SEPTEMBER 18, 2007THIRTY-EIGHTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, September 18, 2007 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrator, Loan Hensley, Assistant County Attorney, and Victoria Ritz, Deputy/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Boykin second by Monson to approve the Board minutes of the September 11, 2007 meeting as submitted. Carried 5-0. Copy filed.

Motion by Clausen second by Boykin to approve the Board minutes of the September 14, 2007 special meeting as submitted. Carried 4-0, Batcheller abstained. Copy filed.

The Board approved the reclassification of Amy L. Ellis, Assistant County Attorney, County Attorney Dept., $56,082/year, effective 10/02/2007. Per AFSCME Assistant Attorney contract agreement from Step 5 to Step 6.

The Board approved the reclassification of Elven C. Merritt, Jr., Temporary Shredder, Social Services Dept., $6.20/hour, effective 08/29/2007. Compliance with Iowa minimum wage, with $21.00 retro pay.

Motion by Boykin second by Batcheller to approve and authorize the Chairman to sign a Resolution setting the public hearing and property sale date for parcel #278160 (3046 Melrose Avenue, Sioux City, Iowa). Carried 5-0.

NOTICE OF PROPERTY SALE
Parcel #278160

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

Lot 14 in Block 7 of Kelly Park Addition, City of Sioux City, Woodbury County, IA
(3046 Melrose Ave.)

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on the 2nd Day of October, 2007 at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury
County Courthouse.

2. That said Board proposes to sell the said parcel of real estate at a public auction to be held on the 2nd Day of October, 2007, immediately following the closing of the public hearing.

3. That said Board proposes to sell the said real estate to the highest bidder at or above a total minimum bid of $ 100.00 plus recording fees.

4. That this resolution, preceded by the caption 'Notice of Property Sale' and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

Motion by Monson second by Clausen to approve lifting the tax suspension for Irene Blackford, 2032 Mc Kinley Street, Sioux City, Iowa, as this person no longer wants her taxes suspended. Carried 5-0.

Motion by Monson second by Clausen to receive the Commission of Veterans Affairs Quarterly Assistance Report, for period ending June 30, 2007. Carried 5-0. Copy filed.

The Board discussed the possible rental of farm bins to Mr. Frank Welte, for $1,000 plus the electricity.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign a lease agreement with Mr. Welte. Motion withdrawn.

Motion by Clausen second by Monson to defer the lease agreement until next week. Carried 5-0.

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign a Resolution to end the tax abatement given to the Siouxland Community Christian School. Carried 5-0.

RESOLUTION ENDING ABATEMENT OF TAXES

WHEREAS, Siouxland Community Christian School is the titleholder of real estate Parcel #561285 located in Woodbury County, Iowa and legally described as follows:

Auditors Plat St. Vincent Sub-Division South West 19-89-47 West 383.9 Feet Lot 24 LL-SC Comm 89-47

WHEREAS, taxes were abated on the above stated parcel for the 2004/05, 2005/06, and 2006/07 tax year. Future taxes that
may be levied were also abated on this parcel for so long as Siouxland Community Christian School owned this parcel.

WHEREAS, it has come to the attention of the Board of Supervisors that Iowa Code section 427.8 limits the Boards ability to abate taxes to prior years and to the current year. It does not give the Board the authority to abate taxes for future years.

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby ends the tax abatement granted to Siouxland Community Christian School and hereby directs the Woodbury County Treasurer to assess and collect all current future taxes owed to the above stated parcel. Siouxland Community Christian School may petition for a tax suspension
or tax abatement pursuant to Iowa Code section 427.8.

SO RESOLVED this 18th day of September, 2007.

Donald Klynsma, Siouxland Community Christian School, addressed the Board with concerns on ending the tax abatement.
He was advised by Loan Hensley, Assistant County Attorney, of his future options.

Patty Erickson-Puttmann presented the Board with contract #MOU-2008-CO97 between Iowa Department of Public Health
and Woodbury County, providing substance abuse prevention, and services related to education, prevention, referral and
post-treatment services.

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign contract #MOU-2008-CO97. Carried
5-0. :Copy filed.

Bid letting was held at 10:20 a.m. for propane for the 2007-2008 season.

The bids were as follows:

Johnson Propane and Heating, 960 1st Street, Battle Creek, IA - $1.55/Gallon
Ferrell Gas, 5208 Dakota Avenue, South Sioux City, NE - $1.50/Gallon
Sapp Bros. Petroleum, Incorporated, 129 S. Steuben Street, Sioux City, IA - $1.495/Gallon
Rodney Propane, 2902 Moville Blacktop, Hornick, IA - $1.50/Gallon

There were no other bids.

Motion by Batcheller second by Monson award the bid to the low bidder, Sapp Bros. Petroleum, Incorporated. Carried 5-0. Copy filed.

The Board discussed a Crisis Intervention Team with social Services Director Patty Erickson-Puttmann, Pat McCormick, and Jim Rixner.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.

Bob Knowler, County Treasurer, updated the Board with CD status.

Motion by Clausen second by Batcheller to go into closed session per Iowa Code Section 21.5 (1) (i), for a performance evaluation. Carried 5-0 on a roll-call vote.

Motion by Monson second by Boykin to go out of closed session per Iowa Code Section 21.5 (1) (i). Carried 5-0 on a
roll-call vote.

The Board adjourned the regular meeting until September 25, 2007.
