MARCH 2, 2010 — NINTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, March 2, 2010 at 9:00 a.m. Board members present were Boykin, Clausen,

Monson, Smith, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

The meeting was called to order.

Motion by Smith second by Monson to go into executive session under section 21.5(1)(c) to deal with matters needing immediate consideration. Carried 5-0 on a roll call vote.

Motion by Smith second by Clausen to go out of executive session. Carried 5-0 on a roll call vote.

Motion by Walish second by Monson to approve recommendation made by legal counsel in the previous executive session. Carried 5-0.

Motion by Clausen second by Walish to approve the Board minutes of the February 23, 2010 meeting as submitted. Carried 5-0. Copy filed.

The Board approved the promotion of Eva L. Lambert, Lead Custodian, Building Services Dept., $15.34/hour, effective 03/03/2010. Per in-house vacancy 02/10/2010. Entry salary per AFSCME Courthouse contract agreement, from Grade 1, Step 5 to Grade 2, Step 5. Copy filed.

The Board approved the separation of Elizabeth A. Schermerhorn, Assistant Director, Juvenile Detention Dept., effective 03/28/2010. Resignation. Copy filed.

The Board approved the separation of John B. Priestley, Director, Veteran Affairs, effective 03/31/2010. Retirement. Copy filed.

Motion by Clausen second by Monson to approve and authorize the Chairman to sign an "Authorization to Initiate Hiring Process" form for:

Assistant Director, Juvenile Detention Dept. Entry level: Wage Plan $47,299/year.

Director, Veteran Affairs Dept. Entry level: Wage Plan $49,427/year.

Assistant Juvenile Attorney, County Attorney Dept. Entry level: AFSCME Attorney salary range, $47,931-$55,431/year.

Custodian, Building Services Dept. Entry level: AFSCME Courthouse, Grade 1, Step 1 $11.65/hour.

Bid letting was held at 10:25 a.m. for corrugated metal pipe culverts for Secondary Roads Dept. The bids were as follows:

Contech Construction Products, Johnston, IA $56,968.24

Iowa Culverts, Low Moor, IA $60,117.80

Johnston Fargo Culvert, Inc., St. Paul, MN $79,526.60

Metal Culverts, Inc., Jefferson City, MO $60,652.70

Midwestern Culverts, Ltd., Ankeny, IA $62,438.52

Northern Iowa Construction Products, Cedar Falls, IA $63,617.50

Motion by Clausen second by Monson to receive the bids and submit to the county engineer for review and recommendation. Carried 5-0. Copy filed.

The Board discussed the usage of attaching employee paid breaks to unpaid lunch periods, with Human Resources Director, J. D. Pellersels.

There was a consensus that the practice of attaching paid breaks to the unpaid lunch will not be allowed under the implementation of the new payroll accounting system.

Motion by Walish second by Smith to approve retiring employee Le T. Olsen, Siouxland District Health Dept., to remain on the County's health insurance plan, for himself and his spouse, at his own expense. Carried 5-0.

Motion by Walish second by Monson to approve and receive for signatures, a Resolution thanking and commending John B. Priestley, for his years of service as a Woodbury County employee. Carried 5-0.

RESOLUTION NO. 10,638

A RESOLUTION THANKING AND COMMENDING

JOHN B. PRIESTLEY

FOR HIS SERVICE TO WOODBURY COUNTY

WHEREAS, John B. Priestley has capably served Woodbury County as an employee of the Woodbury County Veteran Affair's Office for 17 years from December 14, 1992 to March 31, 2010; and

WHEREAS, the service given by John B. Priestley as a Woodbury County employee, has been characterized by his dedication to the best interests of the citizens of Woodbury County; and

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA that the undersigned members of this Board thanks and commends John B. Priestley for his years of service to Woodbury County; and

BE IT FURTHER RESOLVED that it is the wish of all those signing below that the future hold only the best for this very deserving person, John B. Priestley.

BE IT SO RESOLVED this 2nd day of March, 2010.

Motion by Monson second by Walish to approve lifting the tax suspension for Dottie Jean Hardgraves, 412 Cook Street, Sioux City, Iowa, as Dottie is deceased. Carried 5-0.

Motion by Walish second by Clausen to approve and authorize the Chairman to sign a Resolution setting the public hearing and sale date for property parcel #367785 (2109 Boies Street) for 03/16/2010. Carried 5-0.

RESOLUTION NO. 10,639

NOTICE OF PROPERTY SALE

Parcels #367785

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

Lot Five(5), Block Five(5), In North Riverside Second(2nd) Addition, City of

Sioux City In County of Woodbury and State of Iowa

(2109 Boies Street)

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on

the 16th Day of March, 2010 at 10:15 o'clock a.m. in the meeting

room of the Board of Supervisors on the first floor of the Woodbury

County Courthouse.

2. That said Board proposes to sell the said parcel of real estate at a

public auction to be held on the 16th Day of March, 2010, immediately

following the closing of the public hearing.

3. That said Board proposes to sell the said real estate to the highest

bidder at or above a total minimum bid of $600.00 plus recording fees.

4. That this resolution, preceded by the caption "Notice of Property Sale"

and except for this subparagraph 4 be published as notice of the

aforesaid proposal, hearing and sale.

The Board discussed the appointment of an interim Homeland Security Director.

Motion by Monson second by Walish to approve the appointment of Eugene D. Nitzschke as interim Homeland Security Director. Carried 5-0.

Motion by Walish second by Monson to approve the estimate of $13,696.16 from Kingsbury Electronic Systems, for the purchase of an LEC Courtroom video system. Carried 5-0.

The Board discussed economic development with representatives from the City of Correctionville.

Motion by Walish second by Smith to approve for letting and authorize signature of title sheet for project

#JFM-CO97(110)—6R-97, HMA resurfacing on K-45 (MPO Jobs/stimulus project), per recommendation of County

Engineer Mark Nahra. Carried 5-0.

Motion by Smith second by Walish to approve for letting and authorize signature of title sheet for project

#JFM-CO97(111)—6R-97, pavement replacement on K-42 (RPA Jobs/stimulus project), per recommendation of the

County Engineer. Carried 5-0.

The Board discussed the fiscal year 2011 County budget.

Motion by Clausen second by Walish to reduce the County Attorney's budget by $70,000.00. Carried 5-0.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board adjourned the regular meeting until March 9, 2010.
