SEPTEMBER 4, 2007THIRTY-SIXTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, September 4, 2007 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrator, Loan Hensley, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Batcheller second by Clausen to approve the Board minutes of the August 28, 2007 meeting as submitted. Carried 4-0; Monson abstained. Copy filed.

The Board approved the appointment of Elven C. Merritt, Jr., Temporary Shredder, Social Services Dept., $5.50/hour, effective 08/29/2007. Not to exceed 120 days. Copy filed.

Motion by Clausen second by Monson to approve and authorize the Chairman to sign a Resolution approving tax suspension via right of redemption for Cathy Johnson, 3001 S. Cornelia Street, Sioux City, Iowa. Motion failed 1-4; Boykin voting aye.

Motion by Clausen second by Boykin to approve lifting the tax suspension for Cleo Manolis, 914 Jones Street, Sioux City, Iowa, as this person is deceased, and the property has been sold. Carried 5-0.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign a Resolution approving abatement of taxes for Siouxland Community Christian School, parcel #561285. Carried 5-0.

RESOLUTION APPROVING ABATEMENT OF TAXES

WHEREAS, Siouxland Community Christian School is the titleholder of real estate Parcel #561285 located in Woodbury County, Iowa and legally described as follows:

Auditors Plat St. Vincent Sub- Division South West 19-89-47 West 383.9 Feet Lot 24 LL-SC Comm 89-47

WHEREAS, the above stated property has taxes owing for the 2004/05, 2005/06 and 2006/07 tax year and the parcel is owned by Siouxland Community Christian School and

WHEREAS, the organization, namely the Siouxland Community Christian School is failing to immediately pay the taxes due; and

WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes and any future taxes that may be levied against this parcel for as long as this parcel is owned by Siouxland Community Christian School; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes owing on the above parcel according to Code of Iowa, 427.8 and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

SO RESOLVED this 4th day of September, 2007.

Motion by Batcheller second by Monson to approve and authorize the Chairman to sign a Resolution setting the public hearing and sale date for parcel #032865, 1201 Iowa Street, Sioux City, Iowa. Motion failed 0-5.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign a Resolution approving tax abatement for the City of Sloan, for parcels #864629384006, #864629384007, #864629384008, and #864629384009. Carried 5-0.

RESOLUTION APPROVING ABATEMENT OF TAXES

WHEREAS, the City of Sloan is the titleholder of real estate Parcels #864629384006 #864629384007, #864629384008 and #864629384009 located in Woodbury County, Iowa and legally described as follows:

WHEREAS, the above stated property has an unpaid balance of taxes owing, and the parcels are owned by a political subdivision of the state; and

WHEREAS, the City of Sloan requests the Board of Supervisors abate the tax representing that part of the taxes after which the City of Sloan was in sole possession; and

WHEREAS, the political subdivision, namely the City of Sloan is failing to immediately pay the taxes due; and

WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes and any future taxes that may be levied against these parcels for so long as this parcel is owned by the City of Sloan; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes owing on the above parcels according to Code of Iowa, 445.63, and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

The Board discussed tax abatement on various parcels which are buildings on leased land or mobile homes that have been removed or disposed of.

Motion by Batcheller second by Monson to approve tax abatement for the following parcels:

1. Parcel #8644-14-100-901 Larry Parr - Building on leased land (mobile home) that has been removed and is no longer assessed. Taxes due and payable 2007-2008 total $80.00.

2. Parcel #8748-10-200-902 Jerry Holder - Building on leased land that has been removed and is no longer assessed. Taxes due and payable 2007-2008 total $64.00.

3. Parcel #8944-32-109-003 Town of Moville- Taxes were erroneously assessed. Taxes due and payable 2007-2008 total $996.00.

Carried 5-0.

Motion by Boykin second by Clausen to approve and authorize the Chairman to sign a lease agreement with the Department of Human Services for the use of the ICN Room in the Trosper-Hoyt County Services Building, effective 01/01/2008 through 12/31/2008. Carried 5-0. Copy filed.

