FEBRUARY 24, 2009NINTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, February 24, 2009 at 9:00 a.m. Board members present were Boykin, Clausen, Monson, Smith, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney/Board Legal Counsel, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Board of Supervisors meeting was called to order.

Motion by Monson second by Walish to approve the Board minutes of the February 17, 2009 meeting as submitted. Carried 5-0. Copy filed.

The Board approved the appointment of E. Dean Neal, Temporary Clerk, County Auditor/Recorder Dept., $13.79/hour, effective 02/18/2009. Not to exceed 120 days. Copy filed.

The Board approved the reclassification of Dustin D. DeGroot, Civilian Jailer, County Sheriff Dept., $16.12/hour, effective 03/15/2009. Per DSDOA contract agreement, from Class 3 to Class 2. Copy filed.

Motion by Monson second by Boykin to approve and receive for signatures, an eight month Class C liquor license for Anthon Golf Course, 2236 Highway 31 South, Anthon, IA, effective 03/01/2009. License includes outdoor service and Sunday sales. Carried 5-0. Copy filed.

Motion by Boykin second by Walish to approve tax abatement for:

Parcel #884603100901, Mary Stultz - Building on leased land (mobile home).
For the tax balance of $353.00, plus interest.

Carried 5-0.

Motion by Boykin second by Smith to approve the bid submitted by Midwestern Culvert, Ltd., Ankeny, IA in the amount of $44,874.26 for maintenance culvert pipe contract #CP-2009, per recommendation of Mark Nahra, County Engineer. Carried 5-0. Copy filed.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign a Resolution authorizing the County Engineer, on behalf of the Board of Supervisors, to execute certification of completion of work and authorize final acceptance thereof, in connection with all Farm to Market and Federal Aid construction projects in Woodbury County. Carried 5-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that Mark J. Nahra, the County
Engineer of Woodbury County, Iowa, be and is hereby designated, authorized, and empowered on behalf of the Board of Supervisors of said County to execute the certification of completion of work and final acceptance thereof in accordance with plans and specifications in connection with all Farm-to-Market and federal or state aid construction projects in this county.

Motion by Boykin second by Walish to approve and authorize the Chairman to sign a Cooperative Fiber Optic Sharing Agreement with Iowa Department of Transportation, per recommendation of Emergency Services Director Gary Brown. Carried 5-0. Copy filed.

Motion by Walish second by Boykin to approve and authorize the Chairman to sign a Cooperative Fiber Optic Sharing Agreement with Long Lines LLC, per recommendation of Emergency Services Director Gary Brown. Carried 5-0. Copy filed.

Motion by Monson second by Boykin to approve and authorize the Chairman to sign a lease agreement for fiber optic with Fiber Comm, per recommendation of Emergency Services Director Gary Brown. Carried 5-0. Copy filed.

Motion by Boykin second by Walish to approve and authorize the Chairman to sign a lease agreement with City/County law enforcement of South Sioux City, NE and Dakota City, NE for the Homer Star Comm Tower, per recommendation of Emergency Services Director Gary Brown. Carried 5-0. Copy filed.

The Board discussed the Elected Officials salary recommendations made by the Compensation Commission, whose recommendations were as follows:

Board of Supervisors 0% Increase
County Attorney 3.2% Increase
County Auditor/Recorder 3.2% Increase
County Sheriff 3.2% Increase
County Treasurer 5.3% Increase

Motion by Walish second by Smith to receive the compensation board schedule. Carried 4-1; Boykin opposed.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board adjourned the regular meeting until March 3, 2009.
