JANUARY 17, 2012 — THIRD MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, January 17, 2012 at 10:00 a.m.  Board members present were Boykin, Clausen, Monson, Smith, and Tripp.  Staff members present were Heather Satterwhite, Public Bidder, Joshua Widman, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented.  Copy filed.

The meeting was called to order.

Motion by Clausen second by Boykin to approve the minutes of the 01/10/2012 Board meeting.  Carried 5-0.  Copy filed.

The Board approved the reclassification of Izzlee Mothershead, Custodian, Building Services Dept., effective 01-30-12, $15.77/hour, 8%=$1.20/hr.  Per AFSCME Courthouse Contract agreement, from Grade 1/Step 4 to Grade 1/Step 5.  Copy filed.

Motion by Boykin second by Clausen to approve the County being Fiscal Agent for the FY 09 SHSP Partial Grant Extension Region III Homeland Security Board.  Carried 5-0. 

Motion by Tripp second by Clausen to approve the County being Fiscal Agent for the FY 08 Allocation for Hazmat.  Carried 5-0.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign a Resolution for Purchase of Climbing Hill Property.  Carried 5-0.

RESOLUTION # 10,856
RESOLUTION FOR PURCHASE OF PROPERTY
IN CLIMBING HILL, IOWA

WHEREAS, the Woodbury County Board of Supervisors believes that purchasing the property herein described furthers the public interest; and

WHEREAS, the Woodbury Central Community School District, after holding a public hearing on the proposal, has agreed to sell the property herein described to Woodbury County, Iowa for the amount of eight thousand dollars ($8,000.00); and

WHEREAS, the Woodbury County Board of Supervisors agrees to pay Woodbury Central Community School District’s attorney’s fees related to this transaction in the amount of five hundred and twenty-five dollars ($525.00);
      
NOW THEREFORE, BE IT RESOLVED that the following described real estate shall be purchased from the Woodbury Central Community School District for the amount of eight thousand dollars ($8,000.00). To wit:
      
Parcel #1:

Beginning at a point on the north line of Section Twenty-one (21), Township Eighty-seven (87), Range Forty-five (45), West of the Fifth P.M., 870 feet West of the corner of Sections Fifteen (15), Sixteen (16), Twenty-one (21), and Twenty-two (22) thence West 171.3 feet along the north line of Section Twenty-one (21) to the center line of the Sioux City - Danbury Road otherwise known as the Sioux City and Elk Creek Road thence North 63°59' West along center line of said road 450.6 feet; thence North 26° 01' East perpendicular to said road 417.9 feet; thence South 63° 59' and parallel to said road 436.8 feet; thence due South 381.45 feet to the point of beginning. Said Tract to contain five acres more or less.
      
Parcel #2:

A tract of land in Section Sixteen (16), Township Eighty-seven (87) North, Range Forty-five (45), West of the 5th P.M. more particularly described as follows: Beginning at a point 870 feet West of the Southeast corner of Section Sixteen (16), Township Eighty-seven (87) North, Range Forty-five (45), West of the 5th P.M.; thence due North and perpendicular to the south line of Section Sixteen (16) 381.45 feet; thence in a southeasterly direction and parallel to the center of the Sioux City and Elk Creek Road a distance of 132.7 feet; thence due South and parallel to the east line of Section Sixteen (16) a distance of 329 feet; thence due West along the south line of Section Sixteen (16) a distance of 123.4 feet to the point of beginning. Said tract to contain one (1) acre more or less.
      
Parcel #3:

A small parcel of land in the Northeast Quarter of the Northeast Quarter (NE¼NE¼), Section Twenty-one (21), Township Eighty-seven (87), Range Forty-Five (45), Woodbury County, Iowa, described as follows: Beginning at the point of intersection of the north line of said Section Twenty-one (21) with the center line of the Sioux City and Elk Creek Road, the same being the point 1,041.1 feet West of the Northeast corner of said Section, running thence due East on the North line of said Section for a distance of 171.3 feet to the east line of the Public School property; thence due South on said east line produced South a distance of 70 feet, more or less, to the center line of said Sioux City and Elk Creek Road, thence northwesterly along said center line to the point of beginning, containing 0.14 acres, more or less.

Now and included in and forming a part of Woodbury County, Iowa.
BE IT RESOLVED that attorney Patrick Phipps of Moville, Iowa shall be paid five hundred twenty-five ($525.00) for the services rendered to Woodbury Central Community School District in this transaction.

BE IT RESOLVED that Woodbury County shall pay the costs of recording the transfer documents for this transaction (if any).

BE IT FURTHER RESOLVED the Woodbury County Board of Supervisors acknowledges and assumes the well lease agreement between the Woodbury Central Community School District and the Climbing Hill West Water Association dated September 15, 2003 and recorded in the Woodbury County Recorder’s Office at Roll 616, Image 1674.

Motion by Clausen second by Tripp to approve and authorize the Chairman to sign a Resolution approving a petition for suspension of taxes for Gregory Vitto, 200 Main St, Pierson, parcel #894312205008.  Failed 0-5.

Motion by Clausen second by Tripp to approve and authorize the Chairman to sign a Resolution setting the public hearing and sale date for Parcel #624765, 11 Water St., Oto.  Carried 5-0.

