AUGUST 14, 2007THIRTY-THIRD MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, August 14, 2007 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Denise Fletcher, Public Bidder, Loan Hensley, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Monson second by Boykin to approve the Board minutes of the August 7, 2007 meeting as submitted. Carried 5-0. Copy filed.

The Board approved the separation of Cory A. Steffen, Temporary Summer Laborer, Secondary Roads Dept., effective 08/08/2007. End of temporary work. Copy filed.

The Board approved the end of probation for Ronald D. Albers, Equipment Operator, Secondary Roads Dept., $17.06/hour, effective 08/20/007. End of probation salary increase. Copy filed.

The Board approved the reclassification of Jayme A. Kirsch, Assistant County Attorney, County Attorney Dept., $62,917/year, effective 09/02/2007. Per AFSCME Assistant County Attorney contract agreement, from Step 7 to Step 8. Copy filed.

The Board approved the separation of Jeremy S. Peterson, Assistant County Attorney, County Attorney Dept., effective 09/07/2007. Resignation. Copy filed.

Motion by Clausen second by Batcheller to approve and authorize the Chairman to sign an Authorization to Initiate Hiring Process for the following positions:

Assistant County Attorney, County Attorney Dept. Entry level: AFSCME Assistant Attorney, $44,223-$51,374/year based on experience.

Case Manager, Social Services Dept. Entry Level: Wage plan, $35,515/year.

Social Services Internship, Social Services Dept. Entry level: 9 month temporary part-time status, $7.00/hour

Motion by Monson second by Boykin to approve and authorize the Chairman to sign, a Resolution approving tax suspension via right of redemption for Kathleen R. Casper, 1925 S. Pomegranite Street, Sioux City, IA. Carried 5-0.

RESOLUTION APPROVING PETITION FOR SUSPENSION
OF TAXES THROUGH THE REDEMPTION PROCESS

WHEREAS, Kathleen R. Casper as joint titleholder of a real estate located at 1925 S. Pomegranite Street, Sioux City, Woodbury County, Iowa, and legally described as follows:

Hedges Morningside South Thirty-five feet (35 ft) Lot Six (6) Block Thirteen (13), City of Sioux City, Woodbury County, Iowa

WHEREAS, Kathleen R. Casper, as joint titleholder of the aforementioned property has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1999 Iowa Code Section 447.9(3) and,

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby directs the County Auditor to redeem Parcel #884705143016 owned by the petitioner from the holder of a certificate of purchase of the amount necessary to redeem under section 447.1, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this parcel.

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes owing on the above parcel according to Code of Iowa, 445.63, and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

The Board discussed funding for the Sioux City Schools Annual Career, College, and Leadership Conference.

Motion by Batcheller second by Monson to approve funding the Conference from Riverboat Funds. Carried 5-0.

Motion by Boykin second by Monson to approve and authorize the chairman to sign a settlement agreement for a tobacco law violation for Heritage Express, 1501 330th Street, Sloan, Iowa per recommendation of Loan Hensley, Assistant County Attorney. Carried 5-0.

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign a contract with CBM Food Service to provide food service for Juvenile Detention for one year, at $1.45/meal, per bid awarded 07/31/2007. Carried 5-0. Copy filed.

Motion by Clausen second by Monson to approve and authorize the Chairman to sign an addendum and renewal to the contract with Mercy Health Services to provide Juvenile Detention with on-site nursing services, effective 09/01/2007. Carried 4-0, Boykin abstained.

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign a utility accommodation permit submitted by Frontier Communications, to install an underground phone line along a section of Lenox Avenue near Pierson, per recommendation of the County Engineer. Carried 5-0. Copy filed.

Motion by Clausen second by Monson to approve and authorize the Chairman to sign a utility accommodation permit submitted by Qwest, Omaha, NE, originally presented to the Board on 07/24/2007, to replace a section of line in the vicinity of a bridge replacement, per recommendation of the County Engineer. Carried 5-0. Copy filed.

Motion by Batcheller second by Boykin to approve the quote received from Kooiker, Incorporated, LeMars, IA, to repair two bridges in Floyd Township at a combined cost of $70,100.00, per recommendation of the County Engineer. Carried 5-0.

The Board discussed the possibility of holding public, no-reserve, auctions for County held deeds and tax sale certificates, with County Treasurer Bob Knowler.

Motion by Batcheller second by Boykin to approve holding public, no-reserve, auctions for the sale of County held deeds and tax certificates. Carried 5-0.

The Board held an appeal of a General Relief decision hearing for Christy Hernandez.

Motion by Batcheller second by Clausen to deny the request for assistance. Carried 5-0.

Mr. Boykin excused himself at 10:30 a.m.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.

Loan Hensley addressed the Board about a previous tax abatement where a sale of the property is imminent.

Rick Schneider, Conservation Director, invited the Board to the grand opening of a trail at the Little Sioux Park.

The Board adjourned the regular meeting until August 21, 2007.
