JANUARY 08, 2013 — SECOND MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, January 08, 2013 at 9:00 a.m.  Board members present were Clausen, Boykin, Tripp, Monson and Smith.  Staff members present were Karen James, Board Administrative Coordinator, Dennis Butler, Finance/Operations Controller, Joshua Widman, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board. 
      
The Claims were approved as presented.  Copy filed.

The meeting was called to order.

Motion by Tripp second by Monson to approve the minutes of the 1/2/2013 Board meeting.  Carried 5-0.  Copy filed.

The Board approved the salary of Larry Clausen, from Board Member to Board Chairman, Board of Supervisors Dept., $37,568/year, effective 01/02/2013, the salary of Jaclyn D. RESOLUTION APPROVING ABATEMENT OF TAXES

WHEREAS, Christian Pentecostal Church Principe De Paz. is the titleholder of real estate Parcel #894721377005  located in the City of Sioux City, Iowa and legally described as follows:

W 100 FT N 50 FT S 108 FT LOT 2 BLK 11 HIGMAN’S ADDITION, City of Sioux City, Woodbury County, Iowa

WHEREAS, the abovestated property has taxes owing for the 2011/2012, tax year and the parcel is owned by Christian Pentecostal Church Principe de Paz and

WHEREAS, the organization, namely Christian Pentecostal Church Principe De Paz.  is failing to immediately pay the taxes due; and 

WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes owing on the above parcel according to Code of Iowa, 445.16 for the taxes owed for the 2011/2012 tax year and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

SO RESOLVED this 8th day of January, 2013.

RESOLUTION APPROVING ABATEMENT OF TAXES

WHEREAS, Ministerio Nuvea Jerusalem is the titleholder of real estate Parcel #894721360001 located in Woodbury County, Iowa and legally described as follows:

LOTS 1-3 BLK 1 ROSE HILL ADDITION, City of Sioux City, Woodbury County, Iowa

WHEREAS, the abovestated property has taxes owing  for the 2011/2012, tax year, and the parcel is owned by Ministerio Nuvea Jerusalem; and

WHEREAS, the organization, namely Ministerio Nuvea Jerusalem is failing to immediately pay the taxes due; and 

WHEREAS,  the Board of Supervisors sees that good cause exists for the abatement of these taxes and; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes and special assessments owing on the above parcel according to Code of Iowa, 445.16 for the taxes owed for the 2011/2012 tax year and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

Motion by Tripp second by Monson to approve the appointment of Brett Baldwin, 3956 240th Street, Anthon, Iowa, and Jason Mahrt, 4170 250th Street, Anthon, Iowa as Miller Township Trustees to fill a vacancy until the next regular election.   Carried 5-0.

Motion by Tripp second by Smith to award the bid for the lease of the County Farm to the highest bidder, Tony Kohn, 4852 210th Street, Cushing, Iowa for the amount of $455.00/acre.  Carried 5-0.  Copy filed.

Motion by Boykin second by Monson to approve and authorize the Chairperson to sign a Resolution regarding construction evaluation under Iowa Code Section 459.304(3), covering the period of 02/01/2013 through 01/31/2014, per recommendation of Planning and Zoning Director John Pylelo.  Carried 5-0.

CONSTRUCTION EVALUATION RESOLUTION


WHEREAS, Iowa Code section 459.304(3) sets out the procedure if a board of supervisors wishes to adopt a “construction evaluation resolution” relating to the construction of a confinement feeding operation structure; and

WHEREAS, only counties that have adopted a construction evaluation resolution can submit to the Department of Natural Resources (DNR) an adopted recommendation to approve or disapprove a construction permit application regarding a proposed confinement feeding operation structure; and

WHEREAS, only counties that have adopted a construction evaluation resolution and submitted an adopted recommendation may contest the DNR’s decision regarding a specific application; and

WHEREAS,  by adopting a construction evaluation resolution the board of supervisors agrees to evaluate every construction permit application for a proposed confinement feeding operation structure received by the board of supervisors between February 1, 2013 and January 31, 2014 and submit an adopted recommendation regarding that application to the DNR; and

WHEREAS,  the board of supervisors must conduct an evaluation of every construction permit application using the master matrix created in Iowa Code section 459. 305, but the board’s recommendation to the DNR may be based on the final score on the master matrix or may be based on reasons other than the final score on the master matrix;

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA that the Board of Supervisors hereby adopts this construction evaluation resolution pursuant to Iowa Code section 459.304(3).

The Board discussed the fiscal year 2013 County budget.
Motion by Boykin second by Monson to receive the Conservation (General Basic) Administration budget as submitted.  Carried 5-0.

Motion by Monson second by Boykin to receive the Conservation (General Basic) Parks budget as submitted.  Carried 5-0.

Motion by Smith second by Boykin to receive the Conservation (General Basic) Naturalist budget as submitted.  Carried 5-0.

Motion by Monson second by Boykin to receive the Conservation (General Basic) Nature Center budget as submitted.  Carried 5-0.

Motion by Boykin second by Monson to receive the Conservation (Non-tax Funds) 257-Nature Center budget, the Conservation (Non-tax Funds) 266-REAP budget and the Conservation (Non-tax Funds) 667-Conservation Reserve budget as submitted.  Carried 5-0.
