AUGUST 7, 2007THIRTY-SECOND MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, August 7, 2007 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrator, Loan Hensley, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Monson second by Clausen to approve the Board minutes of the July 31, 2007 meeting as submitted. Carried 5-0. Copy filed.

The Board approved the separation of Landen M. Wright, Temporary Summer Laborer, Secondary Roads Dept., effective 08/03/2007. End of temporary work. Copy filed.

The Board approved the separation of Joel A. Bertrand, Correctional Officer, County Sheriff Dept., effective 08/10/007. Resignation. Copy filed.

The Board approved the separation of Luke S. Jenkins, Temporary Summer Laborer, Secondary Roads Dept., effective 08/10/2007. End of temporary work. Copy filed.

The Board approved the separation of Cody F. Forch, Temporary Summer Laborer, Secondary Roads Dept., effective 08/10/2007. End of temporary work. Copy filed.

The Board approved the reclassification of Marti S. Sleister, Assistant County Attorney, County Attorney Dept., $51,374/year, effective 08/15/2007. Per AFSCME Assistant County Attorney contract agreement from Step 3 to Step 4. Copy filed.

The Board approved the reclassification of Michael T. McDonald, Custodian, Building Services Dept., $11.88/hour, effective 08/17/2007. Per AFSCME Courthouse contract agreement from Grade 1, Step 2 to Grade 1, Step 3. Copy filed.

The Board approved the reclassification of David A. Dawson, Assistant County Attorney, County Attorney Dept., $62,917/year, effective 08/19/2007. Per AFSCME Assistant County Attorney contract agreement from Step 7 to Step 8. Copy filed.

Motion by Clausen second by Batcheller to approve and authorize the Chairman to sign an Authorization to Initiate Hiring Process for a Correctional Officer, County Sheriff Dept. Entry level: D.S.A. $14.32/hour. Carried 5-0. Copy filed.

Motion by Monson second by Boykin to approve and authorize the Chairman to sign, a Resolution approving petition for suspension of taxes for George M. Whitmore, 1319 Main Street, Sioux City, IA. Carried 5-0.

RESOLUTION APPROVING PETITION FOR SUSPENSION OF TAXES

WHEREAS, George M. Whitmore, is the titleholder of property located at 1319 Main Street, City of Sioux City, Woodbury County, Iowa, and legally described as follows:

Sioux City East Lot 1 & Lots 2 (EX A PT Of Lots 1 & 2 COM NELY COR Lot 1 THEC W 136.11 FT TO POB; THEC W 128.86 FT,SWLY 80.08 FT, SWLY121.58 FT, NELY 43.63 FT, E 16.18 FT, N7.12 FT, W 40.22 FT, & N 98.56 FT) Block 76 City of Sioux City, Woodbury County, Iowa
WHEREAS, George M. Whitmore as titleholder of the aforementioned real estate have petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

The Board discussed tax abatement on various parcels which are buildings on leased land for mobile homes that have been removed or disposed of.

Motion by Batcheller second by Boykin to approve tax abatement for the following parcels:

1. Parcel #8847-30-301-936 James Michael Blenderman - Building on leased land for a mobile home that has been removed and is no longer assessed. Taxes due and payable 2007-2008 total $88.00.

2. Parcel #8847-30-301-956 Heather Clay - Building on leased land for a mobile home that has been removed and is no longer assessed. Taxes due and payable 2006-2007 and 2007-2008 total $68.00 plus interest.

3. Parcel #8944-32-276-905 Matthew J. Gist - Building on leased land (deck) for a mobile home that has been removed. Taxes due and payable 2007-2008 total $5.00.

4. Parcel #8847-30-301-964 Stacy English - Building on leased land for a mobile home that has been removed and is no longer assessed. Taxes due and payable 2006-2007 total $50.00 plus interest.

5. Parcel #8847-30-301-962 Jared Messer - Building on leased land for a mobile home that has been removed and is no longer assessed. Taxes due and payable 2006-2007 and 2007-2008 total $78.00 plus interest.

The Board discussed change order #9 for the Woodbury County Courthouse Phase 8 renovation project, with Patty Erickson-Puttmann.

Motion by Batcheller second by Monson to approve and authorize the Chairman to sign change order #9, authorizing Holtze Construction to install ten new eight foot light fixtures, furnished by the County, for $378.00. Carried 5-0. Copy filed.

Motion by Boykin second by Monson to approve the use of Riverboat Funds for change order #9, authorizing Holtze Construction to install ten new eight foot light fixtures, furnished by the County, for $378.00. Carried 5-0. Copy filed.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign a certificated of completion for project #L-EWP07(2)73-97, per recommendation by the County Engineer. Carried 5-0. Copy filed.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign an agreement with Iowa DOT for constructing a salt storage shed at Moville, with 50% cost sharing, per recommendation by the County Engineer. Carried 5-0. Copy filed.

Motion by Boykin second by Monson to cancel a hearing to be held at 10:15 a.m. with Ellie Cremer, Ho-Chunk, Incorporated, regarding a tobacco law violation by Heritage Express, 1501 330th Street, Sloan, Iowa per recommendation of Loan Hensley, Assistant County Attorney. Carried 5-0.

The Board discussed Harrison Replat Lot 6 Harrisons Addition Subdivision, with John Pylelo, Planning and Zoning Administrator.

Motion by Batcheller second by Boykin to deny a waiver of the Countys subdivision requirements. Carried 5-0.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board adjourned the regular meeting until August 14, 2007.
