The Board of Supervisors met on Tuesday, April 29, 2008 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson; and Walish. Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney/Board Legal Counsel, and Patrick F. Gill, Auditor/Clerk to the Board.

Motion by Monson second by Clausen to approve the Board minutes of the April 15, 2008 meeting as submitted. Carried 5-0. Copy filed.

The Board approved an end of probation salary increase for Dagmar L. Kopacs-Radloff, Case Manager, Social Services Dept., $36,580/year effective 03/04/2008. End of probation salary increase. Retro pay = $119.72. Copy filed.

The Board discussed a $7,500.00 ThinkSafe, Incorporated safety grant with Gloria Mollet, Human Resources Administrative Assistant. The grant would be used for CPR, first aid, Automated External Defibrillators, and associated training.

Motion by Boykin second by Monson to approve submitting an application for the ThinkSafe grant. Carried 5-0.

The Board reviewed a new Woodbury County Inclement Weather Policy with J. D. Pellersels.

Motion by Boykin second by Batcheller to seek an opinion of the countys collective bargaining representative as to any conflict with bargaining agreements. Carried 5-0.

The Board discussed possible adjustments for Wage Plan personnel with J. D. Pellersels.

Motion by Batcheller second by Monson to approve an additional personal leave day per year for Wage Plan employees, as was negotiated for AFSCME and CWA contracts. Carried 5-0.

Motion by Boykin second by Monson to approve changing the sick leave payoff at retirement, from $2,000 to $3,000 for Wage Plan employees, as was negotiated with all bargaining units. Carried 4-1, Clausen opposed.

A public hearing and sale was held at 10:15 a.m. for property parcel #228015 (3016 West 15th Street). The Chairman called on anyone wishing to be heard.

Motion by Batcheller second by Monson to close the hearing. Carried 5-0.

Dave Watterson bid $100.00.

RESOLUTION NO. 10,398
WEED DESTRUCTION ORDER

WHEREAS, it is the responsibility of each of Iowa Countys Board of Supervisors to enforce the provisions of Chapter 317 of the Code of Iowa as amended with regard to the destruction of weeds, and

WHEREAS, under Chapter 317 of the Code of Iowa as amended each county Board of Supervisors must prescribe and order a program of weed destruction to be followed by landowners, tenants, and other persons in possession or control of land, and

WHEREAS, it has been determined by the Woodbury County Board of Supervisors that a program of weed destruction for the year 2008 is necessary,

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa that each landowner, tenant or other person in possession or control of private land shall on or before the dates stated below, destroy the below-listed noxious weeds on their land by spraying them with a suitable herbicide in a strength sufficient to kill such weeds.

1. May 25, 2008 - for musk, thistle, sow thistle, bull thistle, leafy spurge, perennial pepper grass, sour dock perennial, smooth dock perennial, and sheep sorrel perennial.

2. June 1, 2008 - for Canada thistle, Russian knapweed, buckhorn perennial, wild mustard annual, horse nettle, and teasel biennial.

3. June 8, 2008 - for field bindweed, wild carrot biennial, and quack grass.

4. June 15, 2008 - for butterprint annual, puncture vine annual, and cocklebur annual.

5. July 13, 2008 - for wild sunflower annual and poison hemlock.

6. October 2, 2008 - all thistles in the rosette stage.

BE IT FURTHER RESOLVED AND ORDERED that all weeds on county trunk and local roads and between the fence lines of such roads, whether they be noxious weeds or other weeds, shall be cut or otherwise destroyed, to prevent seed production, by the owner of the land adjoining the road on or before June 22, 2008.

BE IT FURTHER RESOLVED that weeds that are not destroyed in compliance with the above order may be destroyed by the Weed Commissioner, and the costs of destruction by the Weed Commissioner, including the cost of serving notice, plus a penalty of twenty-five percent of total costs shall be assessed against the property upon which the weeds were destroyed, in the case of private lands, or against the adjoining land, in the case of weeds on county roads. Landowners are to contact Weed Commissioner and notify him if there are areas that should not be sprayed with herbicides.

Linda Drey, Siouxland District Health, addressed the Board on amending the fiscal year 2008 Local Public Health Services contract.

Motion by Boykin second by Monson to approve amending the fiscal year 2008 Local Public Health Services contract to include the addition of three new activities (agency evaluation/quality improvement, workforce development and community partnerships), and two alternative plans (skilled nursing/home health activities and infant/childhood immunizations). Carried 5-0. Copy filed.

The Board discussed a letter of agreement for the Prairie Hills Detention Facility water source project with Mark Elgert, Building Services Director.

Motion by Batcheller second by Monson to approve and authorize the Chairman to sign a letter of agreement with DeWild, Grant, Reckert, and Associates for water facility consulting services at the Prairie Hills Detention Facility. Carried 5-0. Copy filed.

Motion by Boykin second by Clausen to approve and authorize the Chairman to sign a Resolution establishing the Sioux City Sue Local Foods Network Program. Carried 5-0.

RESOLUTION NO. 10,399

A RESOLUTION ESTABLISHING THE
SIOUX CITY SUE LOCAL FOODS NETWORK PROGRAM

WHEREAS, Woodbury County approved acquisition of a United States Trademark and Logo using the name Sioux City Sue on July 3, 2007, as a community owned brand for local and organic food products, and to promote the sale of locally produced organic and natural foods.

WHEREAS, Woodbury County desires to promote the sale of locally produced food products under the Sioux City Sue brand throughout the Siouxland Region and within a 100-mile radius of the Woodbury County Courthouse, located at 620 Douglas Street, Sioux City, Iowa.

WHEREAS, it is desired, as a means of economic development, to increase income of farmers in the region by providing markets and opportunities for their products.

WHEREAS, Woodbury County has determined that local restaurants provide a ready market for farm products produced within the region, and provide an opportunity to create community identity and awareness through the introduction of locally produced food at these establishments; providing the consumer with a quality and healthy food option that also benefits our local farmers and the economy in the region.

WHEREAS, the Department of Rural Economic Development for Woodbury County has prepared documentation that grants a Trademark License to Firehouse Market, located at 1211 5th Street, Sioux City, Iowa to act as the broker and distributor of locally produced food under a Trademark Sublicense to restaurants within the Siouxland Region and within 100 miles of the Woodbury County Courthouse. The Trademark Sublicense grants participating restaurants the ability to use the Sioux City Sue logo in connection with the sale of locally produced food products at their establishments.

WHEREAS, Woodbury County desires to establish a program entitled the Sioux City Sue Local Foods Network to promote the legitimate economic development objectives as stated above.

IT IS HEREBY RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That it hereby authorizes the establishment and promotion of the Sioux City Sue Local Foods Network Program.

2. That the Trademark License and Trademark Sublicense Agreements be negotiated between the respective parties to those agreements in a way that will protect the Sioux City Sue Trademark and promote the objectives of the Sioux City Sue Local Foods Network Program.

The Board discussed a cost allocation services agreement between Woodbury County and Cost Advisory Services Inc. and Maximus, for fiscal years 2007, 2008, and 2009.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign the agreement with Cost Advisory Services Inc. for the amount of $6,475.00 for each year. Carried 5-0. Copy filed.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.

Sheriff Glenn Parrett and Chief Deputy Greg Logan discussed an early retirement proposal and a law enforcement agreement with the Board.

The Board adjourned the regular meeting until May 6, 2008.
