SEPTEMBER 24, 2013 — THIRTYEIGTHTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, September 24, 2013 at 10:00 a.m.  Board members present were Boykin, Clausen, Smith, Tripp, and Monson.  Staff members present were Karen James, Board Administrator, Dennis Butler, Finance/Operations Controller, Joshua Widman, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The Board of Supervisors canvassed the Western Iowa Tech Community College School Election held on the 10th day of September, 2013.

Western Iowa Tech Community College Director District 2

Michael D. Hunter Received thirty-four (34) votes

Brent Koppie Received twenty-six (26) votes

Candidate Total Sixty (60) votes

We therefore declare: Michael D. Hunter duly elected for the office of Western Iowa Tech Community College Director District 2 for the term of 4 years.

Motion by Monson second Boykin by to receive for signatures the canvass of the Western Iowa Tech Community College School Election held on the 10th day of September, 2013.  Carried 5-0.

The meeting was called to order.

Motion by Smith second by Boykin to approve the minutes of the 9/17/2013 Board meeting.  Carried 5-0.  Copy filed.

Motion by Tripp second by Boykin to approve the county’s claims totaling $949,499.81.  Carried 5-0.  Copy filed.

Motion by Boykin second by Monson to approve the reclassification of Elizabeth Peterson, Youth Worker, Juvenile Detention Dept., effective 10/07/13, $23.84/hour, 6.5%=$1.46/hour. Per AFSCME Juvenile Detention Contract agreement, from Grade 1/Step 5 to Grade 1/Step 6. and the reclassification of Jason Kurtz, Youth Worker, Juvenile Detention Dept., effective 10/12/13, $22.38/hour, 5.5%=$1.18/hour. Per AFCME Juvenile Detention Contract agreement, from Grade 1/Step 4 to Grade 1/Step 5.  Carried 5-0.  Copy filed.

Motion by Monson second by Boykin to approve and authorize the Chairperson to sign a Resolution approving petition for suspension of taxes through the redemption process for Michael Chaussee, 3534 Park View, Sioux City, parcel #894723385012.  Carried 5-0.

RESOLUTION APPROVING PETITION OF SUSPENSION OF TAXES

THROUGH THE REDEMPTION PROCESS

WHEREAS, Michael R. Chaussee  as joint titleholders of  a property  located at 3534 Park View Blvd.,  Woodbury County, Iowa, and legally described as follows:

KELLY PARK LOT 15 BLK 23 

WHEREAS, Michael R. Chaussee, as joint titleholders of the aforementioned property has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1999 Iowa Code Section 447.9(3) and,

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby directs the County Auditor to redeem this property  Parcel  #894723385012 owned by the petitioner from the holder of a certificate of purchase of the amount necessary to redeem under section 447.1, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this parcel.

RESOLUTION APPROVING ABATEMENT OF TAXES

WHEREAS, Saint Thomas Episcopal Church is the titleholder of real estate Parcels #894728112012 and #894728112013 located in Woodbury County, Iowa and legally described as follows:

SIOUX CITY EAST LOT 4 AND N 1/2 LOT 5  BLK 64  

Parcel # 894728112013

SIOUX CITY EAST PT E/W ALLEY ADJ TO LOTS 3 & 4 BLK 64      

WHEREAS, the abovestated property has taxes owing for the 2012/2013, tax year, and the parcel is owned by Saint Thomas Episcopal Church; and

WHEREAS, the organization, namely Saint Thomas Episcopal Church  is failing to immediately pay the taxes due; and 

WHEREAS,  the Board of Supervisors sees that good cause exists for the abatement of these taxes and; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes and special assessments owing on the above parcel according to Code of Iowa, 445.16 for the taxes owed for the 2012/2013 tax year and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

Motion by Smith second by Tripp to approve Re-appointments of Dr. Jerome Pierson, Susan Barta, Mike McTaggart, and Jackie Smith to the Prevention Commission for Youths at Risk.  Carried 4-0; Boykin abstained.  Copy filed.

There was a presentation of a Resolution Thanking and Commending Traci Handke for Years of Service.

Motion by Monson second by Tripp to approve initiating the bid process on equipment for Courthouse Security.  Carried 4-1; Clausen opposed.

Bid letting was held at 10:25 a.m. for Project Number LB-(X9)—73-97.  The bids were as follows:

Dixon Construction, Correctionville, IA  $172,420.00

GUS Construction, Spencer, IA   $174,471.12

Graves Construction, Spencer, IA   $227,821.75

Motion by Monson second by Tripp to receive and refer the bids to the County Engineer, Mark Nahra, for review and recommendation.  Carried 5-0.  Copy filed.

Motion by Boykin second by Monson to approve and receive for signatures a Resolution for the establishment of a Stop Sign at the Intersection of 235th Street and Allison Avenue, per recommendation of Mark Nahra, County Engineer.  Carried 5-0. 

