OCTOBER 10, 2006THIRTY-NINTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, October 10, 2006 at 9:00 a.m. Board members present were Batcheller, Clausen, Monson and Walish; Boykin was absent. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and Bobbier Johnson, Assistant County Attorney.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Batcheller second by Monson to approve the Board minutes of the October 3, 2006 meeting as submitted. Carried 3-0, Walish abstained. Copy filed.

The Board approved the appointment of Douglas E. Washburn, Equipment Operator, Secondary Roads Dept., $16.05/hour, effective 10/11/2006. Job vacancy posted 08/21/2006. Entry level salary $16.05/hour. Copy filed.

Motion by Batcheller second by Walish to receive the County Auditors quarterly report for period ending 09/30/2006. Carried 4-0. Copy filed.

Motion by Walish second by Monson to approve and authorize the Chairman to sign a Resolution setting a public hearing for the sale of real estate parcel #554675 to the City of Sioux City. Carried 4-0.

WHEREAS Woodbury County, Iowa is the owner under a tax deed of certain parcel of real estate described as:

Part of Tax Lots 5 and 18 in the Auditors plat of Unplatted and Vacated Parts, Sec. 11, T89, R 47, all lying between the Southerly and Southwesterly line of Rogers Replat of Lots 5-6-7-8-9 and 10 of Rogers Addition to Sioux City, Iowa and the Northeasterly line of Lots 2 and 3 of the Elmwood Addition to Sioux City, Woodbury County, Iowa and the Northwesterly line of Floyd Blvd., as shown on Exhibit A (sheet 1 of 2) of Acquisition Plat and by reference made a part hereof more particularly described as follows: Beginning at the Northeast corner of said Lot 3 of the Elmwood Addition to Sioux City; thence N 534424W along the Northeasterly line of said Lot 3 of the Elmwood Addition for 82.16 feet; thence N 695732W along said Northeasterly line of said Lot 3 of the Elmwood Addition for 161.60 feet; thence N 700734W along the Northeasterly line of said Lot 2 of the Elmwood Addition for 79.37 feet; thence N 284042E for 35.32 feet; thence S 693608E along said Southwesterly line of Rogers Replat of Lots 5-6-7-8-9 and 10 of Rogers Addition for 114.42 feet; thence N 873312E along said Southerly line of said Rogers Replat of Lots 5-6-7-8-9 and 10 of Rogers Addition for 58.69 feet; thence S 583538E along said Southwesterly line of Rogers Replat of Lots 5-6-7-8-9 and 10 of Rogers Addition for 169.64 feet; thence Southwesterly along said Northwesterly line of Floyd Blvd. and a 4623.66 foot radius curve concave Southeasterly for a curve distance of 50.27 feet with a delta of 03722 to the point of beginning, said curve having a chord bearing of S 435921W and a chord distance of 50.26 feet. Also known as that same parcel described on Roll 235, Image 2158, as filed and recorded in the Recorders/Auditors office of the Woodbury County Court House, in Sioux City, Iowa, being described as: Parcel #554675 LL SC Comm Auditors Plat of Vacated and Unplatted Parts of Section Eleven (11) Township Eighty-nine (89) Range Forty-seven (47), and irregular tract lying North and Adjacent to Evergreen Lodges Inc., City of Sioux City, Woodbury County, Iowa (3267 Floyd Blvd.)

NOW THEREFORE,
BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on the 24th day of October, 2006, at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. The said Board proposes to sell the said parcel of real estate on the 24th day of October, 2006, immediately following the closing of the public hearing, to the City of Sioux City, Iowa only per Code of Iowa 331.361(3).

3. That said Board proposes to sell the said real estate to the City of Sioux City, Iowa, only for consideration of $1.00 plus recording fees.

4. That this resolution, preceded by the caption 'Notice of Property Sale and except for this subparagraph 4, be published as notice of the aforesaid proposal, hearing and sale.

Motion by Batcheller second by Monson to authorize the use of Board Expense for supplies required to enforce the Woodbury County beer keg ordinance that goes into effect 11/03/2006. Carried 4-0.

Motion by Batcheller second by Walish to approve and authorize the Chairman to sign an addendum to the food service contract between Woodbury County and CBM Foodservice, to extend the existing contract for five years beginning on July 1, 2006. Carried 4-0. Copy filed.

Motion by Walish second by Monson to approve and authorize the Chairman to sign a certificate of completion for the 2006 maintenance gravel contract with Hallet Materials. Carried 4-0. Copy filed.

Motion by Batcheller second by Monson to approve and authorize the Chairman to sign a utility accommodation permit submitted by Northwest Iowa Telephone Company, Sergeant Bluff, for installation of phone cable on Eastland Avenue between 280th and 290th Street, and fiber optic cable on Glen Ellen from Elk Creek Road to 190th Street and 190th Street from Elk Creek Road to Buchanan Avenue, per recommendation of the County Engineer. Carried 4-0. Copy filed.

Motion by Batcheller second by Walish to approve plans for projects #LC05(1)73-97, #LC05(6)73-97,
#LC06(3)73-97, and #LC06(4)73-97, per recommendation of the County Engineer. Carried 4-0.

Motion by Monson second by Walish to approve a temporary removal of the embargo on Warrior Road, between Old Lakeport Road and Lewis Boulevard, for one month, to allow the movement of grain during harvest, per recommendation of the County Engineer. Carried 4-0.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Linda Phillips of Siouxland Cares and Glenn Parrett, Woodbury County Sheriff made a presentation to the Board for Red Ribbon Week.

The Board adjourned the regular meeting until October 17, 2006.