1.  That a public hearing on the aforesaid proposal shall be held on
the  31st  Day of January, 2012 at 10:15 o’clock a.m. in the meeting
room of the Board of Supervisors on the first floor of the Woodbury
County Courthouse.

2.  That said Board proposes to sell the said parcel of real estate at a
public auction to be held on the 31st Day of January,  2012,  immediately        
following the closing of the public hearing.
     
That said Board proposes to sell the said real estate to the highest
bidder at or above a total minimum bid of $332.00 plus recording fees.

Motion by Boykin second by Clausen to approve setting the public hearing date for a Budget Amendment #2 for FY 2012 on February 7, 2012 at 10:15 a.m.  Carried 5-0.

A public hearing was held at 10:15 a.m. for the sale of property parcel #327330 & #32745 (3250 13th St & 3250 ½ 13th St, Sioux City). 

The Chairman called on anyone wishing to be heard. 
      
Motion by Clausen second by Boykin to close the hearing.   Carried 5-0.
 
Motion by Boykin second by Tripp to approve and authorize the Chairman to sign a Resolution for the sale of this parcel to Sewalson for the minimum bid of $231.00 plus recording fees, for real estate parcel #327330 & #32745 (3250 13th St & 3250 ½ 13th St, Sioux City, Sioux City).  Carried 5-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes.  Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

Presentation of District Technician 2011 Report for the Woodbury County Soil and Water Conservation District.

Motion by Boykin second by Clausen to receive the District Technician 2011 Report by WDSWCD.  Carried 5-0.

Motion by Clausen second by Monson to approve Medical Examiner Contract.  Carried 5-0. Copy Filed.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign a Permit to Work in the County Right of Way by Fred Johnson, per recommendation of County Engineer Mark Nahra.  Carried 5-0.  Copy filed.

Motion by Tripp second by Monson to approve and authorize the Chairman to sign a Permit to Work in the County Right of Way by Lee Westergard, per recommendation of County Engineer Mark Nahra.  Carried 5-0.  Copy filed.

Motion by Boykin second by Clausen to approve scope of work submitted by McClure Engineering for an informational public meeting regarding Liberty Park Development and the Port Neal Interchange.  Carried 5-0.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda, or Supervisors concerns.

Andy Brouillette, 102 Liberty Lane, Segeant Bluff, Mike Patterson, 707 6th, Sloan, Laurence Reynolds, Dan Lee, 1405 260th St., Salix, Caryl Powell, 2430 Benton, Salix, Craig Bock, Salix, Curt Koenig, Sloan, and Brian Rosener, 3030 Glen Allen Rd. presented their concerns to the Board regarding the Liberty Park Development and the Port Neal Interchange.

The Board discussed the proposed fiscal year 2013 County budget with Dennis Butler, County Budget/Tax Analyst.

Motion by Boykin second by Monson to receive the Conservation Administration budget as submitted.  Carried 5-0.

Motion by Boykin second by Clausen to receive the Conservation Parks budget as submitted.  Carried 5-0.

Motion by Clausen second by Boykin to receive the Conservation Naturalist budget as submitted.  Carried 5-0.

Motion by Boykin second by Monson to receive the Conservation Nature Center budget as submitted. Carried 5-0.

Motion by Clausen second by Tripp to receive the Conservation 257-Nature Center (non-tax funds),the Conservation 266-REAP (non-tax funds) and the Conservation 667-Conservation Reserve (non-tax funds) budget as submitted.  Carried 5-0.

Motion by Monson second by Boykin to receive the Communication Center General Basic budget as submitted.  Carried 5-0.

Motion by Boykin second by Monson to receive the County Fair General Basic budget reduced by $5,988.00.  Carried 5-0.

Motion by Boykin second by Monson to receive the Veteran Affairs Administration budget as submitted.  Carried 5-0.

Motion by Tripp second by Monson to receive the Veteran Affairs IDVA Grant budget as submitted. Carried 5-0.

Motion by Boykin second by Monson to receive the Council on Sexual Assault request, the Meals on Wheels request, the Senior Aides – WCCAA request , the Siouxland Regional Transit request, the Siouxland Senior Center request and the Moville Senior Center request reduced to last fiscal year’s funding level.  Carried 5-0.
 
Motion by Boykin second by Monson to receive the County Treasurer Motor Vehicle budget as requested.  Carried 5-0.
 
Motion by Clausen second by Monson to receive the County Treasurer Tax Department budget as requested.  Carried 5-0.

Motion by Monson second by Boykin to receive the Building Services-Courthouse budget reduced by $25,000.00.  Carried 5-0.

Motion by Boykin second by Monson to receive the Building Services-LEC budget reduced by $25,000.00.  Carried 5-0.

Motion by Boykin second by Tripp to receive the Building Services-Trosper-Hoyt budget reduced by $7,500.00.  Carried 5-0.

Motion by Monson second by Boykin to receive the Building Services-Prairie Hills Facility budget as submitted.  Carried 5-0.

Motion by Clausen second by Boykin to receive the Building Services-Old Eagles Building budget reduced by $250.00.  Carried 5-0.

The Board adjourned the regular meeting until January 24, 2012.
