JUNE 6, 2017, TWENTYSECOND MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, June 6, 2017 at 4:30 p.m.  Board members present were De Witt, Pottebaum, Radig, Taylor, and Ung.  Staff members present were Dennis Butler, Budget/Tax Analyst, Karen James, Board Administrative Assistant, Ed Gilliland, Human Resources Director, Abigail Sills, Assistant County Attorney and Patrick Gill, Auditor/Clerk to the Board.

The regular meeting was called to order with the Pledge of Allegiance to the Flag and a Moment of Silence. 

Citizen concerns.

Motion by Radig second by Ung to approve the Agenda for June 6, 2017.  Carried 5-0.  Copy filed.

Motion by Radig second by De Witt to approve the following items by consent:

To approve minutes of the May 30, 2017 meeting.  Copy filed.

RESOLUTION APPROVING PETITION FOR SUSPENSION

OF TAXES THROUGH THE REDEPTION PROCESS

WHEREAS, Carrie Rustin as joint titleholders of property located at 2216 Jones St., Sioux City, Iowa, Woodbury County, Iowa, and legally described as follows:

Parcel #   894721252003

LAWN RIDGE DRURY REPLAT BLK 10 LOT 4  

WHEREAS, Carrie Rustin, as joint titleholders of the aforementioned property has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1999 Iowa Code Section 447.9(3) and,

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby directs the County Auditor to redeem this property Parcel #894721252003 owned by the petitioner from the holder of a certificate of purchase of the amount necessary to redeem under section 447.9, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this parcel.

RESOLUTION APPROVING ABATEMENT OF TAXES

WHEREAS, Long Lines Wireless  is the titleholder of a building on leased land Parcel #894430300901 located in Woodbury County, Iowa and legally described as follows:

WHEREAS, the abovestated property has taxes payable including special assessments and the parcel is owned by Long Lines Wireless

WHEREAS, these taxes are uncollectable or impractical to pursue collection through personal judgment or tax sale.

WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes and;

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes owing on the above parcel according to Code of Iowa, 445.16 for the taxes owed and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

WOODBURY COUNTY BOARD OF SUPERVISORS

To approve the reclassification of Anthony Thomas, Civilian Jailer, County Sheriff Dept., effective 05-15-17, $21.61/hour, 15%=$2.88/hr.  Per CWA Civilian Officers Contract agreement, from Class 2 to Senior Class due to 4 years employment and Bachelor’s Degree.  Copy filed.

To receive employment agreement between Woodbury County and the Jail Alternative Coordinator.  Copy filed.

Carried 5-0.

Motion by Radig second by Taylor to approve and authorize the Chairperson to sign the Authorization to initiate the hiring process for Community Economic Development Director, Community Economic Development Dept., Wage Plan:  $74,500-$80,000/year, and Zoning Coordinator, Community and Economic Development Dept., Wage Plan:  $49,500-$54,000/year. Carried 4-1; Pottebaum was opposed.  Copy filed.

A public hearing was held at 4:35 p.m. for the sale of Survey #5248.  The Chairperson called on anyone wishing to be heard.

Motion by Taylor second by Radig to close the public hearing.  Carried 5-0.

Motion by Radig second by Taylor to approve and authorize the Chairperson to sign a Resolution for the sale of this parcel to David and Lynette Howell, 4710 Military Rd., Sioux City, for real estate survey #5248, for $4,000.00 plus recording fees.  Carried 5-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

By   David W. Howell & Lynette M. Howell___in the sum of Four Thousand Dollars & 00/100 ($4,000.00)-----------------------------------------------------dollars.

For the following described real estate, To Wit:

All that part of Lot 10 in the Southeast ¼ of the Southeast ¼ of Auditor’s Subdivision of Section 14, Township 89 North, Range 48 West of the Fifth Principal Meridian, Sioux City, Woodbury County, Iowa, described as follows:

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.

BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes.  Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

NOTES

WHEREAS, pursuant to notice published as required by law, the Board of Supervisors has held a public meeting and hearing upon the proposal to institute proceedings for the authorization of a Loan Agreement and the issuance of not to exceed $900,000 General Obligation Capital Loan Notes, for the essential county purposes, in order to provide funds to pay the costs of HVAC Automation Projects at the Courthouse and Siouxland District Health Facility, at a total cost of the projects not to exceed $1,200,000, and has considered the extent of objections received from residents or property owners as to the proposed issuance of Notes; and following action is now considered to be in the best interests of the County and residents thereof.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, STATE OF IOWA:

That this Board does hereby institute proceedings and take additional action for the authorization and issuance in the manner required by law of not to exceed $900,000 General Obligation Capital Loan Notes, for the foregoing essential county purposes.

This Resolution shall serve as a declaration of official intent under Treasury Regulation 1.150-2 and shall be maintained on file as a public record of such intent.  It is reasonably expected that the general fund moneys may be advanced from time to time for capital expenditures which are to be paid from the proceeds of the above Notes.  The amounts so advanced shall be reimbursed from the proceeds of the Notes not later than eighteen months after the initial payment of the capital expenditures or eighteen months after the property is placed in service.  Such advancements shall not exceed the amount authorized in this Resolution unless the same are for preliminary expenditures or unless another declaration of intention is adopted.

WHEREAS, pursuant to notice published as required by law, the Board of Supervisors has held a public meeting and hearing upon the proposal to institute proceedings for the authorization of a Loan Agreement and the issuance of not to exceed $850,000 General Obligation Capital Loan Notes, for the essential county purposes, in order to provide funds to pay the costs of boiler and steamtrap improvement projects at the Courthouse, Trosper Hoyt Facility and Siouxland District Health Facility, at a total cost of the projects not to exceed $1,200,000, and has considered the extent of objections received from residents or property owners as to the proposed issuance of Notes; and following action is now considered to be in the best interests of the County and residents thereof.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, STATE OF IOWA:

That this Board does hereby institute proceedings and take additional action for the authorization and issuance in the manner required by law of not to exceed $850,000 General Obligation Capital Loan Notes, for the foregoing essential county purposes.

WHEREAS, pursuant to notice published as required by law, the Board of Supervisors has held a public meeting and hearing upon the proposal to institute proceedings for the authorization of a Loan Agreement and the issuance of not to exceed $1,100,000 General Obligation Capital Loan Notes, for the essential county purposes, in order to provide funds to pay the costs of Miscellaneous needs assessments and facility maintenance, replacement projects at the Courthouse, Law Enforcement Center, Prairie Hills Facility and Climbing Hills Facility, and has considered the extent of objections received from residents or property owners as to the proposed issuance of Notes; and following action is now considered to be in the best interests of the County and residents thereof.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, STATE OF IOWA:

That this Board does hereby institute proceedings and take additional action for the authorization and issuance in the manner required by law of not to exceed $1,100,000 General Obligation Capital Loan Notes, for the foregoing essential county purposes.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, STATE OF IOWA:
