APRIL 1, 2014 — FOURTEENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, April 1, 2014 at 10:00 a.m.  Board members present were Clausen, Monson, Tripp, and Boykin; Smith was absent.  Staff members present were Karen James, Board Administrator, Dennis Butler, Finance/Operations Controller, Joshua Widman, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The meeting was called to order.  

Motion by Monson second by Tripp Monson to approve the minutes of the 03/25/2014 Board meeting.  Carried 4-0.  Copy filed.  

Motion by Tripp second by Clausen to approve the county’s claims totaling $388,406.69.  Carried 4-0.  Copy filed.

Motion by Monson second by Clausen to approve the other of Ryan Chytka, Clerk II, Building Services Dept., effective 03/13/14, $16.99/hour, 10%=$1.57/hour. Per AFSCME Courthouse Contract agreement, Temporary Transfer to Clerk II position.; the separation of Benjamin Koithan, Civilian Jailer, County Sheriff Dept., effective 04/06/14.  Resignation., and the reclassification of Loan Hensley, Asst. County Attorney, County Attorney Dept., effective 04/16/14, $81,911/year, 3.5%=$2,755/year. Per AFSCME Asst. County Attorney Contract agreement, from Step 10 to Step 11.  Carried 4-0.  Copy filed.

Motion by Monson second by Tripp to approve and authorize the Chairperson to sign an “Authorization to Initiate Hiring Process” for Civilian Jailer, County Sheriff Dept., CWA Civilian Officers Contract:  $16.85/hour.  Carried 4-0.  Copy filed.

Motion by Clausen second by Tripp to receive the appointment of Jake Prichard, 212 5th Ave., Hornick, IA as Council Member to the City of Hornick, to fill a vacancy in the office until the next regular election.  Carried 4-0.  Copy filed.

Motion by Monson second by Tripp to receive the appointment of Clifford Teel, 401 4th Ave., Hornick, IA as Council Member to the City of Hornick, to fill a vacancy in the office until the next regular election.  Carried 4-0.  Copy filed.

Motion by Clausen second by Monson to approve an application for a 12-month, Class A Liquor License (LA) (Private Club), with Sunday sales privileges, for White Horse Patrol Club, 1689 Old Hwy 141, Sergeant Bluff, Iowa, effective 04/05/14 through 04/04/15.  Carried 4-0.  Copy filed.

A public hearing was held at 10:05 a.m. regarding Authorization of a Loan Agreement and the Issuance of Notes to Evidence the Obligation of the County Thereunder. 

The Chairperson called on anyone wishing to be heard.

Motion by Clausen second by Monson to close the hearing.  Carried 4-0.

Motion by Monson second by Tripp to approve and authorize the Chairperson to sign a Resolution Instituting Proceedings to Take Additional Action for the Authorization of a Loan Agreement and the Issuance of Not to Exceed $965,00 General Obligation Capital Loan Notes, Series 2014.  Carried 4-0.

RESOLUTION #11,980

RESOLUTION INSTITUTING PROCEEDINGS TO TAKE

ADDITIONAL ACTION FOR THE AUTHORIZATION OF A

LOAN AGREEMENT AND THE ISSUANCE OF NOT TO

EXCEED $965,000 GENERAL OBLIGATION LOAN

NOTES, SERIES 2014

WHEREAS, pursuant to notice published as required by law, this Board has held a public meeting and hearing upon the proposal to institute proceedings for the authorization of a Loan Agreement and the issuance of not to exceed $965,000 General Obligation Capital Loan Notes, Series 2014, for the purpose of paying costs of:

a)  public buildings, including equipment, remodeling, reconstruction and additions or extensions to the buildings, in an amount not to exceed $845,000; and

b)  optical scan voting equipment, in an amount not to exceed $120,000,

and has considered the extent of objections received from residents or property owners as to the proposal and, accordingly the following action is now considered to be in the best interests of the County and residents thereof:

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, STATE OF IOWA:

Section 1.  That this Board does hereby institute proceedings and take additional action for the authorization of a Loan Agreement and issuance in the manner required by law of not to exceed $965,000 General Obligation Capital Loan Notes, Series 2014, to evidence the obligation thereof for the foregoing purpose.

