JANUARY 15, 2013 — THIRD MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, January 15, 2013 at 9:00 a.m.  Board members present were Clausen, Boykin, Tripp, Monson and Smith.  Staff members present were Karen James, Board Administrative Coordinator, Dennis Butler, Finance/Operations Controller, Joshua Widman, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board. 
      
The Claims were approved as presented.  Copy filed.

The meeting was called to order.

Motion by Monson second by Tripp to approve the minutes of the 1/8/2013 Board meeting.  Carried 5-0.  Copy filed.

Motion by Boykin second by Smith to approve the promotion of Michael Wingert, Appointed Deputy Lieutenant, County Sheriff Dept., $67,393/year, effective 01/02/2013, the appointment of Matthew Maynard, Temporary Equipment Operator, Secondary Roads Dept., $19.90/hour, effective 01/17/2013, not to exceed 120 days, the appointment of Gary Worrell, Temporary Equipment Operator, Secondary Roads Dept., $19.90/hour, effective 01/17/2013, not to exceed 120 days, the reclassification of Karla Polley, Clerk II, County Auditor/Recorder’s Dept., $18.44/hour, effective 01/30/2013, per AFSCME Courthouse contract agreement, from Grade 3, Step 4, to Grade 3, Step 5, the separation of Gregory Logan, Deputy Sergeant, County Sheriff Dept., effective 01/31/2013, retirement.   Carried 4-0; Tripp abstained.  Copy filed.

Motion by Monson second by Smith to approve and authorize the Chairperson to sign a Resolution authorizing tax abatement for Dana Allner, for a mobile home that has been removed, and no longer assessed, parcel #874506300901, taxes for 2012-2013 totaling $60.00.  Carried 5-0.

WHEREAS, the abovestated property has taxes payable Including special assessments and the parcel is owned by Dana Allner, and

WHEREAS, these taxes are uncollectable or impractical to pursue collection through personal judgment or tax sale

WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes owing on the above parcel according to Code of Iowa, 445.16 for the taxes owed and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

Motion by Boykin second by Smith to receive the Commission of Veteran Affairs quarterly report for the quarter ending 12/31/2012.  Carried 5-0.  Copy filed.

Motion by Monson second by Smith to approve and receive for signatures, a Resolution thanking and commending Gregory Logan for his years of service to Woodbury County.  Carried 5-0.

RESOLUTION #11,002
RESOLUTION THANKING AND COMMENDING

WHEREAS, Gregory Logan has capably served Woodbury County as an employee of the Woodbury County Sheriff’s Office  for 36 years from March 21, 1977 to January 31, 2013; and

WHEREAS, the service given by Gregory Logan as a Woodbury County employee, has been characterized by his dedication to the best interests of the citizens of Woodbury County; and

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA that the undersigned members of this Board thanks and commends Gregory Logan  for his years of service to Woodbury County; and

BE IT FURTHER RESOLVED that it is the wish of all those signing below that the future hold only the best for this very deserving person, Gregory Logan.

BE IT SO RESOLVED this 15th  day of January 2013.

Motion by Tripp second by Boykin to authorize the Chairman to sign a lease agreement for the County Farm, awarded to Tony  and Kim Kohn, doing business as Kohn Farms, 4852 210th Street, Cushing, Iowa for the amount of $455.00/acre.  Carried 5-0.  Copy filed.

The Board discussed with Juvenile Detention Director Mark Olsen, the possible use by Siouxland Mental Health of  an empty classroom on the fourth floor of the Trosper-Hoyt Bldg.

Motion by Smith second by Monson to approve the use of the fourth floor classroom at Trosper-Hoyt by Siouxland Mental Health.  Carried 5-0.

Motion by Tripp second by Boykin to award the bid for project #LB11(1)—73-97 to Nelson & Rock Contracting, Onawa, IA for the amount of  $38,454.00, per recommendation of County Engineer Mark Nahra.  Carried 5-0.  Copy filed.

Motion by Smith second by Boykin to award the bid for project #LB11(2)—73-97 to Nelson & Rock Contracting, Onawa, IA for the amount of  $38,855.00, per recommendation of County Engineer Mark Nahra.  Carried 5-0.  Copy filed.

The Chairperson asked if there were any individuals or groups wishing to make a presentation of items not on the agenda, or Supervisors concerns.
 
Motion by Smith second by Boykin to go into Closed Session per Iowa Code Section 21.5 (1) (c).  Carried 4-0 on a roll-call vote; Mr. Tripp recused himself.
Motion by Monson second by Smith to go out of Closed Session per Iowa Code Section 21.5 (1) (c).  Carried 4-0 on a roll-call vote.
Motion by Monson second by Boykin to approve the attorney’s recommendation to settle cases previously discussed.  Carried 4-0; Tripp abstained.

The Board discussed the fiscal year 2013 County budget.
Motion by Monson second by Boykin to reduce the County Attorney (General Basic) Administration budget by $75,000.00.  Carried 5-0.

Motion by Monson second by Tripp to receive the County Attorney (General Basic) Administration budget as amended.  Carried 5-0.

Motion by Smith second by Monson to receive the County Attorney (General Basic) Edward Bryne Grant budget as submitted.  Carried 5-0.

Motion by Boykin second by Monson to receive the County Attorney (General Basic) Juvenile Attorney budget as submitted.  Carried 5-0.

Motion by Monson second by Smith to receive the County Attorney (General Basic) Jury and Witness Fees-General Supplemental budget reduced by $6,725.00.  Carried 5-0.

Motion by Tripp second by Boykin to receive the County Treasurer (General Basic) Motor Vehicle budget as submitted. Carried 5-0.

Motion by Smith second by Monson to receive the County Treasurer (General Basic) Tax Department budget as submitted.  Carried 5-0.

Motion by Monson second by Boykin to receive the WCICC Information (General Basic) budget as increased by $22,000.00.  Carried 5-0.

Motion by Boykin second by Monson to receive the General Relief (General Basic) Assistance budget as submitted.  Carried 5-0.

Motion by Smith second by Monson to receive the County Auditor (General Basic) Recorder/Vital Stats budget as submitted.  Carried 5-0.
