SEPTEMBER 10, 2013 — THIRTYSIXTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, September 10, 2013 at 10:00 a.m.  Board members present were Boykin, Clausen, Smith, and Monson; Tripp was absent.  Staff members present were Karen James, Board Administrator, Dennis Butler, Finance/Operations Controller, Joshua Widman, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The meeting was called to order.

Motion by Boykin second by Smith to approve the minutes of the 9/3/2013 Board meeting.  Carried 4-0.  Copy filed.

Motion by Smith second by Boykin to approve the county’s claims totaling $313,911.66.  Carried 4-0.  Copy filed.

Motion by Smith second by Boykin to approve the separation of Kevin Larsen, Analyst II, Homeland Security Dept., effective 09/12/13. Other.; the separation of Eugene Nitzschke, Analyst I, Homeland Security Dept., effective 09/15/13.  Other.; and the reclassification of Susan Ahlquist, M.V. Clerk II, County Treasurer Dept., effective 09/28/13, $16.11/hour, 5%=$.77/hour. Per AFSCME Courthouse Contract agreement, from Grade 3/Step2 to Grade 3/Step 3.  Carried 4-0.  Copy filed.

Motion by Boykin second by Monson to approve and receive for signatures, a Resolution thanking and commending Traci Handke for her years of service to Woodbury County.  Carried 4-0.

RESOLUTION #11,906

TRACI HANDKE

FOR HER SERVICE TO WOODBURY COUNTY

WHEREAS, Traci Handke has capably served Woodbury County as an employee of the Woodbury County Disaster and Emergency Services Department    for 20 years from June 23, 1993 to September 1, 2013; and

WHEREAS, the service given by Traci Handke as a Woodbury County employee, has been characterized by her dedication to the best interests of the citizens of Woodbury County; and

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA that the undersigned members of this Board thanks and commends Traci Handke  for her years of service to Woodbury County; and

BE IT FURTHER RESOLVED that it is the wish of all those signing below that the future hold only the best for this very deserving person, Traci Handke.

BE IT SO RESOLVED this 10th day of September,  2013.

WOODBURY COUNTY BOARD OF SUPERVISORS

Motion by Boykin second by Smith to approve and authorize the Chairperson so sign Telecommunications Facilities Exchange Agreement with the City of Sioux City to provide the installation and operation of Fiber Optic Service to the County owned building on 1211 Tri View, per recommendation of Communication Center, Glenn Sedivy.  Carried 4-0.  Copy filed.

A public hearing was held at 10:15 a.m. for the sale of property parcel #538815 (2617 S. Maple St.)

Then Chairperson called on anyone wishing to be heard.

Motion by Boykin second by Smith to close the public hearing.  Carried 4-0.

Motion by Boykin second by Monson to approve and authorize the Chairperson to sign a Resolution for the sale of this parcel to Geraldine M. Behlers Living Trust (2615 S. Maple St, Sioux City), for real estate parcel #538815 (2617 S. Maple St.) for $5.00 plus recording fees.  Carried 4-0.

RESOLUTION OF THE BOARD OF SUPERVISORS

RESOLUTION #11,907

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:   By    __Geraldine M. Behlers Living Trust__**_______in the sum of          Five Dollars & 00/100 ($5.00)-----------------------------------------------------dollars.

For the following described real estate, To Wit:             

**Under Agreement dated May 15, 2013  

Parcel #538815

The South 3 feet North 17 feet of Lot 2 in Block 1 of Windsor Heights Addition to Sioux  

City, Woodbury County, Iowa

(2617 S. Maple Street)

Now and included in and forming a part of the City of Sioux City, Iowa, the same is hereby accepted: said Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said Real Estate.

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.

BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes.  Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

Motion by Boykin second by Monson to approve and authorize the Chairperson to sign a Resolution approving tax abatement for Living Water Evangelical Church, Parcel #894715359001.  Carried 4-0.

WOODBURY COUNTY, IOWA

RESOLUTION #11,908

RESOLUTION APPROVING ABATEMENT OF TAXES

WHEREAS, Living Water Evangelical Church is the titleholder of real estate Parcel #894715359001 located in Woodbury County, Iowa and legally described as follows: 

Parcel #894715359001

DUNDEE PLACE LOTS 6-7-8-9 LYING N ELY FROM E LINE CHEYENNE BLVD & VAC LAFAYETTE ST ABUTTING BLOCK 4 

WHEREAS, the abovestated property has taxes owing for the 2012/2013, tax year, and the parcel is owned by Living Water Evangelical Church; and

WHEREAS, the organization, namely Living Water Evangelical Church  is failing to immediately pay the taxes due; and 

WHEREAS,  the Board of Supervisors sees that good cause exists for the abatement of these taxes and; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes and special assessments owing on the above parcel according to Code of Iowa, 445.16 for the taxes owed for the 2012/2013 tax year and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

There was a discussion on nurse and correctional officer staffing within the jail with County Sheriff, Dave Drew. 

The Chairperson asked if there were any individuals or groups wishing to make a presentation of items not on the agenda, or Supervisors concerns. 

The Board adjourned the regular meeting until September 17, 2013.
