OCTOBER 24, 2006FORTY-FIRST MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, October 24, 2006 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrator, Diane Swoboda Peterson, Deputy/Clerk to the Board, and Bobbier Johnson, Assistant County Attorney.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Batcheller second by Monson to approve the Board minutes of the October 17, 2006 meeting as submitted. Carried 4-0, Batcheller abstained. Copy filed.

The Board approved the appointment of Robert J. Bulit, Sheriffs Reserve Volunteer, County Sheriff Dept., $1.00/year, effective 10/25/2006. Per Iowa Code 80D.11. Copy filed.

The Board approved the appointment of Travis L. Wichers, Sheriffs Reserve Volunteer, County Sheriff Dept., $1.00/year, effective 10/25/2006. Per Iowa Code 80D.11. Copy filed.

The Board approved the reclassification of Carrie A. Klosterman, Clerk/Secretary, Social Services Dept., $12.22/hour, effective 10/27/2006. Per wage plan comparability with AFSCME Courthouse contract. Copy filed.

Motion by Boykin second by Walish to approve setting the floating Christmas holiday date for wage plan employees as Tuesday, December 26, 2006. Carried 5-0.

The Board discussed the cancellation of the 12/26/2006 meeting of the Board of Supervisors.

Motion by Boykin second by Walish to not have a Board of Supervisors meeting on 12/26/2006. Carried 5-0.

Motion by Monson second by Walish to receive the County Recorders Report of Fees Collected for the period of 07/01/2006 through 09/30/2006. Carried 5-0. Copy filed.

The Board discussed use of a vacant room at the Trosper-Hoyt Building with Mark Olsen, Juvenile Detention Director.

Motion by Boykin second by Monson to approve the Juvenile Detention Department using a vacant room at the Trosper-Hoyt Building for classroom use. Carried 5-0.

A public hearing was held at 10:15 a.m. for the sale of real estate parcel #554675 (3267 Floyd Blvd.).

Motion by Batcheller second by Boykin to close the hearing. Carried 5-0.

The Chairman called for bids.

The City of Sioux City bid $1.00.

There were no further bids.

Motion by Boykin second by Batcheller to accept the bid from the City of Sioux City for $1.00, plus recording fees. Carried 5-0.

Now and included in and forming a part of the City of Sioux City, Iowa, the same is hereby accepted: said

Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said Real Estate.

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.

BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

The Board discussed a Tri-State Equestrian project memorandum of understanding, with Rob Marqusee, Rural Economic Development Director.

Motion by Boykin second by Walish to approve and authorize the Chairman to sign the Memorandum of Understanding between Woodbury County Board of Supervisors, Tri-State Equestrian Group, Woodbury County Fairgrounds Association, and the City of Moville. Carried 4-1; Batcheller opposed. Copy filed.

Motion by Walish second by Boykin to approve and authorize the Chairman to sign a Resolution in support of the Iowa Legislature maintaining its commitment to the local management of the adult MH/DD System, per recommendation of Social Services Coordinator Patty Erickson-Puttmann. Carried 5-0.

WOODBURY COUNTY, IOWA
RESOLUTION SUPPORTING THE COUNTY
MANAGEMENT OF THE ADULT MH/DD SYSTEM
RESOLUTION #10,103

Whereas, county property taxes have been and continue to be a major funding source for services to adults with MH/MR/DD/BI,

Whereas, beginning in 1994, the state began a process to fund a larger amount of the adult service system from state funds,

Whereas, beginning in 1994, the state embarked on a partnership with the counties to fund 50% of the base and all of the growth in the system,

Whereas, the counties agreed to manage the system with the combination of local, state and federal funds,

Whereas, the MH/DD/MR/BI Commission undertook a project to improve the system and in that evaluation confirmed that the adult disability service system should be managed by the counties,

Whereas, the county system has worked well for the past ten years,

Whereas, there is no evidence that a centralized system of services will provide better services for less money than the current system,

Now, therefore, be it resolved by the Board of Supervisors of Woodbury County that the undersigned do hereby, request the Iowa Legislature to maintain its commitment to the local management of the adult MH/DD/MR/BI system in Iowa.

The Board discussed Change Order #1 for the current contract with Holtze Construction for Phase VIII Courthouse Restoration, with Social Services Coordinator Patty Erickson-Puttmann. The Change Order adds $1,200.00 for using cast iron in lieu of PVC for the sanitary sewer, and $11,070.00 for sawing and hauling excess tonnage of concrete due to 9 thickness in lieu of 6 per contractors letter dated 09/29/2006. Net change to contract: $12,270.00.

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign Change Order #1, increasing contract from $548,205.00 to $560,475.00. Carried 5-0. Copy filed.

Sherry McGill, Woodbury County Extension, gave a presentation to the Board regarding the Woodbury County Extension November 7, 2006 ballot issue.

Al Welding, Co-Chair of Friends of Extension Committee addressed the Board.

Motion by Batcheller second by Walish to accept the quotation of Christensen Brothers, Cherokee, Iowa, maintenance repairs to five bridges, totaling $157,110.00, per recommendation of the County Engineer, Richard Storm. Carried 5-0. Copy filed.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board adjourned the regular meeting until October 31, 2006.

The Board toured various County roads.