Motion by Boykin second by Clausen to approve and authorize the Chairman to sign form NRCS-ADS-78 Assurances Relating To Real Property Acquisition, for the Glen Ellen Sub-watershed rehabilitation project. Carried 5-0. Copy filed.

Motion by Batcheller second by Boykin to postpone action to approve and authorize the Chairman to sign modification #2 to Project Agreement #69-6114-3-17 for the Little Sioux Watershed and Glen Ellen Sub-watershed. Carried 5-0. Copy filed.

Motion by Monson second by Boykin to approve and authorize the Chairman to sign a Utility Accommodation Permit submitted by Enterprise Pipeline, per recommendation of the County Engineer. Carried 5-0. Copy filed.

Motion by Batcheller second by Clausen to approve and authorize the Chairman to sign a claim reimbursing Iowa DOT for materials inspection costs on project #STP-S-CO97(78)5E-97, per recommendation of the County Engineer. Carried 5-0.

Motion by Monson second by Boykin to approve and authorize the Chairman to sign an agreement with the City of Lawton for use of Secondary Roads pothole patching equipment. Carried 5-0. Copy filed.

Motion by Batcheller second by Monson to approve and authorize the Chairman to sign a Resolution approving the acceptance of electronic conveyance of Groundwater Hazard statements by the Recorders Office. Carried 5-0.

GROUNDWATER HAZARD REPORTING SYSTEM
RESOLUTION #10,196

WHEREAS, Woodbury County (County) and the Iowa County Recorders Association (Association) have created a county land record information systems in order to provide public access to real estate documents; and

WHEREAS, all Iowa counties are required to process Groundwater Hazard Statements as provided in Iowa Code section 558.69; and

WHEREAS, Iowa Code section 558.69 requires the submission of the Groundwater Hazard Statements to the Iowa Department of Natural Resources (Department); and

WHEREAS, the Department has adopted Iowa Administrative Code chapter 561 IAC 9, which allows the electronic submission of the Groundwater Hazard Statements; and

WHEREAS, the County and the Department desire to utilize the county land record information system as a means to provide for more efficient and timely filing of the Groundwater Hazard Statements;

THEREFORE, BE IT RESOLVED that the County acknowledges that the County is responsible for the processing and filing of Groundwater Hazard Statements as provided in Section 558.69 of the Iowa Code and the chapter 561 IAC 9 of the Iowa Administrative Code. The County requests that in lieu of forwarding a printed version of any affirmative Groundwater Hazard Statement to the Department of Natural Resources, a facsimile or image of the printed version of the Groundwater Hazard Statement shall be stored in the local county land record indexing and imaging system.

BE IT FURTHER RESOLVED that the County agrees to the following terms and conditions.

a. A facsimile or image of a printed version of all forms required to be submitted to the Department pursuant to 561 IAC 9 shall be stored within the local county land record indexing and imaging system.

b. The facsimile or image of the form shall be permanently stored in the local county land record indexing and imaging system.

c. The image shall be legible and shall comply with the document formatting and imaging standards adopted by the Association.

d. The county and county recorder shall be members of the Electronic Services System.

e. The county and county recorder shall maintain compliance with the operating policies, procedures, and standards adopted by Electronic Services System including but not limited to policies concerning the timely uploading of information to the statewide county land record information system, a.k.a. Iowa Land Records.

f. The county recorder shall index the associated document information and the parties (grantors and grantees) for each Groundwater Hazard Statement. The county recorder is not required to index property or legal description information for Groundwater Hazard Statements.

g. The county and county recorder shall provide 180 days notice prior to reverting to the practice of forwarding a printed version of any affirmative Groundwater Hazard Statement to the Department.

An affirmative response on a Groundwater Hazard Statement means that the Groundwater Hazard Statement indicates a well, underground storage tank, disposal site, or hazardous waste site exists on the property. Pursuant to Iowa administrative rule 561 IAC 9.2(3), Groundwater Hazard Statements on which a private burial site is the sole matter disclosed and which do not reveal the existence of a well, disposal site, underground storage tank, or hazardous waste on the property shall not be submitted to the Department.
