JULY 21, 2026, THIRTIETH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS  

The Board of Supervisors met on Tuesday, July 21, 2026, at 4:30 p.m. Board members present were Bittinger II, Ung, Carper, and Nelson; Dietrich was absent. Staff members present were Karen James, Board Administrative Assistant, Joshua Widman, Assistant County Attorney, Ryan Ericson, Budget and Finance Director, Melissa Thomas, HR Director, and Michelle Skaff, Auditor/Clerk to the Board. 

The regular meeting was called to order with the Pledge of Allegiance to the Flag and a Moment of Silence.  

Motion by Nelson second by Bittinger to approve the July 21, 2026, agenda. Carried 4-0. Copy filed.

NOTICE OF PROPERTY SALE
WOODBURY COUNTY, IOWA

WHEREAS Woodbury County, Iowa is the owner of a certain parcel of real estate described as:

Lots 1,2,3,4,5, & 6; and the vacated East/West alley lying between Lots 3 & 4 all in Block 38, Sioux City East Addition to Sioux City, Woodbury County, Iowa.                                                                     
           
(Said parcel commonly known as 401 7th Street, Sioux City, Iowa.)

NOW THEREFORE, 
 
BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1.   That pursuant to Iowa Code Section 331.361, a public hearing on this property 
sale proposal shall be held on the 4th Day of August, 2026 at 4:35 p.m. in 
the basement of the Woodbury County Courthouse. 
      
2.   That said Board proposes to sell the said parcel of real estate in a
directed sale to City of Sioux City, immediately following the closing of the   
public hearing.
      
3. That said Board proposes to sell the said real estate to City of Sioux City for $1.00 and other good and valuable consideration as set forth in the  Letter of Understanding   Current Law Enforcement Center 407 7th Street, Sioux City, Iowa 51101  between the City of Sioux City and the Woodbury County Board of Supervisors dated February 16, 2021.
      
4.  That this resolution, preceded by the caption "Notice of Property Sale"
and except for this subparagraph 4 be published as notice of the
aforesaid proposal, hearing and sale.

Mickey Sauser, President of EMS Association; Daem Lauters, Sergeant Bluff Assistant Fire Chief; Cy Gaul, Sergeant Bluff Fire and Rescue; and Nick Lars, Bronson and Lawton Ambulance, presented information on the Opioid related EMS calls in Woodbury County and the importance of the LifePak Heart monitors. 

Motion by Nelson second by Ung to receive a letter from Nick Poese, Anthon Ambulance, regarding the importance of the LifePak monitors. Carried 4-0. Copy filed.

Motion by Ung second by Bittinger to approve to the use of Opioid fund to Fund75% the new LifePak Heart Monitors with the balance coming from County Gaming Funds up to $200,000.  Carried 4-0.  Copy filed.

Motion by Nelson second by Ung to approve and authorize the Chairperson to sign a Resolution in support of the Joint CHBP Grant Agreement & Letter of Support for the Competitive Highway Bridge Program (CHBP) Grant Project.  Carried 4-0.

RESOLUTION #14,069
IN SUPPORT OF THE JOINT CHBP GRANT AGREEMENT & LETTER OF SUPPORT FOR THE
COMPETITIVE HIGHWAY BRIDGE PROGRAM (CHBP) GRANT PROJECT

Whereas, Woodbury County, Iowa bridge FHWA number: 353380, has been identified as being part of a joint Competitive Highway Bridge Program (CHBP) Grant Project, and 

Whereas, Iowa bridge FHWA number 353380 have been included in a Bundle, as detailed in Exhibit B, and

Whereas, we accept the Contracting Authority for the bundle as detailed in Exhibit B, and acknowledge the roles and responsibilities of each party as detailed in Sections 3 and 4, and

Whereas, it is desired by and in the interest of Woodbury County to participate fully in the CHBP project activities as a Sub-recipient and provide all requisite information necessary to bring to completion all project phases through final completion, and 

Whereas, we are in support of the Iowa DOT providing Primary Recipient roles and duties, and 

Whereas, we understand and accept the Sub-recipient roles and responsibilities as defined in the  28E Cooperative Agreement for a Fiscal Year 2026 Competitive Highway Bridge Program (CHBP) Grant Project , including its referenced Exhibits, and

Whereas, each County as shown in Section 4, paragraph A shall be responsible for all matching funds and accept any costs exceeding the funds requested in the CHBP Grant application for their respective structure, and

Whereas, it is the intent of Woodbury County, upon award of CHBP funds, to enter into a Federal-aid Agreement with the Iowa Department of Transportation (DOT).

