JULY 31, 2012 — THIRTFIRST MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, July 31, 2012 at 10:00 a.m.  Board members present were Monson, Clausen, Boykin, Tripp, and Smith.  Staff members present were Heather Satterwhite, Public Bidder, Joshua Widman, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board. 
      
The Claims were approved as presented.  Copy filed.

The meeting was called to order.

Motion by Tripp second by Boykin to approve the minutes of the 07/24/2012 Board meeting.  Carried 5-0.  Copy filed.

Motion by Monson second by Clausen to approve the separation of Benjamin Koithan, Temporary Summer Laborer, Secondary Roads, effective 07/20/12. End of Temp.; the reclassification of Todd Peterson, Sheriff Deputy, County Sheriff Services Dept., effective 08-02-12, $25.63/hour, 6.5%=$1.75/hour.  Per CWA Deputy Sheriff Contract agreement, from class 1 to Senior Class; the reclassification of Vincent Dvorak, Civilian Jailer, County Sheriff Dept., effective 08-11-12, $19.68/hour, 10.8%=$1.93/hour.  Per CWA Civilian Officer Contract agreement, from Class 1 to Senior Class; and the separation of Daniel Whitlock, Civilian Jailer, County Sheriff Dept., effective 08-13-12.  Resignation.  Carried 5-0.  Copy filed.

Motion by Clausen second by Boykin to approve and authorize the Chairperson to sign an “Authorization to Initiate Hiring Process” for Civilian Jailer, County Sheriff Dept., CWA Civilian Officer:  $16.40/hour.  Carried 5-0.  Copy filed.
 
Motion by Monson second by Clausen to approve for change in part-time staff position, per recommendation of Gary Brown, Emergency Services.  Carried 5-0.  Copy Filed.

Motion by Boykin second by Monson to approve and authorize the Chairperson to sign Attestation Letter, per recommendation of Joy Caudron, Siouxland District Health.  Carried 5-0.  Copy filed.

Motion by Monson second by Tripp to take action on County Grants Administration Policy/Procedures, per recommendation of Dennis Butler with the addition of position identifiers.  Carried 5-0.

Motion by Boykin second by Tripp to lift the suspension of taxes for Nancy Ingalls, 1720 w 3rd St., Sioux City, parcel #894730287006.  Carried 5-0.

Motion by Tripp second by Boykin to approve and authorize the Chairperson to sign a Resolution approving petition for suspension of taxes through the redemption process for Monica Flower, 3341 Dearborn Blvd, Sioux City, parcel #894716154010.  Carried 5-0.

RESOLUTION APPROVING SUSPENSION OF TAXES
      
WHEREAS, Monica R. Flower  is the titleholder of  property located at 3341 Dearborn Blvd., Sioux City,  Woodbury County, Iowa, and legally described as follows:  
    
Parcel #   8947 16 154 010

Pt Vacant  McDonald Ave  West of & Lot Three (3) Block Four (4)  North Haven Addition, City of Sioux City, Woodbury County, Iowa
 
WHEREAS, Monica R. Flower is the titleholder of the aforementioned property have petitioned the Board of Supervisors for a suspension of taxes pursuant to the 2009 Iowa Code section 427.9, and 

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension  for this property.

SO RESOLVED this 31st day of  July 2012.

A public hearing was held at 10:14 a.m. for the sale of property parcel #407626 (3422 Grandview Blvd., Sioux City). 

The Chairman called on anyone wishing to be heard.
      
Motion by Clausen second by Boykin to close the hearing.   Carried 5-0.
      
Motion by Clausen second by Monson to approve and authorize the Chairperson to sign a Resolution for the sale of this parcel to City of Sioux City, 405 6th St., Sioux City, for $6.00 plus recording fees, for real estate parcel #407626 (3422 Grandview Blvd., Sioux City).  Carried 5-0.

RESOLUTION #10,953

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

By    City of Sioux City______in the sum of Six Dollars & 00/100 ($6.00)-----------------------------------------------------dollars.

For the following described real estate, To Wit: 
 
Parcel #407626
That part of Lots Thirteen, & Fourteen lying west of creek, Lot Fifteen, that part of Lot   
Sixteen not vacated, all in Block Ninety-Seven, Peirce’s Addition to
Sioux City
(3422 Grandview Blvd.)

Now and included in and forming a part of the City of Sioux City, Iowa, the same is hereby accepted: said
Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said Real Estate.

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.

BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes.  Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

A public hearing was held at 10:15 a.m. regarding the Budget Amendment #1 FY 2013.  The Chairperson called on anyone wishing to be heard.

Motion by Clausen second by Boykin to close the public hearing.  Carried 5-0.

Motion by Monson second by Boykin to approve and authorize the Chairperson to sign Budget Amendment #FY 2013.  Carried 5-0.

Motion by Monson second by Boykin to approve the construction contract with L & L Builders for the relocation ASAP Room and the Law Enforcement Center.  Carried 5-0.

Motion by Monson second by Boykin to approve the Amendment of the Woodbury County Hazard Mitigation Contract.  Carried 5-0.

Motion by Monson second by Boykin to receive the appointment of Don Wood, 305 1st St, Sergeant Bluff, to fill office previously held by Larry Kollbaum and of Glenda Moriarty, 301 Windsor Way, Sergeant Bluff, to fill the office previously held by Walt Wendel,  to the Sergeant Bluff City Council until the next regular election.  Carried 5-0.

Motion by Clausen second by Boykin to accept a Certificate of Completion for Hackley Lateral Drainage District Cleanout Project  with Clark Construction Co. for $44,130.00, per recommendation of Mark Nahra, County Engineer.  Carried 5-0. Copy filed.

Discussion of Outreach Program for Investing in County Loan Program with Rob Marqusee, Rural Economic Development.

The Chairperson asked if there were any individuals or groups wishing to make a presentation of items not on the agenda, or Supervisors concerns.

Steve McGrory and two participants (Cal Robertson and Keegan Lyon both of Sioux City) with the First Tee program addressed the Board.

The Board adjourned the regular meeting until August 07, 2012.
