County Drainage District of Monona and Woodbury Counties, Iowa, a special assessment in the amount of Twenty-One (21%) Percent of the Original Assessment, and the Auditors of Monona and Woodbury Counties, Iowa, be directed and ordered to spread such levy upon said lands, to be collected under 468.55 in semi-annual installments in the same manner as general property taxes are collected pursuant to 445.36 in the year 2003-2004.

The Chairman adjourned the Sandhill-Lakeport Inter-County Drainage District meeting.

Chairman called the regular meeting to order.

Motion by Welte second by Batcheller to receive County Auditors Quarterly Report for the third quarter ending 3-31-03. Carried 5-0. Copy filed.

Motion by Clausen second by Boykin to acknowledge the appointment of Ida M. Milligan, 1469 Buchanan Ave., Sioux City, IA for the office of Concord Township Clerk, to fill a vacancy until the General Election of 2004. The appointment is to fill the office previously held by Frances Solomon. Carried 5-0. Copy filed.

Darrell Geib from USDA gave an update presentation on Climbing Hill.

The Board discussed elected officials deputies.

Sheriff David Amick and the Board discussed county jail inspection.

Motion by Welte second by Boykin to authorize the Chairman to sign letter of authorization for Siouxland Community Foundation Grant on behalf of Woodbury County Disaster and Emergency Services. Carried 5-0. Copy filed.

Gary Brown, Director of Disaster and Emergency Services, gave a presentation to the Board of Woodbury County-wide Multi Hazard Emergency Operation Plan.

Motion by Boykin second by Welte to approve and receive for signatures Resolution No. 9644, approving the Woodbury County-wide Multi Hazard Emergency Operations Plan. Carried 5-0.

Resolution No. 9644

RESOLUTION

WHEREAS, The Woodbury County Board of Supervisors of Woodbury County, Iowa, pursuant to Iowa Code is vested with the authority of administering the affairs of Woodbury, Iowa; and

WHEREAS, It has been determined that a Woodbury County-wide Multi-Hazard Emergency Operations Plan; has been developed in order to provide for a coordinated response and recovery to a disaster or emergency in Woodbury County.

WHEREAS, The Board of Supervisors of Woodbury County, deems it advisable and in the best interests of Woodbury County to approve said County-wide, Multi-Hazard Emergency Operations Plan;

NOW THEREFORE, BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa that the Woodbury County-wide, Multi-Hazard Emergency Operations Plan be, and hereby is approved.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board recessed for lunch.

The Board reconvened to a public meeting of the Board of Supervisors and the Jail Advisory Committee of the Criminal Justice Council in the Gleeson Room, Wilbur Aalfs Public Library.

The Board adjourned the regular meeting until April 22, 2003.
