SEPTEMBER 11, 2007THIRTY-SEVENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, September 11, 2007 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrator, Loan Hensley, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Monson second by Batcheller to approve the Board minutes of the September 4, 2007 meeting as submitted. Carried 5-0. Copy filed.

The Board approved the separation of Austin M. Conolly, Temporary Summer Laborer, Secondary Roads Dept., effective 09/07/2007. End of temporary work. Copy filed.

The Board approved the appointment of Kristine M. Rupp, Assistant County Attorney, County Attorney Dept., $49,017/year, effective 09/17/2007. Job vacancy posted 08/16/2007. Entry salary range: $44,423-$51,374/year, based on experience. Copy filed.

The Board approved the reclassification of Jorma J. Schwedler, Correctional Officer, County Sheriff Dept., $15.46/hour, effective 09/22/2007. Per DSA contract agreement from Class 3 to Class 2. Copy filed.

The Board approved the reclassification of Daniel M. Whitlock, Correctional Officer, County Sheriff Dept., $14.87/hour, effective 09/25/2007. Per DSA contract agreement from Class 4 to Class 3. Copy filed.

The Board approved the reclassification of Jeromy A. Stroman, Correctional Officer, County Sheriff Dept., $15.46/hour, effective 09/27/2007. Per DSA contract agreement from Class 3 to Class 2. Copy filed.

Motion by Batcheller second by Boykin to approve lifting the tax suspension for Crystal Smutzler, 1620 Villa Avenue, Sioux City, Iowa, as this property has been sold. Carried 5-0.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign modification #2 to agreement #69-6114-3-17 Little Sioux Watershed, Glen Ellen Sub-watershed, between Woodbury County Board of Supervisors, Woodbury County Soil and Water Conservation District, Iowa Department of Agriculture, and the United States Department of Agriculture. Carried

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign a letter of support for the Safe Routes to School grant for Sergeant Bluff. Carried 5-0.

Motion by Boykin second by Batcheller to approve final platting for Baileys Plat, a replat of Lot 1 and part of Lot 2 of Ridgview II Subdivision, parcel GIS #8945-31-200-001, and forward them to the Zoning Commission for review and recommendations. Carried 5-0.

Motion by Boykin second by Monson to approve final platting for Kaufman Addition Subdivision, parcel GIS #8747-05-300-004, and forward them to the Zoning Commission for review and recommendations. Carried 5-0.

Motion by Monson second by Boykin to receive from the County Engineer, a petition from Pioneer Valley residents regarding lowering the speed limit to 20 mph. Carried 5-0. Copy filed.

Motion by Boykin second by Clausen to receive and approve plans for project #BROS-CO97(82)8J-97, per recommendation of the County Engineer. Carried 5-0.

Motion by Batcheller second by Monson to award the bid for the snow plow, patrol wing, and tailgate sander for Secondary Roads Dept., as follows:

Reversible snow plow: Steffen, 623 W. 7th Street, Sioux City, Iowa - Henderson 12-40-56 $7,292.00

Patrol snow wing: Steffen, 623 W. 7th Street, Sioux City, Iowa Henderson HPW-9 $8,588.00

Sander: Murphy Tractor and Equipment, 4900 Harbor Drive, Sioux City, Iowa Hiway SA-9 $5,282.00

Motion by Clausen second by Monson to accept Justice Assistance Grant funds and authorize the Chairman to sign a Justice Assistance Grant agreement. Carried 5-0. Copy filed.

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign a Resolution authorizing and supporting the submission of a grant application to the Siouxland Community Foundation on behalf of The Security Institute project. Carried 5-0.

Subject: Resolution Authorizing the Sponsorship, Preparation, and Submission of Cr ant Applications to the Statewide Transport at/on Enhancement Grant Pro grain, the Federal Recreational Trails Program. and the Statewide Recreational Trails Program administered by the Iowa Department of Transportation, and the MPG Transportation Enhancement Program Grant administered by the Siouxland Interstate Metropolitan Planning
Council Transportation Planning Division, to continue scenic beautification and the development of the trail system located on the cam/ms of Western Iowa Tech Community College.

Recommendation: The Woodbury County Board of Supervisors is requested to pass a Resolution of Public Sponsorship and authorize the Chairperson to sign a letter of commitment for the tiling of grant applications to the trail funding programs administered by the Iowa Department of Transportation and the Siouxland Interstate Metropolitan Planning Council. Western Iowa Tech Community College will be requesting funds to continue the construction of a trail system on its campus that will provide connections to the City of Sioux City trail system and linkages to the Colleges parking lot. Funds will also be requested for scenic beautification and prairie grass restoration along the trail system. This project will be Phase 3 of a multi-faceted project to provide county residents and visitors with access to the Loess Hills Arboretum and Nature Center and other natural heritage areas surrounding the campus.
Discussion: As part of the requirements for a federal investment from the transportation enhancement grant programs and federal recreational trails program, a local unit of state government must act as applicant, project sponsor and fiscal agent to coordinate the efforts of the project. Western Iowa Tech Community College is eligible to apply as the co-applicant.

Western Iowa Tech Community College has requested Woodbury County host the submission of these grant applications. No funding or staff time is required for these project submittals. Staff time will need to be committed to administer the projects if grant monies are awarded. County staff will be designated for this project when funded.

Financial Impact: There will be no County money invested in this project. Staff time will be needed as a commitment if an award is received.

Maurice Welte and Skip Perley gave a presentation on County Jail recommendations by the Correctional Study Initiative.

At 11:15 The Board recessed for five minutes and Mr. Batcheller excused himself.

Janeese Martin of the Tax Research Conference addressed the Board about the Correctional Study Initiative reccomendations.

Motion by Clausen second by Boykin, after reviewing the information provided, to deny the appeal of the decision by General Relief Services requested by K.W. Carried 4-0.

Motion by Clausen second by Boykin to go into closed session per Iowa Code Section 21.5(1)(c). Carried 4-0 on a roll-call vote.

Motion by Boykin second by Monson to go out of closed session per Iowa Code Section 21.5(1)(c). Carried 4-0 on a roll-call vote.

The Board dismissed for lunch.

Mr. Batcheller returned after the lunch recess, Mr. Boykin excused himself.

Mr. Pylelo asked for an executive session for a performance evalutation.

Motion by Clausen second by Batcheller to go into closed session per Iowa Code Section 21.5(1)(i) for a performance review. Carried 4-0 on a roll-call vote.

Motion by Batcheller second by Monson to go out of closed session per Iowa Code Section 21.5(1)(i). Carried 4-0 on a roll-call vote.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board adjourned the regular meeting until September 18, 2007.