Section 2.  This Resolution shall serve as a declaration of official intent under Treasury Regulation 1.150-2 and shall be maintained on file as a public record of such intent. It is reasonably expected that moneys may be advanced from time to time for capital expenditures which are to be paid from the proceeds of the above loan agreement.  The amounts so advanced shall be reimbursed from the proceeds of the Loan Agreement not later than eighteen months after the initial payment of the capital expenditures or eighteen months after the property is placed in service.  Such advancements shall not exceed the loan amount authorized in this Resolution unless the same are for preliminary expenditures or unless another declaration of intention is adopted.

Motion by Clausen second by Monson to approve and authorize the Chairperson to sign a 28E Agreement between Woodbury County and Woodbury Soil and Water Conservation District for Funding and Management of a Watershed Inspection and Maintenance Program in Woodbury County, State of Iowa.  Carried 4-0.  Copy filed.

Motion by Monson second by Tripp to postpone action on the of addendum to Travel Policy for Economic Development Director.  Carried 4-0.  Copy filed.

Motion by Clausen second by Tripp to approve plans for Project Number L-B(K199)—73-97, Michigan Avenue Bridge.  Carried 4-0.  Copy filed.

Motion by Tripp second by Clausen to approve and authorize the Chairperson to sign a permit for use of County Road/Highway Right-of-Way for overhead and/or buried utilities accommodation for Woodbury County REC on Calhoun Ave.  Carried 4-0.  Copy filed.

Motion by Monson second by Tripp to approve and receive for signatures a Resolution to place a seasonal embargo on 250th St, County Route D51 in Sections 20 and 21 of Miller Township.

WOODBURY COUNTY, IOWA

TEMPORARY ROAD EMBARGO – 260TH STREET

RESOLUTION #11,981

WHEREAS, the Woodbury County Board of Supervisors believe certain secondary roads in Woodbury County, Iowa which are paved or unpaved,  will be seriously damaged or destroyed unless the us of vehicles thereon is prohibited or permissible weight thereon reduced, and

WHEREAS, Chapter 321, Section 471 of the Code of Iowa, gives said Board the power to prohibit the operations of said vehicles on such roads, and to impose restrictions as to the weight of vehicles on said roads.

NOW THEREFORE BE IT RESOLVED by the Woodbury County Board of Supervisors, that, where signs are erected on a highway, operations of vehicles weighing in excess of said weight limit are prohibited on said highway.

IT IS FURTHER RESOLVED that the said secondary roads subject to this resolution are more particularly described as:

1) 260th Street from Highway 31 east to the intersection of County Routes D51 and L27. The effective of this resolution is April 1, 2014 through and including June 15, 2014.    The County Engineer is instructed to remove said embargo earlier if road conditions allow.

2) 220th Street from County Route K29 east one and one half miles to the end of the seal coat segment.   The effective of this resolution is April 1, 2014 through and including June 15, 2014

SO RESOLVED, Dated this 1st day of April, 2014.

Motion by Monson second by Tripp to approve and authorize the Chairperson to sign Highway 31 Transfer of Jurisdiction Agreement.  Carried 4-0.  Copy filed.

The Chairperson asked if there were any individuals or groups wishing to make a presentation of items not on the agenda, or Supervisors concerns.

Trent Wright, Sioux City, addressed the Board with concerns about tax dollars being appropriated for non-mandated services performed by non-profit organization.

An applicant for a position within the County requested an interview be conducted in executive session.  Motion by Clausen second by Tripp to go into closed session for interview for Human Resources Director’s Position per Iowa Code 21.5(i).  Carried 4-0 on a roll-call vote.

Motion by Clausen second by Tripp to go out of closed session per Iowa Code 21.5(i).  Carried 4-0 on a roll-call vote.

A closed session for the interview of an applicant for the Human Resources Director’s Position per Iowa Code 21.5(i) was postponed.

The Board adjourned the regular meeting until April 8, 2014.