RESOLUTION FOR THE ESTABLISHMENT OF A STOP SIGN AT THE INTERSECTION

OF 235TH STREET AND ALLISON AVENUE

RESOLUTION #11,914

WHEREAS, under the provisions of Section 321.255 and 321.236 (1C)(6) of the 2013 Code of Iowa, the Board of Supervisors and County Engineer are empowered to designate the location and erection of stop signs,

AND WHEREAS, the County Board and County Engineer may designate certain roads as through roads with the erection of stop signs at specified locations furnishing access thereto or designation of any intersection as a stop intersection and erect like signs at one or more locations of access to such intersections.

AND WHEREAS, traffic through the intersection has changed due to the use of 235th Street and Allison Avenue as haul roads during the construction of the new CF Industries plant, resulting in a significant change to the volume of traffic at this intersection,

AND WHEREAS, there is currently a stop sign controlling eastbound and westbound traffic at the intersection,

AND WHEREAS, with the increased level of traffic at the intersection, it is deemed a safety hazard to allow the traffic to move without stopping all directions,  

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors of Woodbury County on this 24th day of September, 2013, recognize as official the location of a stop sign at the intersection described below:

1. Located at the W ¼ corner of Section 25, T87N, R48W, designated as the intersection of 235th Street and Allison Avenue, causing traffic travelling on Allison Avenue northbound and southbound to come to a complete stop.

WHEREAS: The Board of Supervisors of Woodbury County is empowered under the authority of sections 321.255 and 321.285, subsection 4 of the Code of Iowa to determine upon the basis of an engineering and traffic investigation conducted by the County Engineer that the speed limit of any secondary road is greater than is reasonable and proper under the conditions existing, and may determine and declare a reasonable and proper speed limit, and

WHEREAS: Such investigation has been requested and completed and the county engineer has reached an opinion concerning the reasonable and proper speed for the road listed herein,

NOW, THEREFORE BE IT RESOLVED, by the Woodbury County Board of Supervisors that the following speed limit be established and appropriate signs erected at the locations described as follows:

1).  Beginning at the intersection of Port Neal Road and 235th Street then proceeding west on 235th Street to the intersection of Allison Avenue, a speed limit of 45 miles per hour is established.

Speed limit shall be effective when appropriate signs giving notice of the speed limits are erected.

WHEREAS: Such investigation has been requested and completed and the county engineer has reached an opinion concerning the reasonable and proper speed for the road listed herein,

NOW, THEREFORE BE IT RESOLVED, by the Woodbury County Board of Supervisors that the following speed limit be established and appropriate signs erected at the locations described as follows:

1).  Beginning at the intersection of Sully Drive and Allison Avenue then proceeding south on Allison Avenue to the end of the county maintenance, a speed limit of 45 miles per hour is established.

Speed limit shall be effective when appropriate signs giving notice of the speed limits are erected.

WHEREAS: Such investigation has been requested and completed and the county engineer has reached an opinion concerning the reasonable and proper speed for the road listed herein,

NOW, THEREFORE BE IT RESOLVED, by the Woodbury County Board of Supervisors that the following speed limit be established and appropriate signs erected at the locations described as follows:

1).  Beginning at the intersection of Allison Avenue and 225th Street then proceeding east on 225th Street to the west corporate line of the city of Sioux City, a speed limit of 35 miles per hour is established.

Speed limit shall be effective when appropriate signs giving notice of the speed limits are erected.

Motion by Boykin second by Tripp to approve the preliminary platting for the Trucke Acres Addition (a Minor Subdivision), and forward it to the Zoning Commission for public hearing and recommendations.  Carried 5-0.

Motion by Boykin second by Smith to authorize the Chairperson to sign the Justice Assistance Grant (JAG) 2013 per recommendation of Patty Erickson-Puttman, Social Coordinator.  Carried 5-0.  Copy filed.

Motion by Smith second by Tripp to authorize Patty Erickson-Puttman to electronically submit Justice Assistance Grant (JAG).  Carried 5-0.  Copy filed.

Motion by Tripp second by Monson to approve and authorize the Chairperson to sign Memorandum of Understanding for the 2014 EMS System Development Grant.  Carried 5-0.  Copy filed.

Motion by Smith second by Tripp to approve and authorize the Letter of Commitment for the Western Iowa Community Improvement Regional Housing Trust Funds proposed 2013-2014 Project to the Iowa Finance Authority.  Carried 5-0.  Copy filed.

The Chairperson asked if there were any individuals or groups wishing to make a presentation of items not on the agenda, or Supervisors concerns. 

County Engineer Mark Nahra provided an update on concerns brought to the Board by Robert Logan of Moville.

Supervisor Smith asked County Sheriff Dave Drew to provide an update of contract law enforcement within the County. 

The Board adjourned the regular meeting until October 1, 2013.
