FEBRUARY 25, 2014 — NINETH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, February 25, 2014 at 10:00 a.m.  Board members present were Smith, Clausen, Monson, and Tripp; Boykin was absent.  Staff members present were Karen James, Board Administrator, Dennis Butler, Finance/Operations Controller, Joshua Widman, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The meeting was called to order.   Motion by Monson second by Tripp to approve the minutes of the 02/18/2014 Board meeting.  Carried 3-0; Smith abstained.  Copy filed.   Motion by Monson second by Tripp to approve the county’s claims totaling $201,191.26.  Carried 4-0.  Copy filed.

Motion by Smith second by Tripp to approve the reclassification of Leila McCoy, Case Manager, Social Services Dept., effective 03/16/14, $20.76/hour, 3%=$1.22/hour. Per Wage Plan Matrix, 3 year Salary Increase. and the reclassification of Laura Kinnaman, Custodian, Building Services Dept., effective 03/18/14, $14.51/hour, 5%=$.70/hour.  Per AFSCME Courthouse Contract agreement, from Grade 1/Step 2 to Grade 1/Step 3.  Carried 4-0.  Copy filed.

Motion by Monson second by Tripp to approve the re-appointments of Sally Hartley and Kevin Grieme to Community Action Agency Board of Directors.  Carried 4-0.  Copy filed.

Motion by Tripp second by Smith to appoint Debbie DeForrest, 1861 Bucchanan, to the Commission to Assess Damages, Category A. Owner/Operator of Agricultural Property.  Carried 4-0.

Motion by Monson second by Tripp to receive for consideration the final platting for Valley Subdivision of Lot 1 of Harrison Replat of a Part of Lot 2 of Ridgeview II Addition Subdivision and to refer to the Zoning Commission for recommendation.  Carried 4-0.  Copy filed.

Motion by Monson second by Tripp to approve and authorize the Chairperson to sign a Quit Claim Deed for Vacated County Right of Way.  Carried 4-0.  Copy filed.

Motion by Smith second by Monson to lift the suspension of taxes for Angel Woods, 711 W 6th St., Sioux City, Parcel #894729213027.  Carried 4-0.  Copy filed.

Motion by Monson second by Smith to lift the suspension of taxes for Terrence Jernberg, 1631 S. Olive St., Sioux City, Parcel #884705205012.  Carried 4-0.  Copy filed.

Motion by second by to lift the suspension of taxes for Denise Koch, 38 Terratam Circle, Sioux City, Parcel #894429388002.  Carried 4-0.  Copy filed.

Motion by Monson second by Smith to approve and authorize the Chairperson to sign a Resolution setting the public hearing and sale date for parcel #132885, 1618 W. 2nd St., Sioux City.  Carried 4-0.

NOTICE OF PROPERTY SALE      

Parcel #132885

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

Lot Five in Block Twenty-Three of Sioux City Davis Addition, in the County of Woodbury and State of Iowa (1618 W. 2nd Street)

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1.  That a public hearing on the aforesaid proposal shall be held on      

the 11th  Day of March, 2014 at 10:15 o’clock a.m. in the meeting      

room of the Board of Supervisors on the first floor of the Woodbury

County Courthouse.        

2.  That said Board proposes to sell the said parcel of real estate at a  

public auction to be held on the 11th  Day of March, 2014,  immediately          

following the closing of the public hearing.

3.  That said Board proposes to sell the said real estate to the highest  

bidder at or above a total minimum bid of $306.00 plus recording fees.

Motion by Monson second by Smith to receive the appointment of Donald Sulsberger, 201 W. Pine St., Smithland, Iowa, as City of Smithland Council Member, to fill the office previously held by Curtis Larson, until the next regular election.  Carried 4-0.  Copy filed.

A public hearing was held at 10:15 a.m. for the sale of property parcels #012735 (615 W. 8th St.), #012585 (612 W. 9th St.), and #012615 (816 Cook St.).

Then the Chairperson called on anyone wishing to be heard.

Motion by Smith second by Monson to close the public hearing.  Carried 4-0.

Bidding opened at $1,500.00 until a final bid of $3,800.00 was made by  

Motion by Smith second by Monson to approve and authorize the Chairperson to sign a Resolution for the sale of these parcels to Harmony Real Estate Co LC, for real estate parcel #012735 (615 W 8th St.), #102585 (612 W. 9th.), and #012615 816 (816 Cook St.) for $3,800.00 plus recording fees.  Carried 4-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

By   Harmony Real Estate Co Lc        in the sum of          Three Thousand Eight Hundred Dollars & 00/100 ($3,800.00)-----------------------------------------------------dollars.

For the following described real estate, To Wit:           

Parcels #012585, #012615, #012735

The East 60 feet of Lots 1 & 2; The South 24 feet of the West 90 ft of Lot 2; and the East    

47 feet Lots 5 & 6 all in Block 60, Sioux City, in the County of Woodbury and State of   

Iowa  

(612 W. 9th Street; 816 Cook Street; 615 W. 8th Street)  

Now and included in and forming a part of the City of Sioux City, Iowa, the same is hereby accepted: said

Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said Real Estate.

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.

BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes.  Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

Motion by Smith second by Monson to approve amending the Correctional Officers Contract current shift differential from .40 cents and .50 cents per hour to .45 cents per hour per recommendation of Doug Phillips, which has already been approved by the bargaining unit.  Carried 4-0.  Copy filed.  

The Chairperson asked if there were any individuals or groups wishing to make a presentation of items not on the agenda, or Supervisors concerns.

The Board adjourned the regular meeting until March 4, 2014.