THEREFORE BE IT RESOLVED that the Board of Supervisors of Woodbury County, Iowa hereby approves and directs the Chair to sign this Letter of Support for the Competitive Highway Bridge Program (CHBP) Grant Project and the 28E Cooperative Agreement for a Fiscal Year 2026 Competitive Highway Bridge Program (CHBP) Grant Project, and to provide all pertinent correspondence and project information to:

RESOLUTION ESTABLISHING THE INTEREST RATE PAID ON DRAINAGE WARRANTS

WHEREAS, the Woodbury County Board of Supervisors has the authority to establish the interest rate on drainage warrants pursuant to Iowa Code Chapter 468.

NOW, THEREFORE, BE IT RESOLVED, by the Woodbury County Board of Supervisors that the interest rate for Drainage Warrants is hereby set at 5% APR for Fiscal Year 2027.

WHEREAS, said Board, as Trustees, has determined that it is necessary to levy a special tax and/or assessment on all tracts of land, lots, railroad companies and public highways within the boundaries of the said Drainage District.

NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Anthon Central Drainage District, that a special tax and/or assessment in the sum of $  0.00      be levied against all the tracts of land, lots, railroad companies and public highways within said Drainage District, same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed.

NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Orton Slough Drainage District, that a special tax and/or assessment in the sum of $  100.00   be levied against all the tracts of land, lots, railroad companies and public highways within said Drainage District, same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed.

WHEREAS, said Board, as Trustees, has determined that it is necessary to levy a special tax and/or assessment on all tracts of land, lots, railroad companies and public highways within the boundaries of the said Drainage District.

NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Wolf Creek Drainage District, that a special tax and/or assessment in the sum of $  13,200.00   be levied against all the tracts of land, lots, railroad companies and public highways within said Drainage District, same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed.

NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Wolf Creek Pumping District #2, that a special tax and/or assessment in the sum of $     0.00   be levied against all the tracts of land, lots, railroad companies, and public highways within said Pumping District and same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed.

BE IT FURTHER RESOLVED that the said levy and/or assessment be and the same is hereby certified to the Woodbury County Auditor who is hereby directed to effect said levy and/or assessment against all of the said lands, etc., in the same ratio and upon the same classification as heretofore adopted, established and confirmed and enter same upon the tax list of Woodbury County for collection with the first half of the current year real estate taxes.

RESOLUTION LEVYING SPEICAL ASSESSMENT AND CERTIFICATE
TO THE COUNTY AUDITOR OF WOODBURY COUNTY, IOWA

WHEREAS, the Woodbury County Board of Supervisors is the governing body of the Wolf Creek Pumping District #3 of Woodbury County, Iowa; and

WHEREAS, said Board, as Trustees, has determined that it is necessary to levy a special tax and/or assessment on all tracts of land, lots, railroad companies, and public highways within the boundaries of the said Pumping District.

John Van Eldick, 40th/Correctionville Rd, expressed concerns about dust control and road conditions in his area. 

Jose Montez, President of NW Iowa Building Trades expressed concerns about damage to signs on private property.

Motion by Nelson second by Carper to receive a document showing photos pf damaged property  from Mr. Montez.  Carried 4-0. Copy filed.

Lynette Ross, Lawton, addressed the board regarding the Salix Data Center protest as she described was a civil protest. 

Board concerns were heard.

The Board adjourned the regular meeting until July 28, 2026.
